are folling this monday morning-- strike deadline by 24 hours tonight, granting bay area commuters a day's grace, but blasted bart leadership for what they called a refusal to negotiate. bart leaders "unceremoniously yanked their offer and gave us a last, best and final offer, which is a indication of an impasse and that they are no longer willing to local 1555. the union would not go on strike tonight because "the public deserves better" but warned that time was limited. lt. gov. gavin newson was there and expressed optimism. >> we want the begins to not strike and, out and say that they will not strike. it is getting beyond ridiculous. we do not think that 1400 members should hold 400,000

daily commuters hostage. we are talking about millions of commuters per week millions of dollars in revenue. district one more day, one the dishonesty and the riding public." two sides had come close to reaching a deal but remained including work rules the back and forth between bart unions and management riders. one man saying he was there to represent riders-- picketed much of the day yesterday outside the building where negotiations were going on. calling for a ban on transit strikes, the protestor paced the block. at times marching in front of union members as they walked in and out of the building. the bay area an orinda city councilman also spent the day handing out flyers at the rockridge bart station, trying to gather signatures for a petition, in support of changing state law to keep transit workers from walking off the job. he says he's collected thousands of signatures for his on-line petition. other transit agencies are

preparing to handle extra passengers just in case of a second possible bart strike. kron 4's grant lodes explores other ways of getting around. >> bart's charter bus service. bart is paying about 900-thousand dollars for buses. starting on friday 150 buses will be ready to shuttle commuters. you can catch the free bus at the following 9 stations el cerrito del norte, west oakland, lafayette, concord, walnut creek, dublin/ pleasanton ,hayward fremont and san leandro the buses will go to the san francisco transbay terminal from 5 am to 8 am. there will be 5 to 15 buses at each station on weekdays. parking at the bart stations is also free in the event of a strike. bart would increase the amount of buses to 200 for next week. a-c transit will put its biggest buses on its busiest routes which includes 60- footers making transbay runs. the fares stay the same. and sf bay ferry will put out all available vessels. the special schedule will have departures every

was missing in the mendocino national forest for 18 days after he slipped and lost consciousness in steep terrain has been rescued and is in surprisingly good condition. the ukiah daily journal reports today that 72-year-old gene penaflor survived in the yuki wilderness by eating squirrels, lizards, a snake, berries and algae and covering himself with leaves to stay warm. penaflor had been missing since sept. 24. oakland international airport rolled out a tsa pre-check program today that will allow some travelers to keep their shoes and jackets on when passing through security. the pre-screening initiative allows expedited screening for qualified passengers that allows them to keep their shoes and light jackets on and keep their laptops in their cases, according to port of oakland a dedicated pre-check lane will initially be open only in terminal 1 during peak hours. during off-peak hours expedited screening will be conducted in regular security lanes, a pre-check lane is expected to be added to terminal 2 by the end airport experience,"

a huge relief and clean-up operation is under way in eastern india. after cyclone phailin blew away houses and trees. fourteen people were killed. this was the strongest storm to hit the area since 1999 -- many feared it would be much worse. almost a million people were evacuated ahead of time. and in southern china. a storm warning was issued last night in an effort to prevent damage by typhoon nari. local authorities have been urging locals to prepare for the tides. heavy rains hit the area, with winds up to 85 miles- per-hour. the typhoon is categorized as an orange-level, which is the second-highest warning in china's weather warning system.

in new york, baby hope was found murdered more than twenty years ago. margaret conley shares more on the investigation and how a little girl's death touched a community. rit wa a break that caught an alleged killer and revealed baby hope's real name. >> "detectives from the bronx violent felony squad apprehended conrado juarez age 52 of the bronx, also known as enidino juarez in connection of the murder of 4 year old anjelica castillo -- a child victim known for the last 22 years as baby hope." >> reporter: retired detective, jerry giorgio, had heard from colleagues they were close to solving the case >> "when i got the phone call i got the news i was elated just i was up on cloud 9." >> reporter: he was the lead detective in 1991. the decomposed body of a 4 year-old girl was found stuffed in this cooler, discarded by a highway. her body was folded in half

and bound. she had been sexually abused. no one ever claimed the body. days turned to months turned to years. by 1993, the 34th precinct squad had given the little girl the name baby hope, and a face - recreated by computer rendering. the squad also paid for her funeral. >> "there wasn't a dry eye in the bunch, including me.the church was full, about 500 people in the church. she truly became a member of the community." >> reporter: anniversaries passed, but police persisted - and finally a break. police recently got a call on their hotline - the caller said she'd been told several years ago by a young women that her parents had killed her sister. that tip, and advances in dna testing, led cold case detectives to find the mother of baby hope. and eventually arrest the cousin who police say murdered her. at her funeral over two decades ago assistant chief joe reznick delivered her eulogy. >> "the justice is gonna be when some judge lowers his gavel and says, 'you're

>> we are just 3 days away from the debt ceiling, and a possible u.s. default on its debt. and after it appeared that democrats and republicans were closer to a deal in the house of representatives. it was announced this weekend that there would be no deal in the house. and that it was up to the senate to come to some compromise. for the debt ceiling. as well as funding the government, which has been shut down now for 14 days senate majority leader harry reid and minority leader mitch mcconnell spoke sunday but failed to agree on a deal to raise the nation's borrowing authority above the 16-point-seven trillion dollar debt limit or reopen the government. that deadline is this thursday the treasury is saying that they are out of money.

just a reminder, there is no bart strike this morning. flights have resumed at los angeles international airport this morning -- following a small explosion. investigators say a plastic bottle -- with dry ice inside --- exploded in an employee restroom on saturday. that prompted officials to briefly shut down terminal 2. no injuries were reported -- and the terminal is back open. federal investigators are trying to figure out who is responsible. >> more than 100 people have been killed during a stampede at a hindu festival
