top stories for this tuesday, december 17th. a teenage girl who went in for surgery at children's hospital oakland, is expected to be taken off life support today. we'll have more on the heartbreaking new development. >> the mega millions jackpot is now a staggering 586- million dollars. what you need to know before tonight's drawing. >> happening now. firefighters are working to knock down a fire at a metal plant in redwood city. the fire started just after one this morning at the sims metal management facility on seaport boulevard. that's where we find kron 4's jackie sissel live this morning. jackie. >> you can see this huge orange glow coming off of this pile of scrap metal. as

you stated, this is the second fired at this particular yard within the last month. according to a spokesperson from the fire department this fire broke out about 1:00 a.m. and it is a huge pile of scrap metal. i can also tell you that this should disclosed down and it will remain this way because these types of fires are very difficult to fight. one of the problem is the smoke that is coming off >> about 45 minutes ago these were the conditions and this is what he had to say >> at this time, it does not matter from what fire. there has not been no shelters issued as of yet, the

incident command team has been discussing with the quality services. there may be a possibility of issuing one but one has now been issued. >> that is what we are waiting for right now. we are waiting for the spokesperson to come back out here. police officials, some of them have mask on their face. there were people waiting to get in and they were told to leave, that worked down this road. because it is closed, because it sounds like this will last for several hours. they have all been sent home at this point. as soon as i receive new information on the condition of the fire but more important the smoke and how it is affecting nearby communities. i will pass this phonalong. >> it was just over a month

ago that this fire broke out at the same scrap metal yard. back on november 10th. the smoke prompted authorities to issue health advisories for residents in parts of san mateo, santa clara and alameda counties. >> there was a fire back in 2007. would check back for an update. >> if you like yesterday's whether you will probably like today. we're talking mid to upper 60s for just about everyone. it is a mile start with oakland at 40 degrees. upper '30's right now for daly city and san jose is at 41 degrees. it will be another nice stable of big changes by tomorrow. we're talking a 10 degree drop. we are looking at the possibility of showers by thursday but san francisco, this may be the driest year on record. i will talk

about rainfall totals as 6:15 a.m.. >> we are tracking delays on interstate 80 with a accident at mcbride in the westbound direction. the slow traffic has not reached back to high with four but it cut and the drive time has jumped from about 16 to 18 minutes. it is now 24 minutes but still within the range of normal. again, the accident is on the west lane. >> the family of a 13 old girl is hoping doctors won't take her off life support. the girl went into children's hospital oaklandl last monday to have her tonsils removed. she is now brain dead. kron 4's will tran is at the hospital with the latest on the case. >> if it were up to the doctors at the hospital that would have already taken her off but the family spoke

with the dr. and convince them to give her one more scan before they make a mold. the doctors agreed, that would do a mother brain scan. here is a picture of the 13 year-old. she came here last monday to have her tonsils or molds. the surgery went well and then she was conscious, she was talking to her family and then something went wrong. she started to bleed from the mouth and had a heart attack. she has been unconscious ever since. no one knows exactly why and the family has hired an attorney to get to the bottom of this. they want answers. >> they are confused and there certain that they should give them one more chance. they want to find out about her brain activity. if no brain activity it will be up to the doctors and medical

examiners to take off a life-support. i spoke with her family and this is what they had to say. >> we are not pulling the plug on her, it is not us. is not us. she is, legally dead. it is another case and this takes away the right from us, the family, the grandmother, for my sister was the mother to have this option. >> her mother is just so full of grief and regret. she did not want to take her daughter to get her tonsils or mold.remote. the molds. unfo, something went wrong and the doctors here, the hospital would like to speak to the media but the family member asks them not to. it is up to them to say yes or

>> welcome back. a new draft report on last year's richmond refinery fire is out. and the federal agency investigating the incident. is pointing blame at both chevron and the state regulatory process. the u.s. chemical safety board says the corrosion caused pipe rupture and the subsequent fire could have been prevented had chevron had implemented safety upgrades. but the chemical safety board says part of the blame is on the regulatory process itself the board says the current system is not about preventing an incident, but responding to it.

>> to wait until there is an accident, a referral, or a complaint after the case and investigate, at issue a citation and a fine, >> the chemical safety board?says what's known as a safety case regime should be utilized because it requires companies like chevron to lay out plans to reduce risks. approved by regulators. >> chevron has released this statement in response to the new report. saying in part. quote - "while we await the release of the board's final report, we are already taking a series of actions in response to the august 2012 incident." >> we're talking about a warm- up for today and we do have the changes in the extended forecast. we will talk about temperatures and the possibility of showers when we continue.

