>> it took six months for bart and its unions to come to an agreement -- commuters have been very frustrated -- waiting for this moment. this is what some commuters had to say once they heard the news. >> when they are gone you appreciate them more. >> investigators looking into the train accident that killed two bart workers now say, the driver was a trainee and was going between 60 and 70 miles per hour. that's according to the n-t- s-b. laurence daniels and christopher sheppard were killed saturday when they were hit by a bart train near the walnut creek station. the n-t-s-b confirms the train was in automatic mode. but would not comment on whether all of the bart employees were following procedure when the accident happened. investigators will be interviewing bart management about the incident later today. this is just the beginning of a long investigation ahead.

>> he was a trainee operator. one was there to do train. >> we've also learned that an emergency stop was pressed just before the accident, and that the video shot from the inside of the train has been sent to washington d-c for review. >> a large house fire is burning in san rafael right now. the fire started before three this morning and fire crews are saying the fire can be seen from highway 101. the blaze is burning at a home on embarcadero way and east mission ave. when firefighters arrived they found the house fully engulfed in flames and now they are trying to put it out. we'll bring you an update as soon as it comes in. >> as if the bart strike wasn't enough. a-c transit drivers told a state advisory board they are threatening to strike because of violence on

buses. the a-c transit district testified yesterday before the 3-member panel created by governor jerry brown to help him decide whether to extend a strike ban by 60 days. brown banned the strike last week for 7 days so he could determine whether a longer cooling off period was warranted. drivers gave the state advisory a proposal that would have them pay some of their medical insurance premiums. a-c transit management says another strike would cause more serious problems to alameda and contra costa county riders. >> hundreds of truckers at the port of oakland walked off the job today over issues with what they have called unfair conditions. a nonprofit group called the port of oakland truckers association represents about 350 truckers who have joined together in a fight against port management. most of the group members refused to work today, with many picketing at the port entrances, group spokesman cesar parra said. the truckers are unable to form a union, as they are independent contractors and not considered port employees. the group is demanding a raise to offset a $50 monthly "green emissions fee" that is used to upgrade equipment to new

emissions standards along with an extension to comply with new environmental standards, which takes effect on jan. 1, 2014. parra said the drivers are asking for more pay and more time to comply with the standards. ideally they are looking for a two-year or longer extension or at least one additional year to get equipment into compliance, he said. he said although only a small portion of the roughly 5,900 truckers who work at the port are striking today, the group has received support from many other drivers. he said members of the occupy movement have also come by the port today to share their support for the striking truckers. >> there is not likely to be extra bus services from bart. we are still trying to up walwork out what they mean by tenants of service. it is still a light and easy ride to rob the east. this includes interstate 580 as

some were even able to help >> "'this was the guy, he looked like this' they were able to give us the description, where he was, which was very valuable information to us, you know, as we go through. we are going in there blind, anyway. but to have somebody give us that kind of information, helps us focus our efforts." >> a law enforcement source says the shooter used a handgun he took from his parents. but the motive for the attack is unknown. >> in colorado. defense lawyers and prosecutors are battling over what evidence can be used against james holmes-- the gunman behind the aurora theater shootings that killed 12 people last year. holmes worked with police to diffuse bombs he allegedly put in place at his apartment before the shooting. holmes' attorneys argue that anything holmes told police about the bombs should * *not * be allowed at trial because he was not advised of his right to remain silent. they claim he was having a psychotic episode during the theater attack. prosecutors are seeking the death penalty, but they must convince jurors that he was sane. >>

>> same sex marriages became legal monday in new jersey. the unions began soon after governor chris christie dropped his legal challenge to same sex unions. christie has made it clear that he opposes weddings for gay and lesbian couples. democratic senator-elect cory booker officiated at several weddings in newark. >> federal judges are giving california an additional month to reduce its prison population, as negotiations continue over a longer-term delay. the judges said in a one- paragraph order monday that a court-appointed mediator needs more time to seek agreement on how the state should reduce inmate crowding. gov. jerry brown and state lawmakers want a three-year

delay to give proposed rehabilitation programs time to work. under a new state law, the alternative is to spend $315 million this fiscal year to house thousands of inmates in private prisons and county jails. the judges pushed back the deadline until late february for meeting an earlier population-reduction goal. the court ordered the mediator to provide a mid- november update to say if negotiations are still productive. >> a squabble over paperwork deadlines between county officials in central california and state prison authorities is leading to the early release of alleged parole violators. the stockton record reports that san joaquin county judges are releasing suspected parole violators from jail if california department of corrections and rehabilitation officials fail to provide the necessary records within 48 hours of an arrest. a cdcr spokesman said in most cases the department can't meet such a strict deadline. he said other california counties adhere to a five-day deadline. adjudicating parole violations was recently switched from state oversight to local courts as a result of california's so-called jail realignment plan. the realignment program has shifted some felons from prisons to county jails.

