a live look at the bay bridge toll plaza. as we take it over to the traffic maps the drive time is about 12 minutes. this is from hercules to berkeley. it is a clear shot through the caldecott tunnel. >> an emotional statement from the family of 13-year- old jahi mcmath -- after a judge rules she will stay on a ventilator for at least another week. the family says it has a facility outside california ready to accept jahi, but children's hospital oakland would have to cooperate in getting her moved. as kron-4's jeff bush reports. this fight is not over.

>> jahi's mother i'm not trying to hold onto a corpse. that is a live girl in there. i'm serious, my daughter is alive. she's warm and i kiss her every time and i let her know that we won today. it may be a small victory. we've only got a few more days. today was a real hard day for me. like i said, i felt like my daughter was on death row. >> jahi's mother, nailah says the legal victory to keep her daughter on a ventalator for another week was a nice surprise that gives the family more time to sort out a deal with an east coast long term care facility. >> nailah my daughter can't fight for herself right now. she can't talk so i'm her voice. my brother is her voice. everyone who is praying for her, they are her voice. >> children's hospital has said it will release jahi if the family comes up with a facility to take her, provides transportation and a doctor willing to perform the surgeries needed to transport her bodyall very expensive and it is likely that no doctor would be willing to perform those surgeries. still, the family is holding

out hope. >> christopher dolan family attorney this case is about jahi, but even more important, it's about choicesand, who gets to make these choices regarding their children and healthcare in this most intimate and fundemental choice whether you live or die. is it the family who brought the child into the world? or is it the hospital that may have made the mistake that has taken her life? >> the hospital says that the family has been misled by it's attorney and that the tragedy of jahi's death is being prolonged by the legal rulings keeping her on a ventalator. >> sam singer hospital spokesman i just want to make it clear that for several weeks now, jahi mcmath has been dead. a physician ruled her dead at this hospital. an independent physician delclared her dead and the judge looked in the family's eyes and said your daughter is dead. >> the attorney for jahi's family has been busy filing legal motions.. he convinced a judge to grant that extension of life

two ice-breaker ships -- one from australia and another from china - have not been able to reach the stranded passengers. the chinese ship 'does' have a helicopter - which might be used to air-lift people - once the weather improves. kron 4's charles clifford talked to one of george and norma's friends. he says they love to travel.and might have gotten the adventure they were looking for. line >> john orfali is george trillia friend and coworker. they install solar panels together. he says that george and his wife norma are avid travelers and that when george said they were taking a ship to antarctica.. john wasn't the least bit surprised. >> sot the couple left mid december and john hasn't heard from them since, but when he saw on the news that a russian ship was stuck in the ice, he suspected his friends might be on board. sot >> i started doing some research and poof there he was. waiving. norma next to him. george was supposed to return to work later this week and start a new solar panel installation. that job is now on hold. john just hopes his friends make it home safe.

2013 has been california's driest year since record=keeping began in 1894. on friday, the state will do the season's first snowpack survey. and the picture will be far different from this scene - last january. in fact, the biggest challenge may be finding any snow at all. 90 percent of the state has been in an official drought since may. and as catherine heenan reports. no rain or snow is forecast for anywhere in california in the foreseeable future. >> the state water crisis has been building for three years. right now 28 percent of the state, including the central valley, is in a state of extreme drought, the government's second most severe category. this is a picture of shasta lake, from december of 2000, an average year for precipitation. here's what it looks like now: more shoreline, a lot less water. california's biggest reservoir is only at 37 percent of capacity. lake oroville in butte county, principal reservoir for the state water project, today is down to 41 percent.

>> folsom reservoir, near sacramento, is at 19 percent. as a result, the city of folsom has imposed strict rationing. all residents and businesses have to reduce their water consumption by 20 percent, and landscape irrigation is allowed only two days a week. bay area residents could also be facing mandatory conservation. >> san jose has only received 29 percent of its normal rainfall to date. oakland, 23 percent and san francisco, 20 percent. >> higher-than-usual tides along california's coastline this week. low-lying areas are prone to flooding - because of what's known as a 'king tide.' kron 4's john fenoglio tells us how long we can expect the high tides to last. >> oc: along the california coast, high tides are getting higher due to a phenomenon called a king tide. >> vo: in sausalito, the tide rose

morning. a san francisco police officer and a driver were injured during a police chase late last this is video from the scene. around nine p-m officers in the bayview district attempted to pull over the driver of vehicle in which there appeared to be a weapon in the passenger area. the driver fled onto interstate 280 then onto 19th street toward golden gate in san francisco. >> during the pursuit of the suspect was not struck by the bullet. also at that point the officer was injured. >> officers say that the driver continued to the haight-ashbury neighborhood where the driver drove onto the sidewalk, into a cul-de- sac and crashed into a concrete barrier. the driver was taken to s-f general and is being treated for minor injuries. the officer was also taken to s-f general. he has been treated and released. >> the time now a4:30 a.m.
