heard back. his father told the newspaper that it is a self defense pact. and he says that they started swinging chairs it was a self-defense act. they are going to proceed cautiously. >> first of all, i do not want to jump to conclusions involving violence. once we are able to review the evidence we will be able to speak to that issue. >> reporter: the district attorney also said that in a statement including independent witnesses. the victim's family is also calling later with more details on that coming up tonight at 8:00 p.m. reporting from at&t park, michael and, kron 4 news. >> thanks mike.

san francisco police will charge an elderly woman in a fatal san francisco crash. police say the woman was speeding when she rear ended a mini-van friday morning. the crash killed a 16 year old teenager in san francisco's lower pacific heights neighborhood. police have not released the identity of the driver. kron 4's alecia reid has an update on the condition of victims of that horrific crash. >> lying in the hospital or a mother and a daughter who are now fighting for their lives after surviving this crash. a student from lincoln high school was also in the car on friday morning. when they were sitting at redline

laying in this hospital are a mother and daughter who're fighting for their lives after surviving the deadly crash teenager kevin san a student from lincoln high was in the car with his mother and sister friday morning sitting at a stoplight on pine and gough streets when a speeding car barrelled minivan. he died at the scene. his mom is in critical condition, and his sister aileen has serious injuries.their van hit another vehicle, injuring an employee from james stanfield catering. we're told he's home, but feeling very sore from the hit. when he'll be returning to work has yet to be determined. up to 80 miles per hour, through red lights.at one point speeding past a patrol car on polk street. unfortunately cops didn't catch up to her until after damage was done. police say the woman responsible for the deadly crash escaped with only minor injuries. reporting from sf general hospital. alecia reid, kron 4 news.

lost and still not found. a 57-year-old san francisco woman has been missing for a week now. lynne spalding was a patient at san francisco general hospital before she vanished last saturday. kron four's philippe djegal explains her disappearance is still a mystery. she got away is still a mystery. friend of lynne's for now. the san francisco police department is treqating this as a missing person case. david perry. a close friend of lynne spalding speaking on behalf of her family. says she checked into san francisco general hospital last thursday. she was being treated for a bad urinary tract infection. two days later. on saturday morning. despite hospital employees checking in on her every fifteen minutes. she went missing at around 10-30. >> if you recall, there were heavy rains that morning. if she was confused on the medication and perhaps headed home. >> reporter: the hospital has not commented on how this could lynne's since then, friends and family have been posting up fliers like this. asking for the public to help track her down. police are also looking for her. everyone hoping for a happy ending. in san francisco, philippe djegal, kron four news.

>> police in antioch are investigating a shooting that killed on person and injured last night. the shooting happened in a home on banyan way near sycamore drive at about 10 p-m. officers say they found two men suffering from gunshot wounds when they arrived to the home both victims - a 24-year- old oakley resident and 20- year-old suisun resident - were taken to the hospital. the 24-year-old died and his name has not yet been released. no word on the condition of the 20-year-old. no arrests were made in the shooting.

>> a new report finds communication problems played a role in the deadliest fire in arizona history.. investigators met with the families of 19 firefighters killed while battling the yarnell hill fire in june considered one of the worst in the u-s in 80 years. according to a new report the firefighters were trying to get to a designated safe zone when a sudden change in wind caused the wildfire to split and spread dramatically. the fire trapped all 19 firefighters. one of the lead investigators talked about having to re-live the tragedy with the families of the victims >> "it is everything you would have expected: anger, frustration and just a overcoming sense of loss. it was a very emotional meeting, both for the families and actually for us, as we were there to try and respond to their questions and answer to the best of our ability what was in the report, but it was a very difficult time." >> the report also says the command center lost contact with the team for about 30 minutes.

the state of california just passed a new law it's bieng called the three foot law and it's to protect bicylist no not the riders that are

using ths sidewalk, it's for people using the roadway along with cars, trucks and buses the three foot law creates an invisible buffer zone around bicyclist to give them an added piece of protection the law goes in to effext in 2014 what this means, cue the bad behavior here: when you see a bicyclist you can't pretend you are in an imaginary race you have to give the rider space because let's be frank even though you are passing up the bicylist you both will end up at the same light unless the bicylist were to run said light and speed up to a suv making an illegal you turn you are on your own then this sign reads change lanes to pass, bicyclist allowed use of full lane which means if there is no dedicated bike lane the bicyclist gets to use the full lane and if a drivers want to pass they must change lanes a law that is ignored every single day my point is. this is going to be an intresting law to enforce because in some areas the bicylist are all over the place this rider stuck between this bus should have realized that a transit bus is going to pull to the right so riding in between is a fail this bicylist probably should have lookes for a safer route and waited to cross instead of running the light it might be hard to keep the three foot buffer if the rider is going the wrong way, or is in the middle of the roadway weaving in and out of traffic now if driver fail to give the ridet the buffer they ticket will be 35 dollars plus court fees which will put the ticket somewhere around 300 bucks now if you hit the cyclist because you ignored the three foot law the base fine jumps to 220 dollars .which would put the ticket including court fees somewhere around a thousnad bucks you know this might be a good time to invest in a dash cam because it's going to be a lot of he said she said arguments over this new law just saying in san francisco stanley roberts kron 4 news live look outside. walnut creek. in a story you will only see on kron 4. the alameda county district attorney's office-- is now filing charges against a hayward man accused of beating his dog. this video of ter-rell daniels appears to show him beating his dog repeatedly with a belt. the video was posted on instagram by daniels' 17 year-old son. kron four's philippe djegal has more on the charges. and where the case goes from here. the man who police say, killed a san francisco state student has now been charged with murder. nikhom appeared in court on friday. investigators say he killed justin valdez-- as he was getting off a muni train near the university on monday.