after two lackluster weeks. the dow jones industrial average rose 129 points to close at 15,884.57, index rose 11 points. and the nasdaq composite was higher by 28 points. >> a federal judge has tossed out a lawsuit filed by the monster beverage corporation. it sought to block the san francisco city attorney's investigation. into the company's marketing practices. on monday, a judge ruled. that granting monster's request, would unfairly hinder the lawsuit filed in state court by dennis herrera. that suit accuses the company of mis-branding its highly caffeinated drinks. and marketing them to

monster filed its lawsuit, after herrera demanded that levels in its drinks. and stop marketing to minors. maligned >> a california company is asking for a judgement against one of the top executives of a now defunct peanut processor in new mexico. swain creations is accusing sunland's c-e-o jimmie shearer of fraud, concealment and intentional misrepresentation. shearer is accused of failing to disclose repeated health and safety violations at sunland. a national salmonella outbreak was linked to the plant in 2012. the plant was one the nation's largest producer of organic valencia peanuts. to >> a judge has ordered some top paint companies to pay one point one billion dollars for marketing paint they knew was harmful to children. a superior court judge in san jose issued the verdict yesterday after a five week, non-jury trial. the judge has ordered conagra grocery products, n-l industries incorporated and the sherwin-williams company to remove lead from millions of older homes.

that the orange glow is still coming from this heat that is burning we do know that scrap metal from the appliances, washers and dryers is what is making it difficult. they stated that it is about 30 ft. high and it may be burning four hours out here. i had a chance to talk to a fire marshal from redwood city fire department and he described it. >> the apollo measure is about 75 ft. by hundred. as approximately 30 ft. in height. of a pulse are segregated so get inside is pretty crafty--just removing the piles. >> it sounds like it will be out here for while and here is a view and you can see that the road is closed and there are a lot of businesses in fact, several

businesses down seaport are closed for today and their workers have been sent home. no one is able to get through right now. obviously, the cost of the fire is not known but that will continue this investigation. >> as far as the smoke, we were told an hour ago the there's no shelter in place, we're being told that the bay area, the air quality district is monitoring this and they will continue to monitor the situation. i can tell you that from where i met, which is still smell the smoke from the actual fire but the wind is blowing in the opposite direction and that is good nils but as the morning progresses if the wind happens to shift some of the conditions may change. that may have to reevaluate. >> within the last week we

highway 1 01. this is in redwood city, the ramps leading to the bayshore freeway to woodside road west, out towards seaport have been closed and on other occasions when a police activity or any other activity might have shut down this one, it has had a big impact. so far, we have not seen that as a case that is because is still early. i expect this will be there for awhile and we will see a bigger impact letter on this morning. >> if this is your normal coute you should think about a another commute. you can use el camino real or interstate 280. >> we are tracking delays on interstate 80 westbound and mcbride. it is not horrible, this accident has been moved over and the drive time is still normal

within the range of normal for hercules to berkeley. >> new information suggests that they failed the joint was the cause of the waterline of rupture at san jose mineta airport. this is video of of the mess at the terminal. staffing contractors working on the clock to restore the service. there were a few cancellations and several flight delays yesterday due to this. today, operators should be back to normal. >> felony charges have been filed. in a deadly high - speed car crash. on the police say, jennie zhu was driving more than 70- miles an hour. before plowing into a family's minivan. which was stopped at a red light at the corner of pine and gough streets. the family was on the way to school. the september wreck killed 16-year old kevin san and seriously injured several family members. there's still no word on *why zhu was going so fast.

bail. line and the mother who survived that fatal crash is now out of the hospital and slowly recovering at home. tina chew worked as a mail carrier at the sausalito post office. many co-workers miss her presence and say she is a like a sister to them. chew's boss says other postal workers have donated some of their vacation time to her during her recovery. chew even recently stopped by to say hello, and they all say she looked great. >> it was very emotional. it brought back great joy. it is brought encouragement to the entire office. >> align >> after the accident, many of ther customers along her route tied yellow ribbons on their mailboxes to show how much the community loves her. and as for her coworkers, they are happy that justice is well be done with the d=a filing charges against the driver. they are waiting for chew to come back to work whenever she is ready.

food. >> a newly-published editorial about vitamins is getting a lot of attention this morning. the controversial piece claims that dietary supplements and vitamins are a waste of money. the editorial -- which is based on three studies -- says taking supplements offers no benefit when it comes to preventing cardiovascular disease, cancer, or a second heart attack. it says those studies also show that multi-vitamins don't improve cognitive function in men older than 65. the national products association -- which represents vitamin manufacturers and retailers -- responded by saying that multi-vitamins address nutritional deficiencies, but are not quote "the answer to all life's ailments" more than half of all adults in the u-s take a multi- vitamin-- making it a 12- billion-dollar-a-year business.

eastbound 80 where a second crash has been reported. the drive time because of what appears to be lighter traffic conditions have not been pushed above normal. 26 to 28 minutes from our police to berkeley. we continue to track a fire on seaport's boulevard in redwood city. this is affecting the ride on 1 01 because of this closure of the ramps from 1101, this will start to back up the bay bridge even more affecting both the south and north bound. you can avoid this by using middle field or el camino real. you can also use and state to way. >> we will continue to get your updates. at the bay bridge toll plaza, west bound is not much of a back
