temperatures. we saw some today and we will see some tomorrow. we are looking live now in san mateo, the sun is setting. clear skies all over the bay area with the exception near the coastline where we did see some fog. i mentioned those record temperatures. we did set a few today. on the left hand side is our new record the high temperature we hit today and the previous record on the right. 70degrees in santa rosa, beat the previous record by four degrees. we set new record in napa p downtown oakland 72, downtown san francisco tied the previous record. we have potential for more record breaking temperatures tomorrow. i'll tell you more about that coming up in a bit. offshore swell is creating big waves at san francisco's ocean beach. mentioned this a moment ago. a surface spectator came out to enjoy the action. the largest waves was 15 feet

high and quite powerful. some equipment such as surfboards were snapped. surfers said today's condition was perfect. they are excited because the waves is expected to get larger here later this week. >> i think it's going to stay consistently big for a few days. almost seems like there's one swell after the next coming in. it's almost like surfer's paradise. >> coming up, tonight on our news at 6:00, you'll hear what these incoming swells mean of the organizers of maverick big wave contest. the big waves turn deadly today. after getting dragged into the ocean by the strong waves the man was trying to retrieve an ice chest. this is video over the scene. witnesses who saw the man in the ocean say he disappeared in

just seconds. the u.s. coast guard launched a search. today is dr. martin luther king jr. day and the bay area and the nation are marking the civil rights leader legacy with parades, rallies and festivals. the freedom train pulled into san francisco this morning carrying more than 1000 passengers. the trip started in san jose, commemorates the 54-mile march on selma back in 1965 led by civil rights leader dr. king. this cal train ride is now the only official freedom ride in the country. ticket sales was slow this year. a last minute rush had organizers promising that the train will roll again. >> all throughout the civil rights movement, people were saying we're going to ride the freedom train. now it's something, a lot of

kids these day, they have to see it to learn it. >> in richmond, hundreds of volunteers spent the day participating in a coastal clean up. the event was part of the national day of service honoring dr. king. the watershed project organizers had originally planned for about 60 volunteers. they were happily overwhelmed when more than 200 people showed up. >> goes to show you that people really feel that today is the day to give back. it is a great bay to build communities and also to make a difference in the environment. volunteers from high schools and church groups and families collected trash and pulled up in placed. they covered roughly three miles of coastline. organizers say this is one of the largest turn out they have seen. tribute to martin luther king were being held in cities across the country including the nation's capital and among those honoring this

helping dogs help people. . >> president obama's comments on marijuana are getting a lot of attention today in an interview in the new yorker, he expressed what most americans now say they believe. smoking pot should not be a crime. advocates of legalization say the tied seems to be turning their way. >> reporter: the president admitted smoking marijuana as a teenager. in the new interview, he adds details of his personal views calling it a vice. adding, i don't think it is more dangerous than alcohol. on that issue, he is in agreement with most americans. 55% of americans now believe

smoking marijuana should be legalized. 54% want to legalize its sale. in colorado, the first marijuana storefronts opened this month. 7000 people have applied to produce and sell pot in washington state. along with two states recreational use is legal, 19 others have approved its use for medical reasons including california. this map reflects the split in america. those favoring legalization tend to be in the northeast or west coast younger, liberal and urban. people over 65 are the only age group opposed. conservatives and rural residents in the south are also against the idea. the cnn survey showed most people are now willing to admit they have used marijuana. 52% said they've tried it.

just what did authority find in justin beiber's mansion. it was treasure trove of drugs. when l.a. county sheriffest deputies his house, drugs weren't on the radar. they only had search warrants for surveillance equipment. the young pop star had drug and drug paraphernalia strewned all over the house. two large cookie jars all over the house. five empty codeine bottles and styrofoam cups. according to tmz, justin developed a serious drug problems. that massive security breach at target should be

spreading in the cyberattack compromised credit card numbers of more than 100 million target customers and a security firm is now warning retailers to be prepared if more potential breaches. it's kind of like playing that game, whack mole. first it was target, the security breach that compromised the information of millions of americans. we learned about niemann marcus, disclosing it too had been hacked. now a report from the cyber watch group intel crawler, suggests at least six more retailers have yet to tell customers they've been breached as well with the same malware attacking their online credit card processing. the question now, where should we look next? >> once it's identified, then security community with rally around it and start to controls in place. the problem the hackers know that. they manipulate or mutate this malway and then reuse it.

>> according to intel crawler, the source, traced to one place. the report claiming the first sample of the malware was created in march of 2013. >> let's say a retailer as 40 million transactions. all 40 million may have been damaged in some way and under law, they can be joined together in a class action lawsuit. >> legally the burden is on retailers to protect customer information from what we know now, this could be just the tip of the iceberg. >> was able to put that up on the internet for download for other hackers to take potentially use it for malicious harm. that's what we believe happened to target as well as niemann marcus. >> a 17-year-old russian believed to be responsible

likely helped in attack. it's not clear where that help came from. the teen thought to have shared the malware with other hackers. >> a salmonella outbreak now appears to be under control. officials say no deaths has been reported but 38% of the people who were sickened were hospitalized. the cdc said the company has taken effective measures to clean up its operation. foster farms did not recall any chicken. but back in october a costco store back in san francisco voluntarily recalled chicken. it was unusually warm january day. we set some records today. looks like we're gong to set some more tomorrow. let's take a look at temperatures this evening. going to be in the upper 50s and low 60 and then plummet

