>> the best chance is wednesday into thursday. right now we are dealing with a cloudy conditions. we have low cloud cover along the bay and the coastline. we are in the 40's and 50's. 49 degrees out the door in san jose. into the afternoon you can expect low 60's. yesterday we did not break any highs. oakland will have a high of 64 degrees. upper 50s for those of you in daly city. satellite and radar shows of rain for northern california. also we are seeing rain right now in the sierra nevada. it is not quite here in the bay area but we may see a few light rain drops later on. >> the seven day are around

>> kron 4's investigation into the friendly fire shooting death of bart police sergeant tommy smith. is focused on bart's training practices. on friday, kron 4 first told you the details of what happened last week, inside a dublin apartment. and how officer smith was killed by fellow bart officer michael maes. now-- new developments. a former bart police officer says, this tragic incident shows, bart police are lacking the training needed to properly conduct residential searches. kron- 4 specifically asked the current bart police chief. to talk about his department's training procedures. linein this exclusive interview. a former bart officer asked us not to reveal his identity for this story. kron 4's haaziq madyun. in a story that you will only see on kron4. >> basically, he was untrained. he saw the threat, he shot the threat. unfortunately it was an officer. >> he stated that this is

the issue that led to this officers and death. >> a fatal shot was fired. this was an untrained officer. since they do not practice this on a daily basis, those skills can go to the wayside. >> this is not uncommon across the country. >> it is not as common to bart officers. >> what about the present officers wore their. a lot of them tell me that they're uncomfortable executing these type of situations. they just do not have the proper training. >> bart police chief announced that he would make changes. he stated that he

would not change the way the officers receive training. he had this to say about previous training. >> every officer receives training. depending on what job they are assigned to, you also get additional training. >> from 2012, all of our personnel under went active shooting training which involves the bill would searches. >> those 18 searchers were for the entire department and all the officers however, a former within a year's time was not enough in terms of baker care for life or death situations. >> this is when they were

>> the belmont police need your help finding a 16-year- old autistic boy. tyler edward simmons was last seen yesterday around 7:00pm at ralston middle school. tyler is six feet tall and 140 pounds. he has brown, curly hair, green eyes and a thin goatee. he was last seen wearing a gray zip-up sweatshirt, black jeans, black beanie and white shoes. he is carrying an orange backpack, a dell laptop computer with a black cover and a purple nintendo ds. tyler is developmentally equilavent to an 8 year old and is somewhat anti-social. investigators do not suspect foul play at this time. >> a registered sex offender is behind bars. accused of

being on school property. and violating his sex offender status requirements. authorities say, theodore lorigo. who dresses as a woman. walked onto the sunnyvale hebrew day school campus. back in december. after school employees identified lorigo. authorities arrested him. he is being held at santa clara county jail. >> the president is expected to highlight his plans for a "year of action" in tonight's state of the union speech. andrew spencer reports lawmakers are expecting the president to press congress on the minimum wage and immigration reform, among other issues. >> president barack obama

>> welcome back. the deep south is getting ready for a deep freeze. ice and snow are expected to fall from south carolina to the gulf coast. in charleston, highway patrol workers were out prepping the streets with salt to avoid slippery driving conditions. even the big easy.new orleans.is shutting down. >> the last time they received snow was five years ago. >> and in kansas city, cold weather isn't stopping this 92-year-old crossing guard.

he's staying at his post despite freezing temperatures. thomas estes says he enjoys helping make sure children get to school safely. he puts on a couple pair of pants and two pair of gloves to stay warm, occasionaly running to his car to heat up a bit. estes has been on the job 18 years and doesn't have plans to retire any time soon. >> this colder than usual winter in the east and the midwest has been driving up demand.and prices.for propane. in montana, the price of heating fuel has gone up more than a dollar fifty per gallon since last winter. the current price is more than three dollars a gallon. propane suppliers say they don't see anyone rationing yet.just the price increase. wholesale suppliers think prices will stabilize once temperatures rise. >> good morning. we have much needed rains finally to are rise. later on this evening the best chance will

valley and low to mid 60's through the valleys. downtown san francisco will be checking in at 63 degrees. 64 degrees for napa. daly city will stay in the upper 50s. >> satellite and radar shows a dry conditions right now but again we have rain infiltrating no. california. it looks like rain is definitely on the horizon and you will see when said that the showers will move in. thursday about half a bus will be affected. the seven day around the bay shows cloud conditions and unsettled weather pretty much for rest of the week. the good news is that if you do like dry weather it will be warmer and sunshine will, as we transition into the weekend. >> the traffic or around the bay, i just checked with the chp we're not looking at any hot spots but we do have the usual suspects, the area of

