the family of 18 declared brain dead says they will seek an injunction to bar the hospital from removing her life support. 13 year- old jahi mcmath was declared brain dead a week ago after suffering complications from a routine tonsil removal surgery. the family met with children's hospital oakland officials yesterday. jahi's uncle says the requested the girl's medical records, asked to get an independent doctors' opinion and that they keep jahi alive at least through the christmas. but the meeting did not go as planned. the family is not giving up. they're going to court today to seek the injunction against the hospital. and are hoping they will be able to get a second doctor's opinion soon.

the hospital released a statement last night. it reads in part " this is a tragic situation. we want the public to know that the family has not permitted us to discuss the medical situation. we're unable without the family's permission to talk about the medical procedure, background or any of the details that are a part of this tragedy. details that would provide transparency, openness and provide answers to the public about the situation. mouth and goes into cardiac arrest. she's been unconscious ever since then. the family got an attorney. got a letter came in here and presented it to the hospital saying you don't want to take her off life support. you have problems down the road. it was just a letter not legally binding. today, they want to make it legally bound. we had a chance to talk to her mother 3 here's what she had to say why she wants to keep her daughter continuously on life-support. >>: asked him how soon will see planning on getting her off. and he said quickly. i need to do this quickly. and i said what can we have her for christmas. can we just before christmas i can bring car family to celebrate christmas with heart and he said now. >>will: you can see how choked up the family is. they are not saying in