internet. it's hot and people are talking about it and a lot of new video is surfacing from richard sherman. we'll have some of that coming up later tonight. we're all over this story. our executive sports producer jason apple -- the bluster from sherman, really took away from his own team's victory. all the focus then became what he had to say. >> yes, niner fans they in doubt needed place to direct their anger. he made himself a very easy target. his antics and outbursts isn't why the niners lost. his play on the field certainly was. sure he was classless after the game. honestly, who really cares? we don't want football to see who is classless. nobody should lose sleep when

that doesn't happen. bottom line this guy is no doubt a knucklehead. he was caught up in the heat of the moment. pumped full of adrenaline immediately after the game when erin andrews shoved a mic in his face. what niner fan wouldn't take richard sherman on their team if he did the exact same thing. speaking of sherman, we wouldn't be talking about the pass if kaepernick final pass was a few inches high for. instead we'll be talking about the super bowl. this photo illustrates how close the niners was punching their ticket to the big game. as i said, just a matter of inches. sherman gets the hand on the pass. otherwise it almost certainly drop into crabtree's hand and niners win by one and are back in the super bowl to face peyton manning and the broncos. lot of fans are blaming kaepernick for the loss.

some even saying he's not a big game quarterback which is almost comical. sure he struggled down the stretch but the niners they wouldn't have been in the game if it wasn't for kaepernick. he was their entire offense in the first half. frank gore also had 11 carries but for just 14 yards. to say kaepernick can't win on the biggest stage, that's ridiculous. he reached the super bowl and nfc championship. the guy has tremendous talent. niners fans also blaming the refs for the loss. here is former vp officiating mike pereira had to say about that. >> refs always play a role. to say they don't is probably a figurement of the image nations -- image nation. the call that hurt them the most was the running into the kicker call.

threaten to withhold disaster recovery money from superstorm sandy. today's christie administration responded. >> reporter: lieutenant governor kim did not mince words. >> the suggestion that anyone would hold back sandy relief funds for any reason is wholly and completely false. >> reporter: over the weekend, the democratic mayor of hoboken dawn zimmer said she approached her in a parking lot in may with a direct message from governor christie. >> lieutenant governor pulled me aside, essentially you got to move forward with the rockefeller project. >> reporter: zimmer said she was told if she didn't support the project, her town wouldn't get relief money for superstorm sandy. the mayor documented the journal and made it available to the media. one high profile republican is

looks like we'll set records again tomorrow. forecast high on the left and record temperature for the day on the right. richmond and santa rosa, we'll break the record by a couple degrees. we'll edge out that record downtown oakland, mountain view looks like we'll tie the record and livermore and napa airport also expected to break records. pictures showing high pressure continuing to drive storms up to the north and around us. no rain in site. we really do need the rain. here are rainfall totals to date. only a couple inches of rain for most locations. mountain view, san jose about an inch in a half of rain. that's july through the current date. you can see the percent of average. obviously you want to be closer to a hundred percent and we're in the teens and even the low 20s. let's get a look at the extends forecast. again the rain dry conditions for the rest of the workweek. it is going to be windy,

this year. as usual tvs took center stage at ces. there are not a lot more ultra hdtvs. these are the next generation hd with four times the amount of pixels that are current high deaf television. another big thing in tv is the curve screen. it makes for better viewing. they are starting to run out of features to build them into television. everyone had a smart watch to show off or a high-tech fitness band. all types of new wearable tech is coming our way. here is one unique example, the june bracelet, it has a jewel sensor that tracked uv intensity and total sun exposure. the bracelet advises women how to maintain beautiful skin. personal drones of all shapes and sizes are buzzing over the show floor. a ton of these are coming out other the market.

>> at 6:00, big waves and high surf along the northern california coast this week. with today's warm temperatures and so many people off the king holiday, the beach has been a big draw for scores of people but the swells posed a threat. the powerful waves capable of pulling people into the water. in fact, this afternoon the waves did prove deadly in the north bay. the coast guard received reports that a fishermen was swept out to sea. >> reporter: this fishermen was trying to retrieve his cooler in the water when he was swept into the ocean by these large powerful waves.

san jose to san francisco this morning. more than 1000 people participated in the annual event. the ride is part of a 30 year tradition organized by the dr. martin luther king association of santa clara valley. the ride commemorates the 54 miles between selma and montgomery, alabama which dr. king and other civil right activist marched. they were fears this will be the last refer for freedom train. as part of the commemoration of dr. king, this is also a national day of service. in richmond, hundreds of volunteers spent the day cleaning up the beach. projects organizers wholeheartedly welcomed the large turn out today. >> reporter: for many martin luther king day offers a break from school or work. for these volunteers -- >> you make it a day on and not a day off which means you participate in some community

russian authorities are looking for a female terrorists who may be planning an attack at the olympics. the host city of sochi is under a terror threat. this is just 2.5 weeks before team u.s.a. and thousands of americans arrive in russia. the woman who you see here may be planning the attack. she is reportedly of a member what's called a black widow. the group gets the name because some members seek to avenge the deaths of their husbands. a developing story two workers are dead, ten people seriously injured. some of them critically after an explosion in omaha, nebraska today. this happened at a plant which processes animal feed. 38 people had been working inside when it happened. tonight omaha officials are saying every one is accounted for. there had been some concern about that. it is not clear yet what caused the blast but authorities say
