>>james:good morning, top stories we are following for you on the supreme court has yet to rule on proposition eight and the defense of marriage act. the justices will reconvene this morning and we will be waiting to see which decisions are announced. and we are just days away from union workers and bart reaching a deal on contracts. the union strike vote is slated for today. we'll take a look at how some workers are gaming the system. and a little girl is safe this morning after being taken from her home and police are continuing to search for the suspect. >> we do want to start to

our morning with the weather check. it is raining out there. the morning erica. >>erica: we are certainly waking up to what roadways. you will need to use your windshield wipers. light rain right now on highway 1 01 over the golden gate heading into san francisco and south toward daly city. east shore freeway under that greene indicated that i trained looks like we are trying things out in the south bay. right now looks like the showers are situated in the heart of the bay area. satellite and radar and you can't see the size of the system. we have a lot of low cloud cover, yet again this morning and that will linger into the afternoon with a potential up often on showers. we've

seen a steady rain but light and certain spots. santa rosa almost reaching a half an inch, a 10th of an inch for napa. it looks like the north bay could see another half and to accumulate in be another quarter of an inch inside the bay. not too much in the south bay just yet, but still pretty misty conditions. here's a look at futurecast 4 into the 7:00 hour. the rain it grows in intensity at about an napa up. cloud cover will move on into the afternoon and evening hours and looks like a straight shower as a possibility heading home later on tonight. in terms of your afternoon highs, '60s and '70s out of their. antioch and 67, 69 in oakland. in terms of your extended forecast, 7 day around the bay looks like a dry weather into tomorrow and we turned a corner in

terms of those temperatures. we are in the low nineties for the next several days. tech look at a monday. temperatures flirted with the triple digits. more details on their developing forecast coming up in just a few minutes. meantime, i want to take a look at traffic. we are dealing with what rose parade approach to the boat bay bridge toll plaza, looks pretty good. no accidents to report on the bridge itself. west, 80 at ninth street, we do have an accident involving two vehicles, but looks like it has been pushed off to the right have shoulder. for those of you had to the san mateo bridge, traffic conditions equal in both directions. i am not seen any delays. and here's a very misty and cloud the shot of the golden gate bridge. we do have a wet weather to deal with working your way out of marin county. >>james: onto our major

headlines this morning. no decision has been made on same-sex marriage from the u.s. supreme court. but a ruling could come this morning. the san francisco city attorney says, whether the court rules in favor or against prop eight -- there will be a 25-day period before the court's final decision is entered into the records. that time allows both sides to file a petition for a re-hearing. experts believe that no matter what justices decide, california will soon have same sex marriages. however -- the u.s. supreme court has alreaady ruled on more than 20 cases this month. and the court is slated to announce a number of other major decisions before the current session ends. has details. >>charles: earlier in june of the justices ruled that dna samples could be taken from people rested with probable cause and felony cases. samples can be taken even without a warrant. on june 16th, the road ruled

that naturally occurring human dna cannot be patented. last week, the justices invalidated arizonas proof of citizenship requirement for voters. they said that federal law and regulation override the state laws. the supreme court also decided that financial agreements between the main drug companies a generic competitors can be legally challenged in court. and earlier today, they declined to make a broad ruling on the validity of affirmative action. instead the justices sent back to a lower court for additional review. now there are three big cases the accord has yet tacked on 3 nimitz finally decide prop 8 in which marriage is defined between one man at one woman. they also decide if the defense of america act or dome is unconstitutional in a ruling is possible and the fate of the 1965 voting rights act in which some states are required to get federal permission to change their voting laws. and the news room, charles clifford, kron4 news.

u-s army specialist javier sanchez junior of greenfield, california, near salinas. he died june 23rd in afghanistan. this is his photograph. sanchez died from wounds he suffered when his unit was attacked by an improvised explosive device. during patrol. he was assigned to the special troops battalion. 2nd brigade combat team in fort drum, new york. a baby girl kidnapped from anitoch. is back home, safe with her mother. police are continuing to search for the child's father, as the suspect in the case this is video of 11-month- old justice benton, being reunited with her mother yesterday in antioch. police say, her father, joshua benton, allegedly kidnapped the child from her home on rainier lane this morning. benton is considered armed and dangerous. coming up on the kron four morning news. and here's a live look outside. san mateo bridge a damper ride out there. riney lightly this morning.

>>james: we are back and it is for 10. a federal judge approves a one- million- dollar settlement. in a lawsuit filed against the city of oakland and alameda county. the money will go to 150- people who were arrested during this 2010 protest. related to the fatal shooting of oscar grant. kron four's alecia reid has the details. >> reporter: after a hundred and 50 protesters were arrested and detained.

>> they handcuffed me and put on buses and we were held for hours. they were hot. people urinate in the past because they weallod off td there was a gentleman who's so shoulder was dislocated by the oakland police department. that left him on the bus for hours. >> there were many violations by oakland police as its own crop control policies. in this case as well as clearly inhumane treatment by aliment county as how people were jailed overnight. when police are supposed to do is in order to disperse, give people ample time to disperse. they did none of those things. >> reporter: 4 protesters that filed the suit will each get $9,000 as any other protestor that files and approves claim will get 4500 to $5,000 a piece. the final

