clean-up efforts are under way today in downtown oakland after a third night of demonstrations against the acquittal of george zimmerman in the trayvon martin shooting case left windows smashed and the streets littered with debris. police said nine people were arrested in connection with monday's protest, and a local businessman said one of the protesters assaulted a waiter. >> catherine: tier of more lawsuits could be the reason for the police standing by. >> i think that has something to do with it. we just paid out a couple of lawsuits cubicle we were picking about king off lawsuits that had gone on the freeway before. they claimed that we brought them up a little bit so we pay close to a million dollars to deal with that suit. >> reporter: is there is

(crying) said >> reporter:firefighters continue to battle a brush fire in southern california. what you see is called the mountain fire. near idyllwild. and eight thousand acres have burned and mandatory evacuations are in effect. firefighters say it is only ten percent contained. several homes have already been destroyed or damaged, but officials don't have an exact number. damage assessment teams are surveying the aftermath. three firefighters have suffered minor injuries, and are expected to be o-k. there is a camp in the area. camp ronald mcdonald for good times -- where 230 kids are -- has not been

just gone " >>when it comes tong >> catherine: of groups have found common ground. rights activists, church leaders and gun rights advocates have come together to file a lawsuit. they want the n-s-a to stop its electronic surveillance program. the suit was filed here in san francisco. the main plaintiff is the "electronic frontier foundation" = or e- f-f and it's based in the city. members say that electronic surveillance is illegal and unconstitutional. it also wants an injunction the justice department and f-b-i. there's no comment yet from the agencies being sued. >> catherine: happening now. there's still no deal on a new bart contract but both sides are at the table. talks reportedly resumed just after 4 p-m. there were talks yesterday as well. a union rep says they only lasted 20 minutes, but bart officials say they actually went on much longer. the four day strike earlier this month was a headache for commuters. and cost the bay area roughly 73 million dollars. both sides have less than three weeks before a second

oakland store six days ago. kron4's terisa estacio is live in oakland. where the toddler's family spoke earlier today. terisa? >> reporter:this is a complicated case. with a lot of unanswered questions. at a news conference a short time ago. daphne's father did not attend. her mother was here, but she didn't speak and wouldn't say when she last saw her little girl. kron four news has learned, she is supposed to stay 100 yards away from the daphne because she was convicted of doing drugs with daphne in the car back in february. before speaking at the news conference, the group of family and friends joined hands for a prayer. there was about 2 dozen people in attendance. some held signs and large pictures of daphne.
