we'll have a big cool down coming up. now back to marty. >> thank you. new information surfacing about a palo alto man still being detained in north korea. he once served in a top secret service group. he was involved in a group attacking and killing north korean soldiers 60 years ago. the man was taken off of a plane after a tour. the family is pleading with the north koreans to let him go. emergency crews were at the scene of a commuter passenger train derailment this morning. the new york fire department and new york governor say that four people are confirmed dead. there are also 63 people injured. authorities believe everyone at

the site has been accounted for and the ntsb is on the way to the scene. the big curve where the derailment occurred is a slow speed area and the train's black box should be able to tell how fast the train was traveling a t the time. there were about 31 firefighters at the scene -- 130 firefighters at the scene. after paul walker, who is best known for his role in the "fast and furious" films has died. the l.a. county sheriff's department says speed was a factor. the driver of the porsche said the driver also died in the crash. there you see the wreckage.

their battle to aids. here's the scene from last night, the light the grove gala fundraiser in observance of world aids day. people will gather to observe world aids day, this is free and open to the public. then this evening at 5:00 there's a candle light vigil in san francisco. this is the 25th world's aids day that started back in 1988 and if first reported -- the first reported case was found in 1981. we are expecting a lot of the cyclists to start showing up in the next hour or two. we will try to speak with them as they kick off the event. marty? >> thank you very much, mike. well, we are starting to

get our first look at a man police say is the suspect in an animal cruelty case. police say these are images of the suspect just after he snatched two cats and the belongs of a homeless woman and then threw them in the bay. the firefighters were able to retrieve the woman's belongings from the water, but not the cats. >> i think it's terrible. >> she's known around here. she is a nice, sweet old lady. i'm born and raised in san francisco and that's not how we take care of our family out here. she is homeless, she has a bunch of cats, i mean, come on, whoever did this, karma. karma. >> police plan to charge the

suspect with two count of felony cruelty. police say a grandmother usually ties a rope around the waist of a child when he fishes, but she didn't do it this time. she looked away for a minute and that's when he fell in the water. the police are looking for 62 iphones that have been stolen. police are hoping surveillance video helps them catch the thieves. >> reporter: investigators say an alarm was tripped after a window was smashed and the suspects crawled in. how many suspects are involved is unclear, but the suspects got away with 62iphones totaling more than $42,000. the problem is none of the

phones were activated so the phones are untraceable. the only phones activated were left behind so it seems the suspects knew what they were doing. the store was closed at the time of the thief. the police arrived four hours later. the police are expecting the store to hand the video over to detectives early next week. well, the bart contract dispute is heating up once again. two of the unions are planning to file a lawsuit against the agency. they believe they stripped the

>> well, the numbers are in and overall sales are up according to the retail firm shopper track. it reports that the sales increased thursday and friday by a little bit over 2%. sales on black friday were down around 13% and analysts say that could be because of the shoppers on thanksgiving day. research shows that a lot of people use smart phones and tablets to take care of their shopping list. and cyber monday is expected to be a huge hit again this year. cyber sales last year hit $1.5 billion. experts say this year it could increase to $2 billion. sales in stores reached more than $11 billion for the holiday season in the u.s. well, coming up, we'll have the latest on the twists and

for those of you heading to the niners game, it's going to be a beautiful game. temperature ins the mid to upper 60s. it's going to be nice and warm. looking at the satellite radar, we have high pressure that's keeping things mild around here, but we have a system to the north of us. we are not going to get too much moisture with this, it's the cooler air coming in. we are only going to get to the low 50s by midweek, so we have some cool days ahead for us. temperatures dropping below freezing in the inland spots and the temperatures slowly rebounding as we head into next week. marty? >> thank you. well, bart is facing more problems with the possible lawsuit happening this week. let's start with bart. >> okay. >> threats of a lawsuit come tuesday, what could all of this mean for riders? >> well, i think the lawsuit is

the only alternative that the union has at this point. going to a political strike is dangerous. really the only action they have file a lawsuit. it would be an unfair labor practice. they could go back to the bargaining table, but it doesn't mean they debt anything they want out of it. >> it stretches things out, then. >> right, it stretches things out. none of the provisions of the contract are going in effect right now. if the court were to rule that bart did engage in an unfair labor practice and nothing was done about it, down the road, that could lead to a strike, but not right now. >> assuming this plays out and

tuesday the lawsuit is filed, how much time are we talking about for the public to see things happen? >> probably not for several months as the courts tend to wind their way through things slowly. i don't see this being resolved until spring or summer at the earliest. >> of next year? >> yes. >> in the meantime, the bart workers are working under the old contract. >> right. in some ways that's not that bad, but others ways not that good. if bart is found to have engaged in an unfair labor practice, issues could arise. >> but again, it's down the road. >> right, you are going to get through the christmas season. reporting. and though the officer has reached his goal, he is predicting that by the end of the year he will exceed it. police say they got a call friday about a shooting near highway 37. the victim was hit twice, but survived. the police are on the look out for a second suspect they say is in a small boat. he is listed as a transient. a federal investigation of senator ron calderon could threaten the power structure in the capitol when lawmakers reseen next month. he was accused of accepting bribes.

newman's family pleaded with the north korean leaders to let him go. emergency crews were at the scene of a commuter passenger train derailment in the bronx that happened at 4:20 our time this morning. four people are confirmed dead as we take a live look at the derailment there. there are 63 people listed as injured. authorities believe everyone at the sight has been accounted for. a transit authority said that there's a big curve where the derailment occurred and it's considered to be a slow speed area and they are thinking the black box should be able to tell them the speed of the train at the time of the derailment. 4-5 cars of f the seven cars

were not stolen. it seems the suspects knew what they were doing. the store was closed at the time of the burglary and the police didn't arrive until four hours after the burglary, that's when an employee called to verify the burglary. the store has video and it's expected to be turned over to the police early next week. well, the bart account issues are heating up. the bart unions are expected to file lawsuits against the agency. they believe the agency stripped the family medical leave act from the account and they expect to meet with a lawyer on tuesday. bart riders we talked to are fed up. >> you would think they would have done their homework in advance rather than put a

developing news this morning, emergency crews are at the scene of a commuter passenger train derailment that happened at 4:20 our time. four people are confirmed dead. there are 63 people injured. authorities believe that everyone at the site has been accounted for and that the n.t.s.b. authorities are on route to the area. there's a big curve in the track where the derailment occurred. it's considered a slow speed area. they are looking at the black box that should be able to tell them how fast the train was

traveling when it reached the curve. four or five of the cars of the seven derailed happened on the curved site you see there. this just coming in. all of the lanes opened on the 580 after a car fire. if you are heading in that direction, you are advised to expect delays and think about alternate routes while they continue to work on the area. the oakland fire department remains on the scene. no estimate time of when things will clear up and we will have more as soon as it comes into the news room. now we want to get you up do date on the forecast. it's going to be a beautiful day compared to yesterday, a little bit warmer. you can see the clear shot here. as for the morning, it's warming up out there.
