>> welcome back. within a potential government shut down looming, republicans are trying to use the opportunity to defund president obama as health- care law. not everyone in the republican party agrees with the assessment of the bill. congressman peter king, an opponent of the affordable care and sharply criticized the measure saying that it does not have any chance of succeeding. september 30th it is the last day of the fiscal year, unless congress passes a spending bill, the government may face a partial shutdown. the republican controlled house resolution to fund the government will pass in the democrats credit controlled senate, but that will stostrip up the writer. >> the time is 6:41 a.m..

>> 18 year-old girl is recovering this morning after she was shot while she was sleeping in her bedroom yesterday. it happened in hayward on tam but ave. her three siblings and parents were not hurt. police are looking as to why her parents and did not report the shooting until hours later. the girl was still in the hospital but is expected to be okay. police say there is no suspect in custody. >> the city of san leandro has a suspended the plan to fly the chinese flag at city hall. mayor stephen cassidy had planned to raise the flag to mark the founding of the people's republic of china on october 1st. the mayor decided that