and what they are posting on there website. they are stating that they are closed until further notice. they stated that they have not been successful in staffing positions for their limited service which was to be expected at 4:00 a.m. this morning i have had some communication that appears to be from bart that they are closed until further notice. so i apologize for the confusion but this seems to be the case and as of yet, our reporters have not are observed any trains moving this morning. last night's announcement, they stated that they would have limited service and a limited meeting shorter trains and lumber times. they stated that they would have service at 4:00 a.m.. as of yet, according to bart's all their stations are closed. they're still trying to staff positions. a

again, we apologize for this confusion. as far as i am aware of they do not have a charter bus either. we may have people left to their own for their morning commute. if you do have to get out and drive less look at roads. >> they're no problems or delays for the bay bridge. the san mateo bridge and highway 92 and again, they are problem free with no delays. the golden gate bridge ride, 1 01 southbound is foggy but an easy trip with no delays. i will show you the traffic maps. it is still pretty it light. they have no delays for 680 or highway 24. although this may change. westbound traffic for 580 is heavy into dublin. some congested

is there. the south bay is okay with no problems. the north bay ride is easy from south of the golden gate bridge. >> again, we are hearing from are the they have no service at a rate and that they are closed until further notice because they need to staff. >> another twist in the found in the stairwell of san francisco general hospital. kron 4's justine waldman talked to lynne spalding's friends about new allegations it's claimed that an employee saw a person slumped in the stairwell -- and yet nothing was done. >> this is the sort of thing that a good samaritan would help. to >> their friends are disturbed about this. an orderly at the hospital told a nurse that he saw an unconscious woman in the stairwell about one week before they found her body.

the 57 year-old was missing for 17 days. the newspaper stated that the orderly saw the body twice once going down the stairs and once going up the stairs. san francisco general has not confirmed this. even so, her family is out rates. >> this is a protocol issue. this is a basic management issue. how can you ignore some one. >> they reported that the nurse contacted the sheriff's department who patrols of the hospital but it is unclear if the deputy ever checked the stairwell. >> i mean this seriously. my heart goes out all the professionals. i am sure there are people who are upset about this. do not forget the fact that this institution has a very, very hard questions. frankly,--

>> here is a live look from a west oakland station. it looks like the station is trying to open right now there are working on staffing sore right now they have no trains running. >> you can see people being turned away if which will cause a another problem. they had announced last night that they had production and they promised people that the trades would be available at 4:00 a.m.. but at a limited capacity. here we are this morning with apparently a staffing issue. station is to choose the and the shock--people are showing up and they have no charter service. people need to get to work. you could see an employee walking up that they are close. keep it toneuned here.

>> welcome back. bart trains are not backed up and running even though they told us this last month. we have kron 4 will tran at the west oakland bart station. we expected to see people showing up smiling but that is not the case. >> we were not the only ones expecting this. this has not been the case because behind made the lights are on at this station and there is a ticket agent but the date is still down. a few minutes ago i saw about four passengers looking through the gate tried to yell out questions but the ticket agents came down and confirmed that they are still confused. they believe

that the lines are up but until they get the offical word to raise the date they have to leave it down. they are not want to lift the gates so for now they're still shut down. in the meantime, bart has chartered buse they have a few people waiting for the next bus to come. it has been a very slow as far as getting bart service up and running. in the meantime i had a chance to talk to some of the passengers. here is their reactions. >> i was out here at 3:30 a.m. in this line. then someone came out and told me that they should be running a limited. nobody is sure what is going on.

open but for whatever reason i do not see anyone sitting. there is a smaller a buzz of behind this one and you can see maybe about five people standing there. now, because they're pulling into the parking lot there are seeing that the gates are closed even though the lights are on. i will go there to find out why they're out in the cold and why they can i get on the charter bus. i think it might be about 10 people waiting in line and right now as far as they are concerned there are relying on this charter bus to get them to where they need to go because bart is still closed. >> what is interesting is that it would be nice to talk to these drivers to see if they called them to have them come or they are ready in line waiting.

waiting to see what happens. they are just very upset by what is going on. they stated that they found out that the strike was a purely over so they thought their lives would resume and get back to normal. this morning they're still not back to normal and their other charter buses, six or seven of them that are out here. you can see that they are pretty much surrounding this station. >> according to the driver that i spoke with she stated that the trains were scheduled to run anyway. they were told to continue going here even though their boss found out about a compromise. so for whatever reason they did not have full face that the trains would be running and that is

why they came here. she stated that her boss did not call her off and that is why they're there. for these people, they state that is getting-testing want this to be over with. we will have to monitor this because more and more people are showing up. >> this will be an issue because a lot of people went to bed and figure they did not have to get up early. now they are waking up thinking that they do need a limited seat. >> this is not just the buses, if they find out that the trains are not going to run by 7:00 a.m. then that means we may see these lines once again. even though the strike is apparently over

this mess is not over because people are still up the air not known what to do. this is far from over and this is the breaking news that we have this morning. we thought that the station would agree open but as you can see that the lights are on and i hear announcements but the gates are still closed. we have bart police also out here. it appears slowly that things may be getting back to normal but just looking at this a looks like more and more-- >> one of the questions is that people want to know whether not the shuttle buses will give them nonstop traffic to san francisco.
