developing story out of the east bay. bart service is expected to resume this morning after a deadly accident. around 11-30 last night, a train heading for richmond hit a person on the tracks near the south hayward station. service was shut down for the past several hours. but trains are now moving as scheduled. its not known what that if tracks in the first place. people in martinez are mourning the death of a popular eighth grade student, who was hit by a freight train sunday

evening. after going back on the tracks to get her cell phone. family and friends of the teen are struggling with the shocking loss. kron-4's j-r stone has more from martinez. east bay regional park police are investigating a recent report of a sexual assault at alameda creek trail. the victim told police that she was grabbed from behind while walking on the trial north of deep creek on sunday. the suspect is described as a white man in his 30's, 5'10", 185 lbs, with a black beard, last seen wearing a royal blue shirt and basketball shorts. a transgender teen. who told police he was sexually assaulted at an east bay school. now admits. he made up the story. hercules police say, the 15 year old originally told them. the assault happened inside a restroom at hercules middle and high school. but investigators were unable to validate the facts of the student's account. school officials say, they still need to look into why

the student told the story in the first place. police say. this officially closes the investigation. no word on the reason yet as to why the student made up the story. part of the reason this story generated so much interest, was because of an incident that did happen at hercules middle high school. back in november. a fight involving transgender student, jewlyes gutierrez identifies as female. she is in the white skirt and black jacket. gutierrez says, repeated bullying prompted her to confront the students who were harassing her. gutierrez was charged with misdemeanor battery. but the charges were dropped. thanks in part to an online petition that said. she had been bullied for a long while leading up to the incident.

happening today, the family of when spaulding is announcing a formal claim against the the city and county of san francisco. spaulding was admitted to san francisco general hospital last september for a bladder infection. she was found dead in a stairwell at the hospital 17 days after she left her hospital room. last month, state health inspectors delivered a report blaming the hospital and the sand from the san francisco sheriff's department for the events surrounding spaulding to this apparent and death. the report also stated that the hospital and the sheriff's department illegally assessed spaulding to medical records. spalding

"within these pages i was finding chat logs that included obvious minors, junior high schoolers and such, that were looking to buy, sell, or trade illicit hand guns. " richard showed me a text message exchange from his phone that he had with someone he met on one of these pages selling guns. ok how much is the rifle?

whether it's state or federal to conduct these transactions." true. and keep in mind facebook has over 1.2 billion users we are talking about a tiny fraction here that is abusing the system. there will always be a dark side to social networking. it's a place where people meet and wherever people meet some of them will do bad things. whether it's in a dark alley, night club, or on a social network this is a tough issue facebook is not in an easy posistion it brings up a lot questions as a society we have to face the law abiding gun enthusiasts should be able to have their hobby pages just like anyone else should a few rotten apples ruin it for everyone?
