this morning on the kron 4 morning news-- for the first time in the agency's history, a bart police officer is shot and killed in the line of duty. and in this case - another officer is responsible. we have late details on the shooting. the emotional reaction from those close to the victim. and the investigation. plus-- a massive winter storm is hitting the east coast this morning. and part of the storm has already dumped about a foot or more of snow in some places. we'll show you the latest video coming into the news room. the kron 4 morning news starts right now. good morning. it is wednesday january 22.

i'm james fletcher. would start the weather with a look at our forecast. >>erica: that's right week a desperately use some rain around here and i have them looking at some of the models of looks like we are rolling off with a dry weather until probably the end of the january. i really don't think we will see any rain. is probably not going to be until the first week of february that we will actually see some scattered showers and what we're looking for is for the light and nature. it's not gonna be the big washout it will not stimulate much. in the meantime talking about unseasonably mild weather. for the past couple of days we've seen '70s a record- breaking highs it looks like we will see that yet again today. in terms of our temperatures it's pretty cold up there. santaring just ae freezing mark. but in my

leaving the house in livermore. we are waking up to mostly clear skies with the exception of the south bay. if you had called moving there. into the afternoon, 45 60s and '70s on tap. today is expected to perhaps be one to two degrees cooler than yesterday. concord and 69. a 74 castro valley and mid-60s for the board for downtown san francisco and 70 degrees in oakland. satellite and radar shows a relatively clear skies. high pressure still dominant over the state. what that means is no rain just dry weather. offshore winds will pick up and that would elevate our concern for fire danger. it will be pretty breezy for the hills. definitely keep that in mind. temperatures climb yet again about expect, went as we head into saturday and sunday. as for traffic around the bay area,

not looking at any hot spots. it's a great time to look at her house. --leave your house. you could see a handful of cars out there. but like most of them are using fasttrack. over at the san mateo bridge very quiet. though still like to get out towards foster city and a live look at the golden gate bridge shows the headlights coming out of san francisco. we are seeing green on the roadways sensors choice speeds over 50 mi. an hour. >>james: 403 is the time. tragic news this morning-- a bart officer -- on a probation search in dublin -- is fatally shot by his own colleague. the officer's name is thomas smith. a 20-year veteran of the bart police department. he leaves behind his wife kellie. and their six-year- old daughter. smith is the 36th officer

killed in california by accidental gunfire. and he is the first here in the bay area killed that way, since 2001. an alameda county sheriff's department representative says, smith is the first bart officer killed in the line of duty since the department's inception. this is video of smith from kron-4 coverage of a story back in 1994. he was only 22- years old at the time. smith comes from a law enforcement family, as his wife is also a bart k-9 officer and his brother works for the newark police department. investigators surveyed the scene in dublin for nine grueling hours. they are still trying to figure out exactly how this could have happened. kron 4's scott rates has the latest. from a helicopter crash of with abc seven news you can see the scene of the deadly accident happening just

before 2:00 thursday afternoon. officers knew the suspect they'd were investigating was already in jail. the officers entered the apartment where the suspect left after noticing the door was unlocked and they went in with guns drawn because it was unclear if anybody else was inside. we also know that all of the officers involved were wearing bullet proof vests and bart police were involved in an investigation into several robberies that have occurred on their trains. >>: was this a target of miss identification or was this an accidental gunshot. that is what we're trying to figure out for it investigators will take all the material collected from the scene and try to piece together exactly what happened. all is quiet now at eden valley medical center in

castro valley, but that wasn't the case last night. the slain officer's body was taken from the hospital in a casket draped with the american flag. officers gathered at the hospital to remember their fallen comrade. police officers from the entire area showed up at the hospital. smith's brother did not want to talk on camera but did say that his brother should be remembered as a good man. will have more on this story and the investigation into the shooting continues to unfold. we will take a quick break. speaking of storms governor chris christie is sworn in for another term. we'll tell you how he's handling this form of scandals surrounding his administration. plus protesters blocking commuter buses and downtown san francisco. we will tell you why they say protesters are

for all nine is the time. a series of public meetings on the proposed golden gate bridge toll increase started yesterday. the public can weigh in with their opinion during two meetings this week. the bridge board is discussing the proposed two- dollar toll increase which would kick in over the next five years. right now, drivers pay six- dollars or five dollars if they have fastrak. the new proposal would mean come the summer of 20-1, it could cost 8- dollars to cross the golden gate bridge. fastrak users would pay up to seven- dollars.

the bridge district says, current tolls can't cover its future costs, that includes repairs and maintenance the next meeting is on thursday at 4 p-m at the fort mason center in san francisco. new proposed legislation coming out of the east bay -- which would address the backlog of rape kits. many of the kits have not been tested in alameda county and in fact, have been tested statewide. state assemblywoman nancy skinner, and other bay area lawmakers, have come up with a bill that would set time limits for law enforcement agencies and forensic labs to process evidence collected after a reported sexual assault. the bill will push the evidence to be sent to a crime lab withing five - days after its booked into evidence by authorities. the crime labs would then

have to process the evidence and upload d-n-a profiles within 30 days. thousands of travelers are dealing with canceled flights again this morning after winter weather watches and warnings were issued for 13 states along the east coast. cnn's andrew spencer reports some areas have been forecast to get more than a foot of snow. bitter arctic cold is taking hold along the east coast this morning. part of a winter storm that's already dumped a foot or more of snow in some places. this is video out of long island, new york where the snow and ice are causing plenty of problems for drivers. boston has ordered schools closed today and stranded airline passengers are trying to find other ways to travel. and take a look at driving conditions out of maryland. black ice and wind are making it difficult to get around.