construction. there is overnight construction that generally wraps up at 5:00 a.m.. if you're going to the bay bridge you will see easy conditions and the metering lights are currently off. >> the san mateo bridge, highway 92 is going well. overall, on the traffic maps we're not seeing any and the top speeds are 50 m.p.h. approaching the golden gate bridge. the east bay freeway is looking good. it looks like small sailing westbound highway 24 approach and caldecott tunnel. >> it's a question that continues to follow hillary clinton everywhere, will she run for president in 2016? and recent public appearances are only adding to the speculation. over the weekend, the group "ready for hillary" was busy laying the groundwork in iowa to try an win in the state's first in the nation caucus. clinton also laughed off the idea of a presidential run in front of an audience at the national automobile dealers association.

the ship is taking part in international efforts to dismantle syria's poison gas and nerve agent program. >> two cantalope farmers from colorado are scheduled to be sentenced today for a 2011 listeria outbreak. the outbreak caused 33 deaths and sent many others to hospitals. last year, brothers eric and ryan jensen pleaded guilty to introducing the tainted food to the public. each could receive a sentence of up to six years in prison. and a fine of one-point-five million dollars. the two brothers owned and operated jensen farms in holly, colorado. lineoklahoma won't review its lethal injection protocol.even after two inmates complained while being executed. one inmate said he felt his whole body burning. the other complained of a metallic taste. the department of corrections says their procedure is fine and they don't plan to change it. the state uses a sedative. a drug to stop breathing.and one to stop the heart. >> a lawmaker in utah is introducing a new bill that aims at easing up the rules on selling liquor in utah. the propsed bill would let

creating apps for. google glass lets users go on line, and take photos and videos. it will cost $1,500. >> the obama administration says that tech companies can release more information about the government's snooping request. microsoft, google, yahoo, facebook and link in sue the government last summer. they wanted to be able to tell customers how many government request they receive. under the agreement, internet companies will be able to tell customers when they have been forced to hand out information to the government. this means customers will have a better idea of how often the government is demanding affirmation and how many users are impacted. >> southwest is spreading its wings and fly out of the diners states. the airline is unveiling its

the shooting on thursday killed 17 year old justice toliver, she leaves behind a 3 year old daughter. family members told us the brother and sister got in to an argument about laundry. they lived with their grandmother in oakland's chinatown. police do still consider the suspect armed and dangerous because they have not recovered a weapon. believing the brother used a handgun to kill his sister. mario is 5-5, 140 pounds, with dark hair and brown eyes. and the chief tells me it is time for the suspect to give himself up. line he is obviously with some one. we are propelling upon who he is with to persuade him to turn himself in. >> police are still getting tips about mario's whereabouts and following up on those leads. there were reports over the weekend that the teen was seen on an a-c transit bus, police now believe it was just someone who looked similar to him and not

they want and then throwing away the rest. police want residents to pay attention to any suspicious activity and report it immediately. >> first it was a target, that it was at neiman- marcus, now my clomichael's migt be the next national retailer to be hit by hackers. the company says that it is not certain that a breach happen, but security for the store detected several fraudulent charges. this sounded a alarm. the head of communications say that the company wanted to get ahead of the problem. credit experts said that the reason this is happening, is because stolen credit card information is very valuable tooperating on the black market. >> officials at michaels say

they have hired an independent security firm to help them figure out if the company has been hacked and what to expect. >> ridesharing company, uber, is being slapped with a wrongful death lawsuit, by the family of a little girl who was killed in a crosswalk on new year's eve. six-year old sophia lui was killed. and her mother and 5 -year old brother were injured. at the intersection of polk and ellis streets. uber has said, the driver who was allegedly involved syed muzzafar was not working for them at the time the accident occurred. because he did not have a passenger. but the family's lawyer says, that should *not let the company off the hook. >> he went on a app, making it available for people to pick him as a driver. we have no business with him. for them to say that they are not

kron 4's charles clifford spoke with the department's general manager. about what they are doing to meet the governor's call to reduce water use. >> over the past few years they have been working to reduce water usage but the governor's drought declaration is looking for deeper cuts. >> we are currently conducting these. >> they're also working on a system within the maintenance problems. they know the landscaping can bounce back and they stated that part of visitors can also help. >> you should be mindful of their water consumption and the amount of time you are at a water fountain. you should be mindful of how long you leave the water on and if you see a leak or a problem where the water is slowing when it should not,
