latest, dan carmen, kron 4 news. >>james:onto a national story. a 4-year-old michigan boy found something unusual in a fast food meal. a pipe -- loaded with marijuana. it happened tuesday at a burger king in the town of dundee. the boy's grandfather went back to the burger king to talk with a manager - and police. that's when he noticed something suspicious going on in the parking lot between an employee -- and two other people. >>erica:"he did a really great thing. he wrote down a description of the car and gave a license plate, wrote it down and gave it to my officer when he arrived at the scene and my officer was able to locate those two suspects and they admitted police still aren't sure how the pipe got into the boy's meal. but all three suspects are facing charges for possession of marijuana. at 40 level will take a break. cloudy out there this morning as once again we are

they responded to a shot fired call around 1030 last night. when they showed up, they show that off-duty officer inside the market and police say what it was inside that market, two masked armed robbers entered in tried to hold up the store. fearing for the safety of himself and the other customers, the off- duty officer shot and killed one of the masked man. police say the second person got away and they are currently checking in the area as well as with hospitals because they said the second person might have been hit by that office-just off-duty officer. this is an ongoing investigation. police tell me they will have the a block tape down. at a second robber--second robbery that happened here at this market about eight days ago. they are looking in to see if there was any connection. >>james: the investigation

shooting in the block a bill. it all started around 7:00 last night when police got a call about a suspicious man and south of vacaville. officers respond in tried to talk to the man but he refused and instead led them on a brief car chase. it ended with a suspect in getting out of his car and charging officers with three weapons including a knife and hammer. that's when police opened fire killing him. the man's identity has not been released. no one else was injured. the san mateo county coroner's office will release the results today on how one of the asiana vic tims died. the report will reveal whether 16 year-old ye mengyuan was killed in the crash or run over by an emergency vehicle. asiana

flight 214 crashed landed at sfo on july 6th, that judge killing three people and injuring dozens. the ntsb is still trying to figure out the cause of the crash. but initial investigation shows that the plane was flying too low at dangerously slow speeds. negotiators for bart and it's unions will be back at the bargaining table this morning. contract talks are set to resume at 9:00. as we've reported, both sides still seem far apart on an agreement. union leaders have threatened to strike again if a new contract isn't hammered out by august 4th. workers say they are prepared to walk off the job for much longer than the four days we saw at the beginning of the month. we'll keep you updated on the negotiations. a community is mourning the

death of an eight-year-old oakland girl. here is what we know this morning. no arrests have made. police don't have a suspect or a motive. they say a man knocked on the door of an apartment just before 11:30 on wednesday night on the 34- hundred block of wilson avenue. then opened fire on the people inside. 8-year-old alaysha carradine was shot and later died at oaklan'd children hospital. she was visiting her friend for a sleep-over. two other children were also wounded. so was their 64-year-old grandmother. police investigating the shooting say they are determined to catch the killer. return to index of ------------------------ 8-year-old alaysha carradind would have been a

third-grader at fruitvale elementary in the fall. a memorial is growing in front of the home of the slain 8-year-old girl, and police are searching for the shooter. kron 4's will tran is live in oakland with the latest on the investigation. people from the neighborhood where alaysha was killed held a rally last night. won't be kept. homeland seurity secretary janet napolitano has been confirmed as the new president of the university of california system. some students weren't happy about that -- citing her role in deporting illegal

immigrants during the obama administration. 6 students who refused to leave were handcuffed and arrested. one was taken to the hospital with minor injuries. napolitano is the first female president of the u-c system. she defended her track record on immigration, saying she's been an advocate for the federal dream act. she'll get a salary of 570 thousand dollars a year. we will be right back.

welcome back. watching wall street this morning, futures trading shows all three indexes negative right now. investors are hoping the bulls keep running on wall stree today. earnings gains at major u-s companies and encouraging economic news pushed u-s stocks to record levels

yesterday. the dow rose 78 points. the nadsaq gained one point. and the s-and-p - rose eight points. opening bell is at 6:30. detroit became the largest u-s city in history to file for bankruptcy. the city's plan now is to cut 11-and-a-half billion in unsecured debt -- including pensions-- down to two-billion dollars. that could slash pension benefits and leave investors holding the city's debt. experts blame things like the sharp decline in population and tax revenues.and an unemployment rate of nearly

19 percent. a judge has ruled that a case challenging the claims on vitaminwater as misleading can move forward as a class-action lawsuit. attorneys representing the health-advocacy group center for science in the public interest and consumers from several states have accused coca- cola of using deceptive labeling on vitaminwater beverages, including claims that they reduce risks of disease and boost the immune system.

the judge said that the plaintiffs can seek injunctive relief, which would prevent coca-cola from making certain claims for the product. but he said the parties cannot seek financial damages.

peers deliberated for 11 hours. the 59 year old man from west contra costa county says some reached their verdicts sooner than others. mostly because they needed to understand the law. juror one / jose montano juror number 1 was partically struck by the young ages of the victim, defendants and witnesses. he called the process emotional for the entire jury. in martinez justine waldman kron 4 news
