think a brief back up and the right pam lane will stay with us all morning long. >>anny: time now 6:00. on to our top story. unless the court steps and again in the next few hours a 13 year-old oakland girl will have her ventilator removed at 5:00 tonight. kron4's will tran has been following this story and joins us now with the very latest from children's hospital oakland. well >>will: that means a bar and a new class at that court action. the family is down to less than 11 hours. we know that 5:00 p.m. is the deadline which was set by the court. even though the hospital has said before the for the past several weeks that like to take her off the ventilator. it was a family who went to push for the deadline in a week ago. the family is try to fight this on two fronts. there try to get a third facility to step up and except-acceot

pt jahi mcmath. she came back on december 9th to the hospital to get a tonsillectomy. she made it through the hospital and it appeared to go well. she was talking to family members eating pops a close. the family had no idea that tragedy was right around the corner. and the reason why. she started bleeding from the mouth had a cardiac arrest and she's been unconscious ever sent. the family pushed for two weeks ago to have a final brain scan to see whether or not she had any brain activity. the family complied and a final brain scan and it showed that no brain activity of the family believes she is still alive warm to the touch that she is responding to their words. the hospital believes that she is brain-dead and there is no hope. we had a chance to talk to the hospital spokesman and attorney and here's what he had to say about the tonsillectomy. >>: there was unfortunately

no amount of prayer that can bring her back and i think everybody in this hospital and community. all the friends and family are all grieving because this is an irreversible and very sad situation. >>justine: up up hospital basically says there were other complications but they can't go into the details because the family won't let them speak to the public but they believe that this is not a " routine tonsillectomy. that there were other problems that happened after she came out of surgery. the family. i spoke to the stepdad who spent all weekend trying to talk to a third facility to step up and accept her. the reason there at 3 instead of one is because on friday in southern california facility was willing to accept her and then they step down and then over the weekend it appears a new york facility was ready and willing to accept her and then it appears they also step down three according to marvin wakefield he will try his

best massage and europe to see if it would change their mind and try to get a third facility at cellmark and the country to step up and accept jahi. we are on watch and unless something happens to have 11 and a half hours ago. >>anny: what they already raised the $20,000 they would need to accept that judge be excepted right of >>: that's right. but unless you have that as you can have all the money and the world but unless the facility agrees it means nothing. they already raised the $20,000 but at the last minute they also canceled so now they're just waiting to see if someone will step up and head to court. they don't have a definite court date according to marvin a week filled he says they are trying to stress the urgency to a judge out there. you have to hear our case is what they are same. >>anny: can the family still

is video from the scene. just after midnight, the ambulance crew was responding to an emergency call but while they were taking care of the patient someone took the ambulance on the 500 block of schwerin street . police recovered the vehicle about a half- hour later a mile away on alitalia--otillia street. no one was in it. and it was undamaged. but the joyrider apparently took some items. police are still looking for the culprit. >>: >>mark: in san francisco two people were hospitalized including a firefighter after a fire truck rush into an emergency crashes into a car does happen in the intersection of fifth and howard. the hook and ladder

more on the weather forecast from erica. >>erica: that's right mark i don't think we'll see any change anytime soon. we're talking temperatures well above where they should be for this time of year. although we do start off with some fairly chilly mornings it will warm up by the afternoon. we're talking temperatures as much as eight to 10 degrees warmer than where we should be so by lunchtime today, most locations are ready and the '60s holding on to some upper 50s along the delta and by 3 this afternoon,

expect slow to mid-60s for just about everyone. it's going to be a hazy sunshine and a little smoggy and east bay and south bay. it o'clock tonight holding on to calm conditions with conditions in the low 50s. i do want to break down those afternoon highs for today. mountain view today checking in with a high of 64. it will be as warm as yesterday. remember oakland came in at 70 degrees. i think we will come and cooler than that. but it we will still be a record- breaking territory. mid-60s for oakland which could tie and no record set back in 1977. 63 in san bruno. if you have new year's eve plans, we will start the night off and the '50s and the ride around midnight we drop into the upper '40's. expect a just a few clouds with mostly clear conditions so optimal viewing if you're heading out to see those fireworks.

indexes advanced more the 1%. starting january first, minimum wage workers in 13 states and four cities will receive higher paychecks. the largest increase is in washington state where the minimum wage will go up to $9.32 per hour. other states that will see a boost include: new york, new jersey, connecticut, ohio, florida, missouri, colorado and oregon. the changes have been partly fueled by nationwide walkouts this year by fast- food workers. 19 states currently have minimum wages higher than the federal level of $7.25 an hour. after the january 1st changes, that number rises to 21.

here in california, minimum- wage earners will be paid $9 an hour starting july 1. it will be the first of two dollar-an-hour boosts that will push the base wage to $10 by 2016, giving california one of the nation's highest rates. good morning america host robin roberts used a facebook post to acknowledge what friends and co-workers have long known. she's gay. roberts thanked her "long- time girlfriend amber" in an end-of-the-year message reflecting on her health battles in 2013. roberts did not give her girlfriend's last name. but people magazine identified her as amber laign, a licensed massage therapist from san francisco she met through mutual friends a decade ago. 53-year-old roberts has not previously spoken publicly about her sexuality. formula one racer michael schumacher suffered severe head trauma sunday while skiing in france. 44-year old schumacher hit his head on a rock, but was wearing a helmet.