and on capp brought the entire day. it looks like we are catching a dry bed for the south bay but let's take a look at the rest of the bay area. we are in the grain which is good news indicating white. -indicated like conditions. you will need your windshield wipers for the south bay 101 ride. looking at the upper deck of the bay bridge freeway out oakland into the city. windshield wipers and needed. no reports of standing water or flooding but it is certainly slick out there so drive with extra caution. looks like we're picking up like ran over portions of highway 43 to concord to 82 getting in and out of walnut creek. depends on where you're located. you can see the showers are pop spotted. futurecast for tracking the timing even into the 7:00 hour. it looks like we're holding on to showers for places like napa up toward

to be in russia. after he didn't show up for a flight from moscow to cuba on monday. its believed snowden wants to get to ecuador. where he's asked the country for asylum. former secretary of state hillary clinton says she is extremely disappointed with china's decision to allow edward snowden to leave hong kong. despite a u-s request to arrest him. speaking in los angeles yesterday, clinton says snowden's exit set a bad precedent that could unravel extradition treaties or other legal agreements between countries. her comments echoed criticism from the white house that hong kong's refusal to detain snowden had "unquestionably" damaged relations with china. we're hours away from day 2 in the george zimmerman murder trial. and if yesterday's fireworks are any indication, we could be in for a very interesting few weeks. shannon travis is in sanford, florida this morning with the latest. president obama will focuses his attention on climate change today.

believe human are causing the earth to get warmer. that's up from 36-percent in 2009. another 23-percent believe the earth is getting warmer, but they believe it's the result of natural patterns. that's also up -- from 16- percent from 2009. the texas town devastated by a fertilizer plant explosion is suing two companies. on april 17th, a blast killed 15 people and leveled numerous homes, and damaged two schools and a nursing home. the city of "west" accuses adair grain of negligently storing ammonium nitrate on its grounds before the blast. their suit also accused c-f industries of selling about 200 tons of the compound to the company without investigating whether the plant could store it safely.

>>james: we are back at 540 this morning. --before 40 this morning--4:40. watching wall street this morning. futures trading shows all three indexes in the positive this morning. signs of financial concern in china and rising u-s bond yield sent global markets plunging yesterday and wall street followed. here's a look at the markets closed. the dow fell 140 points to end the day at 14,659. the nasdaq followed dropping 36 points closing at 3,320. and the s and p 500 finished the day down 19 points at 1,573. we'll be watching the stock market all morning long here on the kron four morning news, starting at 6:30 with the opening bell. a tokyo high court has upheld a lower court's

ruling that samsung did not infringe on apple's patent for synchronizing music and data across devices. apple asked for 100 million dollars in damages but the tokyo district court ruled in samsung's favor last august. the intellectual property high court upheld that decision today. this appeal case is one of many legal battles between apple and samsung. the court decision comes after apple won a separate patent infringement case against samsung in the tokyo district court last week. south korea has issued a cyberattack alert. shortly after government websites shut down on the 63rd anniversary of the start of the korean war. officials are still investigating who is responsible. they say several government websites and at least one media website in south korea were down. this comes following a cyber attack in march -- which promoted tens of thousands of computers and servers at south koreak broadcast station and banks to shut down.

there is a new trend in hotel check out policies that many say is long overdue. some are encouraging weekend guests to go ahead and rest this summer by offering late check-outs on sundays. a few hotels are altering check-out times all together so a guest can stay a full 24 hours at no extra fee, you just have to book it in advance. five-pm is about the latest a visitor can stay without cost. sunday nights tend to be the slowest for hotels so their isn't as much pressure for housekeepers to get the rooms ready for the next guest.

following on this tuesday, june 25th. we are waiting to hear what rulings will come down from the supreme court justices this morning. they did not make a decision yesterday on california proposition eight. we will be waiting to see if that ruling comes down today, or later this week. and, only five more days until the contract between bart and its biggest unions expires next sunday. the union strike vote is slated for today. so far there no progress, no headway, and no deal to avert a possible strike. a federal judge is ordering the state to move several thousand inmates out of two california prisons. >>erica: you will probably need to use when show wipers' today. as we do man, you can see surface streets affected. wet and slick

>>james: a federal judge is ordering the state to move several thousand inmates out of two california prisons. that is because the prisoners aren't i high risk of contract in a potentially deadly airborne fungus. a u.s. district judge ordered corrections officials to transfer most black, filipino and medically at risk inmates because they are more vulnerable to health problems from valley fever. the judge gave the state 90 days to comply. fever. the city of richmond is dealing with back-lash after riasing a gay pride flag and city employees are documenting their

displeasure with the show of support during pride month. an email recently went out to about 900 city employees.with at least one of them replying that richmond is not the castro.and raising the flag offends richmond's faith based community. several city officials, including the mayor support flying the flag.and say despite the opposition from some.it will remain on display until the end of june. this is the first time the city has raised a rainbow flag during pride. last week, *calistoga took down its pride flag after opposition from some, including a former calistoga mayor. a woman was arrested after allegedly stabbing a man with a pair of scissors in san francisco's united nations plaza. the victim, a 60-year-old man, was stabbed in the shoulder at about 1:35 a.m. the attacker fled but she was located and taken into custody. the victim was taken to san francisco general hospital for treatment of his wound, which was not considered life-threatening.

some quick thinking neighbors may have helped save a man's life. from a house fire in walnut creek. this is video a neighbor took with her cellphone. dawn and ken tuttle said, they had just gotten home from work, and noticed the smoke coming from their neighbors home. and called 9-1-1. the quick action of the neighbors may have been what saved the resident from more serious injuries. >> it was really bad smoke. they came really quick and took them a little bit to get in to the building. they went through an attic and through the front door and actually drag him out and he was pretty burned. >>james: the man inside the burning house -- suffered from minor burns and smoke inhalation. he was taken to a hospital.
