>> reporter:during his brief court appearance joshua cooper was assigned a temporary public defender. however he told the judge that he has a job, taking home 700-dollars a week and intends to hire a private attorney. >> reporter:the charges stem from a recent incident at his fairfield home where cooper lives with the baby's 17-year-old mother. fairfield police allege that it was here that cooper bit the nose of the baby boy out of frustrationbecause the child wouldn't stop crying. >> "me in my heart i don't think he did nothing like that" >> reporter:outside the court room cooper's mother who you see here declined to speak to the media. >> reporter:however a man describing himself as his uncle had this to say >> reporter:describe the joshua that you know >> "the joshua i know is fun loving, do back flips, play basketball, football, never knew he would do something like this i don't believe he did that" >> reporter:joshua cooper's bail has been set at $750-

"waking up and seeing my baby in the hospital. it hurts. it hurts my feelings a lot. my heart is broken." >> reporter:she said she's confused, hurt, lost and wonders how his own father could hurt him. riggins said ta'jon's father, joshua cooper, called her thursday from solano county jail and confessed to her about biting their son's nose off out of frustration when he couldn't get the baby to stop crying. >> reporter:riggins does not buy that excuse. "i didn't see no anger that

morning. i didn't see no stress that morning. he was up playing with the baby." >> reporter:it happened thursday morning inside the fairfield apartment where they lived with cooper's family. riggins, 16, was getting ready for school. she went to the bathroom and left the two of them alone. she said she never heard ta'jon cry. "two minutes later i come into a disgusting scene," riggins explained. >> reporter:fairfield police responded to the home after riggins called 911. officers did not know what they were dealing with until the found the baby's nose on the floor. >> reporter:cooper was arrested for child cruelty and aggravated mayhem and booked into the solano county jail. officers are trying to determine how fracture and a brain hemorrhage. riggins can only think of one possible reason. >> "that my son has been hit happened behind my back before." >> reporter:she also said she did not know why he snapped. "i seen no signs or i would have left. of course. i'm

not going to put an infant through that." >> reporter:but there were signs. a week and a half ago, ta'jon had swelling and bruising to his face, which riggins thought was an allergic reaction. doctors suspected child abuse and notified cps. now, ta'jon is in cps custody and riggins has to fight to prove that she deserves her son back. "i'm willing to fight. because i'm not in the wrong. i'm willing to fight to bring home my baby." >> reporter:family members have told us. the child protective services hearing was scheduled for today. but there is no update on the outcome of the proceedings. >> pam: new tonight -- we're learning more about the stabbing death of a 16- year-old boy. it happened in a park in campbell. >> pam: and tonight, police have arrested todd tharp. he is a homeless man suspected in the stabbing. >> pam: investigators say, when police arrived at john d morgan park last night. they found tharp injured as though he had been in a fight. >> pam: officers later linked him with a 16-year-old who had been hospitalized with stab wounds. and died in surgery this morning. >> pam: tharp has been booked in the santa clara jail for murder.

from neighbors about their concerns, and looks at how the neighborhood is returning to business as usual. >> reporter:a pedestrian was struck and killed by a union pacific freight train in berkeley this morning, fire and railroad officials said. the fire department received reports of a train hitting apedestrian near the berkeley and albany border at 9:06 a.m., berkeley fire acting deputy chief avery webb said. the pedestrian was pronounced dead at the scene, webb said. >> reporter:the victim, a man, had been walking south on the tracks and a southbound union pacific train heading from roseville to oakland struck him, union pacific spokesman aaron hunt said. >> reporter:the train crew blew the train's horn and tried to stop, but freight trains typically take over a mile to stop and the train was not able to stop in time, hunt said. >> reporter:by the time the train came to a stop, it was blocking four streets >> reporter:-- virginia, cedar, camelia and gilman streets, webb said. the streets were still blocked late this morning. trains in the area have been

concord, philippe djegal, kron four news. >> reporter:a pre-dawn earthquake rolled across the los angeles basin, rattling residents from the san fernando valley to long beach but causing no reported damage. the u.s. geological survey says the quake's magnitude was 4.4 and it was centered 15 miles west-northwest of the downtown civic center. >> reporter:usgs seismologist robert graves called it a typical southern california quake of moderate magnitude and said expectations would be that damage would be slight, if it occurred at all. los angeles police and fire officials said there were no immediate reports of damage. earthquake. it appears to have stopped. we are going to jump right now to the geological gold survey. the
