(male announcer): this is the bay area news station, kron 4 news starts now. >> catherine: new at five. the father of missing teenager sierra lamar is reacting to a major development in the case. santa clara county's d-a will ask for the death penalty for the man accused of her murder. good evening, i'm catherine heenan. the 15-year-old morgan hill cheerleader vanished more than two years ago. her body has *not been found. kron4's rob fladeboe talked to her father about the case. >> reporter:the decision by prosecutors to seek the death penalty against antolin garcia torres, shown here in court in february as he was indicted by a grand jury for the kidnapping and murder of sierra la mar comes as welcome news for sierra's father steve la mar. >>'.it's been shown that he's guilty of this, he's taken a life and we feel he doesn't deserve to continue living life, even if it's in a prison cell.'

>> reporter:15 year old sierra lamar vanished on her way to school in morgan hill in march of 2012. despite official and volunteer search efforts, which continue even now. sierra's body has not been found. legal analysts say the defense will claim sierra lamar is a missing person but steve lamar says prosecutors know what they doing. >>'.i am confidant and have faith in the d.a.'s office, they did not take take this lightly and i don't think they would have pursued it this far otherwise so no, i am not concerned about that.' >> reporter:steve lamar reminds us there is d.n.a. evidence linking his daughter with garcia-torres, who is also charged in the attempted kidnapping of three other women and although he has not been to any of the previous garcia torres court hearings, sierra's father says he plans to be there every day when the trial begins. >>'.i can't hardly stand to look at it, so it's going to be really hard for me when i start going to court, it's going to be very hard but i am just not going to let it me.' >> reporter:even as he holds out hope alive, steve lamar says his entire family was consulted and support the

d.a's decision to pursue the death penalty and in his words.' justice for sierra.' in san jose rob fladeboe kron 4 news >> catherine: the santa rosa woman accused of assaulting a child she suspected was bullying her daughter, might have been >> catherine: that's according to the sonoma county sheriff's office. 30-year-old delia garcia- bratcher was arrested friday after being accused of putting her hands around the neck of a 12-year-old boy athe had been pointed out to her as someone who'd been harassing her daughter. the sheriff's department says it hasn't found any evidence of that. as for the 12-year-old boy - photos taken by school staffers show red marks on his neck. a relative of the suspect says the woman has 6 children - and would never hurt a child. >>"she's got a good heart, she would never do that she says they are making me sound like a monster, she's thrown >> catherine: the woman was arrested on suspicion of inflicting injury to a child. >> catherine: her access to the school is being limited by a protective order, which also prevents her from contacting the victim. her attorney says she adamantly denies touching the boy. >> catherine: a san francisco catholic high school is now apologizing for a policy that created a campus wide controversy. a senior at sacred heart cathedral prep named jessica urbina took her

yearbook photo in a tux. >>most people didn't think it was a big deal -- but it violated school policy and the photo was not included in the yearbook. today kron four learned that the photo will be 'pasted' into the yearbook which will be handed out to seniors this week. and in a reprint available in june - jessica's photo will be included in the senior portrait section. the school is now apologizing to the community in an open letter. saying it 'deeply regrets' the pain caused by its original decision. >> catherine: the school says that while it believes s-h-c is a safe and supportive place. the situation is a reminder it has "much growth to achieve." >> catherine: new tonight. >> catherine: a walgreens store in san francisco has re- opened -- after being shut down by the health department. >> reporter:a source told kron-4 it was closed because of rodent droppings. the store is at van ness avenue and eddy street. this is at least the second time a san francisco walgreens has been shut down by the health department this year >> reporter:in san diego county right now they are mopping up after the first major widlfires least a half dr fires erupted beginning last wednesday, the two biggest on the camp pendleton marine base. >> reporter:charred remains

'mers -- or middle east respiratory syndrome. a third case of the >> catherine: potentially- deadly virus has now been confirmed in the u-s. unlike the first two cases, health officials say this one was transmitted on u-s soil through a meeting and a handshake. senior medical correspondent elizabeth cohen has this story. >> catherine: the first two cases in the united states were from people who got infected in saudi arabia and then got on a plane and came here. those cases were reported in indiana and florida. >> reporter:now, health officials say an illinois man who had a business meeting with the indiana patient has also tested positive for mers. >>"this potential person that is maybe the third case that was transmitted had just basically business transaction with this individual, so no unique travel history of their own and then no travel history since." >> reporter:the c-d-c says during the april 25th meeting, the two men were sitting within six-feet of each other talking. >> reporter:the only physical contact they had was by shaking hands.
