the alleyway. we did not know if he was fired in the alley but for that reason he isb dangerous at this time" >> reporter: not the case says his mother. >> "he dosen't have a gun he is not dangerous, i just want him to turn himself in >> reporter: in antioch, haaziq madyun-kron4news >> pam: also developing tonight. the bart strike threat. we are days away from a decision that could trigger a caotic commute for the bay area. bart's contract negoitaions with its union are not going well. if a strike happens when it start? kron 4's justine waldman is here with us tonight to go over what could happen. >> reporter: there are several different way this could play out we'll start with the possibilty that there could be a strike. the union is meeting tomorrow to vote to authorize a strike. bart typically gives bart 72-hours notice when the strike will happen, but that is not a legal

requirment. when the strike will happen and how long it will last has not been determined yet. it doesn't have to happen on july first, the day after the contract expires. we should get some of those answers after the strike vote tomorrow. and the governor could also be involved for a " cooling off " period. it would last 60-days. that would keep the trains operating and give both sides more time to work out their differences. but after 60-days, that takes us into the fall, when ridership goes up 30% and the bay bridge is scheduled to be closed to open the new span. and bart is supposed to run 24-hours. that could be a mess. the phone calls to this governor's office were not returned today. finally, bart agents could work without a contract. this also keeps trains running and more time to negotiate. or bart could impose a contract on its agents.

bart is already preparting for a possible strike. by getting extra buses, ferries and figuring out how to coordinate carpools. we should get more answers tomorrow when and if the strike will happen. of course we will keep you posted. >> pam: if all is still a strike, that could still be a mess. bart officials say, they have not reviewed the lawsuit, so, they can not make a direct comment about the suit. however, they did have a sharp response to the assertion that bart is failing to make safety a top concern. >> we have been trying to bring the district to the negotiation table for over 40 years. this is nothing new. our members have been insulted, killed over the years. they have refused to

do it. the only way that we can get them to the bargaining table is by filing a lawsuit. >> andbart management says the real sticking points in this contract dispute focus on pension and healthcare issues. and that currently, employees do not contribute to their pension and only pay a small amount of their healthcare. >> as of right now we are talking with the union, that is what is important. we have negotiations in good faith at the bargaining table. one thing i want to make sure that to get across is a the is a priority for bart, 365 days a year not just when we are negotiating. it is something that we talk about with the budget, and our labor unions once per week and monthly. and how to prevent accidents from happening. to address any issues coming up, things like that. is ongoing. we do not need labor negotiations about safety i think that it is a smoke screen.

but first, our chief metorologist jacqueline bennet is in the weather center. >> jacqueline: the shower activity is continuing. we can show you where the rainfall is showing right now, portions of the east bay. walnut creek. with heaviest near concord and light showers near berkeley. as we move towards the peninsula, some areas of moderate rainfall over san mateo, redwood city. palo alto and over the water towards the east bay shores. it is going to be continuing as we move towards this evening. temperatures are in the '60s. we've seen traces of rainfall pretty much, everywhere. so far, rainfall in san francisco, traces. you can see phone:shower activity towards real fear towards fair. and currently, not reported rainfall in fairfield.

about what, if anything, the delay could mean. we spoke with the san francisco city attorney. the were supposed to meet and issue a ruling he was prepared to give a news conference. we spoke about weather the longer that this is takes if it is in favor of proposition 8? were against proposition 8. >> it is not thatintense flooding in canad uncommon. we have litigated this and a variety of forms. and with 50 different judges and it is not that -- on common. it is something that we are used to. is not that uncommon. we are always used to increment the decisions. >> does it mean yes or no

(chaos) this is video of traffic at a standstill on the bay bridge. in san francisco, cars clogged the on ramps to the bridge for hours. the other transit agencies around the bay area tried to compensate by adding additional bus routes. this is a shot of commuters lined up around the block at the old transbay terminal in

immigration reform has just passed the senate. with a vast majority. this signals that this will pass the senate thursday or friday. president were, and endorses this changes that will tighten border security and also provide a path of citizenship. for hundreds of illegal immigrants in the country right now. this issue will then go to the house of representatives which is controlled by the republicans. many conservative republicans do not support any illegal immigration and that would provide and citizenshi. bake immigratio reform. with big- immigration reform today bringing you updates as soon as we get them.
