latest, dan carmen, kron 4 news. >>james:onto a national story. a 4-year-old michigan boy found something unusual in a fast food meal. a pipe -- loaded with marijuana. it happened tuesday at a burger king in the town of dundee. the boy's grandfather went back to the burger king to talk with a manager - and police. that's when he noticed something suspicious going on in the parking lot between an employee -- and two other people. >>erica:"he did a really great thing. he wrote down a description of the car and gave a license plate, wrote it down and gave it to my officer when he arrived at the scene and my officer was able to locate those two suspects and they admitted police still aren't sure how the pipe got into the boy's meal. but all three suspects are facing charges for possession of marijuana. at 40 level will take a break. cloudy out there this morning as once again we are

they responded to a shot fired call around 1030 last night. when they showed up, they show that off-duty officer inside the market and police say what it was inside that market, two masked armed robbers entered in tried to hold up the store. fearing for the safety of himself and the other customers, the off- duty officer shot and killed one of the masked man. police say the second person got away and they are currently checking in the area as well as with hospitals because they said the second person might have been hit by that office-just off-duty officer. this is an ongoing investigation. police tell me they will have the a block tape down. at a second robber--second robbery that happened here at this market about eight days ago. they are looking in to see if there was any connection. >>james: the investigation

shooting in the block a bill. it all started around 7:00 last night when police got a call about a suspicious man and south of vacaville. officers respond in tried to talk to the man but he refused and instead led them on a brief car chase. it ended with a suspect in getting out of his car and charging officers with three weapons including a knife and hammer. that's when police opened fire killing him. the man's identity has not been released. no one else was injured. the san mateo county coroner's office will release the results today on how one of the asiana vic tims died. the report will reveal whether 16 year-old ye mengyuan was killed in the crash or run over by an emergency vehicle. asiana

flight 214 crashed landed at sfo on july 6th, that judge killing three people and injuring dozens. the ntsb is still trying to figure out the cause of the crash. but initial investigation shows that the plane was flying too low at dangerously slow speeds. negotiators for bart and it's unions will be back at the bargaining table this morning. contract talks are set to resume at 9:00. as we've reported, both sides still seem far apart on an agreement. union leaders have threatened to strike again if a new contract isn't hammered out by august 4th. workers say they are prepared to walk off the job for much longer than the four days we saw at the beginning of the month. we'll keep you updated on the negotiations. a community is mourning the

juries have found two men guilty of taking part in the gang rape of a 16-year- old girl. marcelles peter and jose montano both have been found guilty on all counts forceable rape in concert, rape with a foreign object and forced oral copulation. the incident happened outside the victims school during a 2009 homecoming dance. the victim had been drinking alcohol. police say as many as a dozen men were on the scene when she was raped and beaten. prosecutor john cope says justice has been served. the verdicts are in for two of the defendants in the richmond high school rape case. guilty on all counts. august 15th.
