half moon bay mike pelton kron 4 no spirit >> pam: getting to work in san francisco is a little easier, as more muni workers showed up for work today. hundreds of drivers have been calling in sick this week. to protest a proposed labor contract. >> pam: today, san francisco city attorney dennis herrera. charged the transport union with unfair labor practices. for violating a ban on strikes and work stoppages, an arbitrator is scheduled to meet with labor and management on saturday some union members say, they were told to go home, after they tried to return to work today kron four's maureen kelly begins our coverage. with their story. >>they are basically locking them out at this point. >> reporter:the president of the muni drivers union is claiming packed buses and long wait times aren't completely the fault of operators staying off the job. he says that many drivers who showed up to the

unfolded. you can see one of the guards pulling the student.francisco martinez in his wheelchair. the 17-year-old has cerebral palsey.and you can see him smiling. he appears to be joking around with another student. >> reporter:but moments later.the whole scene changes. martinez and a guard.identified by the school district as marcell mitchell. struggle for control of the wheel-chair. >> reporter:there's an argument.martinez tries to get out of the wheel- chair.he's pushed back.and then mitchell flips the wheel-chair.and appears to kick martinez in the head before dragging him into the elevator. >> reporter:at one point.both guards are on top of martinez in the elevator. two other students are there and watch this unfold. martinez says the beating continued in the elevator. >> reporter:once out of the elevator on a different floor.this happened. this is the video that was released last week. >> reporter:the district says mitchell was the guard who punched or slapped a hand-cuffed martinez. before knocking over his wheelchair yet again.
