doctors to evaluate physical and mental health. this is a picture of the suspect michael montgomery via his facebook page. he you can see this video. has not yet been charged with a crime. his father tells a lodi paper that his son acted in self defense when the victim in this case began swinging chairs at him his son stabbed him... him. the district attorney's office told me this afternoon that their office has not yet received the case but will likely receive it sometime this evening then charges could happen. jonathan denver is the dodgers fan who was killed. he is from the fort bragg area. when asked about fan violence this is what the district attorney had to say. >> well, first of all i do want to say that this case we do not know one way or the other ones we are able

>> pam: a live look now at san francisco on this friday. blue skies -- weather is nice. but that could be changing soon. a chance of rain is on the way. the full foreacst is ahead. >> an elderly san francisco couple. is fighting to keep their apartment. after they've been told to leave because the new owners decided to remodel the building. the family was supposed to move out this week, but received a temporary reprieve from the sheriff's department. kron 4's charles clifford has the story.

>> reporter: on thursday afternoon gum gee lee who doesn't speak english, said through an interpreter that she, her husband poon heung lee and their daughter, are being evicted from their apartment here in the 1500 block of jackson street in san francisco and that they haven't found a new place to move to the lee's have lived here for 34 years and are now the last tenants in the three unit building. the previous owners sold the property and the new owners want to remodel the apartments. the lees and the other tenants were given buyouts, but the lee's daughter is disabled and receives care here in san francisco. the family is on a fixed income and couldn't find anywhere in the city to move to, so they decided to stay. omar calimbas, a lawyer with the asian law cacus, has been helping the family. they have been trying to find different affordable housing but there has not been anything available. >> reporter: it's a story that's playing out all to often in san francisco, where the booming economy has made rent prices soar. in california, the ellis act allows owners to evict tenants if they plan to take the building off the rental

market. calimbas says the law has hit low income families hard. >> basically it forces them to move out of the homes for doing nothing wrong. a lot of times the half to leave the city. >> reporter: as for the lee's, the san francisco sheriff's department has given the family another week to move out. after that, their future is up in the air. >> it is not enough but for them they are able to stay at least they will get the weekend. >> reporter: in san francisco, charles clifford kron 4 news. >> catherine: a united airlines flight had to make an emergency landing in boise last night. after its pilot had a heart attack - and later died. the 63-year-old pilot was still alive when the plane touched down.but later died at the hospital. the flight had been headed to seattle from houston. one passenger says the pilot appeared to weigh over 300 pounds.and was taken from the cockpit to the first class cabin where a doctor performed c-p-r. an off-duty pilot helped

with the emergency landing. passengers waited at the boise airport until united flew in another pilot from san francisco. >> a man who fell onto the subway tracks in boston this week is going to be ok. it was a nasty fall -- and all caught on surveillance video. he walked full speed off the station platform - as though he didn't even see the edge. and fell hard. within seconds - people jumped into action. some of them called for help - and three men actually jumped onto the tracks and hauled the unconscious man back to safety. we'll slow it down a little for you. people who watch this say it's surprising the man wasn't more seriously injured -- his head seems to hit the metal rail when he falls. the 33-year-old man says he had two drinks to celebrate passing his medical boards and was waiting for a train home - but doesn't remember anything else. >> pam:

cortes in court this week- he is now facing multiple charges of having sex with a minor. cortes says he met the victim several years ago at santa clara high school and became close to her because she had reportedly a troubled home life. during an interview with police captured in court documents the detective quote says "i asked cortes who came up with the idea to have sex. he stated that it was mutual, it just cortes further admits that the sexual encounters occurred in his suv - and that the two often slept in his car because cortes was living out of his vehicle due to some debt issues. he also revealed the two went on several trips together and that he routinely picked her up from her weekend job as well as took her home. documents also reveal how this case came to light. a janitor cleaning corte's room noticed the two together and felt something was odd. the janitor later found a mattress under