lawmakers announced they were combining two separate committees that are investigating whether or not the investigation abuse power. >>: in world news. the 52-people rescued from a ship stuck in antarctic ice. are now on solid ground in australia. the scientists, journalists and tourists were rescued by helicopter 20-days ago, and put on an australian icebreaker.

their russian ship became trapped in ice on christmas eve during a scientific expedition. this is their first time on dry land in three weeks. the u-s, china, france and australia all helped rescue the passengers. it's still not known who will pick up the tab for that rescue. syria peace talks began -- and got testy-- in switzerland this morning. diplomats are pushing for an end to the civil war.

but they're not getting very far. secretary of state john kerry said syrian president bashar assad *cannot be part of any transitional government. syria's foreign minister responded by saying only syrians can decide who will act as the country's leader. negotiators from syria's government and opposition are set to meet on friday.

a group of about 40 protesters blocked two silicon valley commuter buses in san francisco. it happened yesterday at the intersection of market and eighth streets. police were called in and the intersection was closed for a short time, before the busses could leave. protesters then marched to the san francisco association of realtors building at grove and franklin streets. before heading to city hall. protesters say, affordable housing is in sharp decline, while evictions are up. all of it. they say, is the result of gentrification that is pushing low and middle- income residents out of the city. the protesters say, passengers who travel between the city and silicon valley, contribute to the housing problem. the protest came just hours before an s-f-m-t-a board meeting.which approved the use of the buses in the area -- for a fee.

by a fellow officer. sergeant tom smith is bart's first officer killed in the line of duty. dublin, calif. - california gov. jerry brown identifies right now.eight flights out of s-f-o have been canceled and 28 flights scheduled to land at the airport have been canceled. on tuesday -- s-f-o saw more than 60 -flight cancellations. the majority of those cancellations were to airports hit hardest by the east coast storm. including new york, washington d-c and boston. airport officials advise travelers to check with their airlines about any potential changes to their

was in the area where our rescue effort took several hours to complete. >>: pacifica police and fire came to the scene of manor drive at about 345 in the afternoon on tuesday. video from a helicopter partnerships seven news shows us the truck all the way down the embankment. you can barely make out its cover it is so much a brush. to get the driver out of the vehicle and chp helicopter put the driver and a basket and flew to a local high school were a an ambulance was waiting to take the injured driver to the hospital. it then took several hours a multiple tow trucks to lift the trucks back up. >>: despite falling some 300 ft. the driver only have

new developments this morning with the flu outbreak in the bay area. we now know that one of the three flu deaths in san mateo county was a child. the san mateo county health department did not release any other information about the victim, like the child's age, or the strain of flu. to date, 22 people in the bay area have died of the flu this season. and to help you navigate this very active flu season.we have a special section on our website. you can find the closest location to your home that's offering the flu shot. you can find that link, and many more resources on kron4.com. snow in the sierra is an important resource for the state.

until this winter, the snow has been the most reliable water supply for the california. echo summit is one of the spots where the state department of water resources measures the snowload throughout winter. but the first such reading taken earlier this month showed the snowpack less than 10 percent of normal. some of the ski resorts like sierra at tahoe ski resort averages about 300 inches of annual snowfall, and right now they have about 66 inches. but marketing manager says they are making the best out of the situation. california's water crisis worsens by the day.

there are cobwebs in the rain gauge. and very little new snow to measure in the sierra. kron four's rob fladeboe shows you. the grim picture emerging in the mountains around lake tahoe. im here at echo summit, along highway, 50 about ten miles south of lake tahoe. in a normal year i would need snowshoes to get where i am right now. cabins like this one would be buried. but not this year. the snow where im standing is only about 8 inches deep. as i drove up from the bay area this morning it was 73 degrees as i went through placerville. i didn't see any snow at all until i passed kyburz at 4,00 feet.

the nimitz freeway 880 north bound and 16th street. this is an injury crash which means extra emergency vehicles on the scene and a little bit more debt way for a 80 in the northbound direction. i don't think this will be there long enough to have a huge impact on the morning commute but it will slow the ride briefly. if your normal route is 88 it will take longer than yesterday. continuing our team coverage this morning.of a bart police officer.shot and killed by another officer. thomas smith was a 20-year veteran of the bart police department. and leaves behind his wife kellie. and their six-year- old daughter. smith is the 36th officer killed in california by accidental gunfire.

but the first in the bay the alameda county sheriff's office tells kron 4 this morning that smith is the first bart officer killed in the line of duty since the department's creation. investigators worked late into the night to figure out how the 20-year- veteran was accidently shot and killed while conducting an investigation as many questions are left unanswered. joining us live now with more on what happened is kron 4's mike pelton. they're performing a routine search and that's when the shooting occurred. >>: they went and were searching for a suspect. the suspect was not there. but at some 0.1 officer fired and fatally wounded the other officer. yet a situation where they are doing this person is wanted for other things that are occurring on the trains and this particular case robberies occurred to the

caymans to do a probation search and that's why they were here. >>: here's the same officers formed just before 2:00. he spent more than 20 years with our police and the officer who shot him as a 10 year veteran. investigators are still looking to see how the shooting happened and although the incident of of of our police officers the dublin police department is the lead agency in this investigation. they hope to get an update from them in the morning. >>: we have team coverage now of the fallen bart officer. tom smith comes from a family of law enforcement officers. and he is very >>charles: well known within that community.

510 is the time. despite protests by housing advocates and other opponents, commuter buses will now be allowed to use public bus stops in san francisco. transportation officials approved the move unanimously. this means companies like google and facebook that use shuttle buses to take their employees to work can use muni stops. they'll be charged one dollar per stop. the same fee will apply to local hospitals and universities that also use shuttles. the change takes effect in
