>> pam: it is just north of big sur. and only 5-percent contiained. kron4's rob fladeboe reports. >> reporter: martha karstens, chief of the big sur volunteer fire brigade, is one of those whose home burned to the ground. >> when i found out, rather than responding to the incident i had to stay here. >> reporter:karsten's home and most of the others lost to the wind-driven fire so far, are up there on pheiffer ridge road where the battle was focused for much of tuesday. on a hilltop across the canyon, garrett cooper cleared brush from the hillside beneath his home. >> stoping the winds will come from the southwest and from jumping over the canyon.

>> pam: dan, very painful? >> reporter: the family is not ready for that officials have announced that they have given the family some breathing room. >> i feel that my daughter is trapped inside of her own body. every time i go in there i let her know that i will not give up, i will not. (crying) >> reporter: the hospital has now backed off with efforts to remove life support. >> reporter: children's hospital has announced the family will give hospital with a family time. we are >> ♪ happy that they have backed off. provided us more time

to get together and pray. >> reporter: showing the same results as the one previously patrick reviewed from on-site position still the family will like to keep the girl on family on life support. >> the big picture here is that the medicine they have provided did not work. >> reporter: now the attorney for the family has indicated that if she had been taken off life-support she would die. the family officials are also telling us that terms of what the legal right is the family has the right to survive or to decide what happens. the hospital and corner cap over ruled that with the court order. no one has sought out for a court order.

for showing affection. >> right. >> catherine: this follows the recent story of a 6- year-old colorado boy suspended because he kissed a little girl in his class on the cheek. >> catherine: and on another occasion - kissed her hand. what really made a lot of people angry, including hunter yelton's mother -- the school labelled him a "sexual harasser." >> catherine: even hunter seemed confused by the fuss. >> i just have a lot of energy. a six year old? have a lot of energy! >> catherine: a lot of people agreed.saying the school had gone way overboard. because of the backlash - the school later agreed to remove the reference to sexual harrassment from hunter's record. he's since gone back to class. >> pam: as the 49ers are getting to say their farewell to candlestick park, the team and the city's rec and park department took the media on a tour of the aging stadium.

more than eight hours. >> reporter:you can see the flames and smoke.harmful fumes filling the air. earlier today, officials advised people who smelled the smoke to stay indoors. the two alarm fire started just before one this morning after a small exploson was heard. no injuries were reported.but people are wondering what's going on - two fires at this plant in less than two months. >> we will not leave any stone unturned. we need to understand what or how these fires are happening. >> reporter: you may remember this fire on november 10th at the same redwood city recycling plant. >> reporter:this fire burned for several hours and people smelled it from the east bay to south san jose. last week the company was given a public nusiance fire. >> jacqueline: was a little cooler out there today but we still squall mild conditions bay area wide it

>> reporter:officials in l - a are investigating whether police unarmed suspect after a high-speed chase. >> reporter:l-a-p-d officers shot 51-year-old brian beaird after the hour-long pursuit in downtown l-a friday night. beaird was driving a 20-13 chevy corvette.

the chase ended when the corvette crashed into another car and spun onto the curb. beaird then got out.walked behind his car --with his back to officers-- while briefly raising his hands. he then fell to the ground after one or more officers shot him. >> reporter:beaird's brother says the family spoke to brian during the chase. >>"he just kept saying, 'why are they after me? i didn't do anything.' you know, my dad had tried to tell him to pull over.'this could have been handled differently, you know. he was just scared. and i don't know what was going through his mind at the time, but i hope that if these people did act inappropriately that, you know, there will be justice down the line. >> reporter:the l-a-p-d says a full investigation will be done. until then, the officers who were part of the shooting are placed on desk duty. >> jacqueline: we do have big change is coming into

>> pam: a missouri mom's big gift for her daughter is gone. she says a u-p-s delivery person placed the tablet she ordered in a garbage can in front of her house. it just so happened it was trash day. jeff bernthal has the story. >> reporter:tracey sole was in tears when she received this notice in her mail box. it indicates a package she ordered was placed in her outdoor trash can. >>"so, i opened the trash can and look in and all that's left, because it's trash day, was two frozen cups and my package had been picked up by the trash man." >> reporter:sole says it wasn't just any package. she says it was an android tablet that was going to be santa's present for her daughter. >> reporter:she suspects it was dumped with the rest of her trash-- and is now long gone.

>>"i was crying all night last night. i came home, and i mean i saved for months to get that for my daughter, and then for them to just throw it in the trash." >> reporter:she called u-p-s and says she was told to contact the company she ordered the tablet from. >>"and i was trying to talk to the guy on the phone. he said, 'you're going to have to calm down. i cant understand what you're saying.' so i was like, 'you donut understand.' but it was awful." >> reporter:we contacted u- p-s and a company spokesperson told us an investigation will be launched in an effort to find out what happened. >> reporter:for an additional charge, the company offers a delivery service that requires a signature. drivers are trained to leave packages out of sight and away from bad weather. >>"i donut care if they leave it by the mailbox, as long as they don;='t throw it in the trash."
