>> the bay area is a few weeks away from another possible bart strike. bart workers can return to the picket lines if bart management and the union don't come to an agreement. the 60-day cooling off period issued by governor jerry brown ends on october 11th. kron 4's dan kerman reports on the latest in negotiations between bart management and bart unions. >> i think everything is very positive on both sides. >> he is still pushing the same proposal that management put on the table 30 days ago. >> our offer is the final offer. >> he failed to mention that

the union had mold and they put out a counter proposal. >> this is more than $10 million m reduction. >> union members stated that this is a show of goodwill that will do what it takes to avoid a strike. >> >> we will come back with a counterproposal and then at that time we can start serious negotiations. >> the unions promised the public a game changing proposal. this is my game changing. not even a significant movement. >> the last i heard we were at a hundred million dollars apart. we need to see a lot more movement. >> the union's proposal has mold a little bit in their minds. bart management

stated that there will be no resolution anytime soon. again, the cooling-off period expires october 11th. the first day of a possible strike would be october 11th. >> violent and gang -related crimes have dropped in san jose this year. the news comes following a long term strategy the city's police department implemented focusing on suppressing gangs. for the first nine months of the year crimes have been reduced across the board. the 'violent crime reduction plan' was put in place back in june -- that sent extra officers from special operations and gang units to patrol evenings and weekends. police say, as for crimes overall-- their violent crime reduction plan has resulted in: 357 searches 83 arrests 56 warrant arrests 88 criminal citations but although crime rates have dropped-- some officials are concerned these high visibility patrols working on an overtime basis may soon get worn out. >> sot- my concern is that

again. >> concerns about the fairness and the costs of mandatory minimum sentences have been growing in congress. the senate judiciary committee is set to hold a hearing on mandatory minimum sentences this week. the committee is considering two bills, which would allow judges to waive the mandatory minimums in many circumstances, particularly for some drug crimes. tomorrow's hearing is the first step in legislation that advocates and lawmakers in both parties say stands a chance of winning enactment by the end of the year. >> the ranks of america's poor are expected to decline slightly when new census figures are released. the census bureau is releasing its annual report on u-s economic well being for 2012 today. analysts predict the poverty rate will decline by up to half a percentage point from its current level of 15-percent. or 46-million people. it could be the first decline since 2006.

today welcomed the mexican museum to its future home in the city's yerba buena neighborhood, where it will join several other museums dedicated to cultural history and the arts. the museum, currently located at fort mason, is scheduled to move in 2018 to its new location at 706 mission st., where it will occupy the first four floors of a mayor ed lee joined other city officials today to welcome the museum to its planned new home, located off of jessie square plaza near the contemporary jewish museum and st. patrick's church. lee said the museum, which is san francisco's lone affiliate to the smithsonian institution in washington, d.c., is an example of art and cultural institutions that billion in visitor annually. he said, "where else in the beautiful gem of a museum?" today's event was also on which city supervisor david campos said more than 14,000 objects eras of mexican history as well as other latino art, but museum officials say the fort mason site is too website at

watching wall street this morning. futures trading shows all three indexes positive this morning. stocks were helped yesterday by news that former treasury secretary larry summers had withdrawn his name as a candidate to be chairman of the federal reserve board. here's a closer look at the closing numbers the dow closed up 118. the nasdaq lost nearly five points. and the s and p 500 climbing nearly 10 points to end at one the highest closes of the summer at 1,697. opening bell today, 6:30. >> it is easily one of the

linepolice have arrested registered sex offender. christopher miller for allegedly engaging in lewd behavior toward children at a mountain view walmart. other police agencies have also identified the 70-year- old man. as a suspect in similar incidents at a fast food restaurant in union city. and a sexual assault incident in a san mateo book store. police say, charges against miller are pending. they add. there may be other victims involving the suspect. >> we have seen our first protest on the new eastern span of the bay bridge. a small group of people marched along the walkway of the new span this past weekend over the crisis in