the district attorney's office says tep- kay-son was seen waving a handgun in front of a thai restaurant before the shooting. and that he may have assaulted another man. with the details. and we are learning new details in the san francisco fatal crash that killed a teenage boy. we'll explain what police are saying now about the woman responsible. and a government shutdown looks more likely. we have a report from washington. the father of a dodgers fan killed near at&t park this week is asking witnesses to come forward. he is going to make a public plea today before the giants game. and joining us live now with more from at&t park is kron 4's mike pelton. good morning mike. thanks mike. san francisco police will charge an elderly woman in a fatal san francisco crash. police say the woman was speeding when she rear ended a mini-van friday morning. the crash killed a 16 year old teenager in san francisco's lower pacific heights neighborhood. police have not released the identity of the driver. kron 4's alecia reid has an update on the condition of victims of that horrific crash. laying in this hospital are a mother and daughter who're fighting for their lives after surviving the deadly crash teenager kevin san a student from lincoln high was in the car with his mother and sister friday morning sitting at a stoplight on pine and gough streets when a speeding car barrelled into the back of their minivan. he died at the scene. his mom is in critical condition, and his sister aileen has serious injuries. their van hit another vehicle, injuring an employee from james stanfield catering. we're told he's home, but feeling very sore from the hit. when he'll be returning to work has yet to be determined. the speeding car was going up to 80 miles per hour, through red lights.at one point speeding past a patrol car on polk street. unfortunately cops didn't catch up to her until after damage was done. police say the woman responsible for the deadly crash escaped with only minor injuries. reporting from sf general hospital. alecia reid, kron 4 news lost and still not found.

a 57-year-old san francisco woman has been missing for a week now. lynne spalding was a patient at san francisco general hospital before she vanished last saturday. kron four's philippe djegal explains her disappearance is still a mystery. friend of lynne's for now. the san francisco police department is treqating this as a missing person case. david perry. a close friend of lynne spalding speaking on behalf of her family. says she checked into san francisco general hospital last thursday. she was being treated for a bad urinary tract infection. two days later. on saturday morning. despite hospital employees checking in on her every fifteen minutes. she went missing at around 10-30. the hospital has not commented on how this could have happened. sot-david perry/ friend of lynne's since then, friends and family have been posting up fliers like this. asking for the public to help track her down. police are also looking for her. everyone hoping for a happy ending. in san francisco, philippe >> the weather was awful, we do not know if she got on a muni we are working very closely with the homeless shelters. public

mazda is recalling midsize cars to fix defective door latches. the company says door latch screws on mazda six cars from 2009 to 20-13 may loosen and possibly open while the car is being driven. more than 161 - thousand cars are being recalled in the u-s. mazda traced the problem to improper tightening at the factory or uneven door surfaces. the recall starts around october 18 - th.

in a story you will only see on kron 4. the alameda county district attorney's office-- is now filing charges against a hayward man accused of beating his dog. this video of ter-rell daniels appears to show him beating his dog repeatedly with a belt. the video was posted on instagram by daniels' 17 year-old son. kron four's philippe djegal has more on the charges. and where the case goes from here.

the man who police say, killed a san francisco state student has now been charged with murder. nikhom appeared in court on friday. investigators say he killed justin valdez-- as he was getting off a muni train near the university on monday. the district attorney's office says tep- kay-son was seen waving a handgun in front of a thai restaurant before the shooting. and that he may have assaulted another man. ". hunting for a victim." tep-kay-son is also a student at s-f state. but it is not believed the two men knew each other. tep-kay-son was arrested at his home tuesday, blocks away from the murder scene. police say he had 20- thousand dollars cash, two assault rifles, four large knives, and a back pack full of survivialist gear. a judge denied his bail.

burning near yosemite national park. has charred more than 257- thousand acres. and it is not over yet. the fire, which started on august 17th, is only 84% contained. full control is not expected until sometime next month. kron 4's charles clifford visited the burn zone. where the forest service is already working on a plan to repair the damage. r >> reporter: the rim fire has burned more than 400 square miles in the stanislaus national forest and yosemite national park, leaving behind charred wilderness. . like you see behind me. . . with black ground and burned trees. technically this fire is still burning. there are hotspots and smoldering flames still in the burn zone. firefighters are in the area trying to put out those hotspots, but as the firefighting effort dies down, the us forest service and the park service are starting to focus their efforts on forest restoration> maggie dowd is the district

ranger for the stanislaus national forest. she says the first job that needs to be done, and it's already underway , is clearning out a lot of the burned timber. charred trees like these could fall over without >> and then after that we're looking in to the restoration work which could be many different treatments like replacing culverts, managing soil stabilization and planting ofcourse >> reporter: the next big challenge is preventing soil erosion . the fire burned away a lot of the grass and shrubs that held the soil together. heavy rains could wash this loose dirt into the nearby streams and rivers, ruining water quality and damaging natural habitats. >> certainly, we want to move forward with and destabilization. the fire has damaged a lot of the slopes that are in that canyons. we need to repair the stream beds to bring back the aquatic wildlife >> reporter: of course, it will take a long time for the forest here to return to what it was like before the fire. but dowd says that even though the rim fire is still burning, the forest is already healing on it's own. there's new growth even within the last week or so. there certainly is a rebirth occurring even as we speak.
