a fleeing suspect armed with a gun was shot and injured by a police officer monday afternoon. this is video from our helicopter partnership with abc-7 news. it happened after four on sycamore drive about a block from the contra costa county fairgrounds. according to police, officers aproached a group of people, that's when on person took off running. police say, while trying to arrest him, one of the officers shot the suspect.

he was then transported to the hospital with non- life threatening injuires. we are told the officer is a veteran of the anitoch police department and was not injured. a child and a woman were injured in a shooting last night in oakland. this is new video just into our newsroom. it shows the young victim. being carried to an ambulance. the shooting happened shortly before 10 p-m on 83rd avenue near g street shortly before 10 p.m., according to police. both victims were taken to a hospital and they are in stable condition.

investigators say, they are looking for one shooter. no word on a motive. in san francisco,a muni light rail train hit a pedestrian. it happened just after 9:30 last night at 19th avenue and holloway near san frnacisco state university. the victim suffered lacerations to the head and knee. police say this a dangerous area for pedestians since it is so close to the university and that the train driver has a difficulty seeing pedestrains since they are so high. the pedestrian was taken to the hospital and is expected to survive. and in san jose-- seven people are waking up without a place to live this morning after a fire burned through a two-story apartment building. it happened just before five p-m at shadow park place near highway 101 and north of east capitol expressway. the blaze was under control just before six p-m. the american red cross was called to assist four

adults and three children that were displaced by the fire. the cause of the fire is still under investigation and it appears the blaze started on the roof, he said. two apartments on the second floor were destroyed and the downstairs apartments sustained severe water damage. no injuries were reported. storms which brought tornado watches and warnings to the south. this is just south of memphis- after some of the excessive rainfall, this weekend.

a truck driver who hadn't slept for more than 24 hours is being blamed for the crash. now, a proposal is on the table that would allow truck drivers to put in as many as 82 hours a week behind the wheel. its backed by the trucking industry but opposed by safety advocates and the obama administration. the government says nearly four thousand people die in large truck crashes each year. driving fatigue is a leading factor. florida governor rick scott has signed a controversial education bill into law. the measure allows undocumented immigrants to quality for in-state tuition at florida colleges and universities. to qualify, those undocumented immigrants must have attended at least three years of high school in the state.

timothy midgett was taken to the basement of the hall of justice to take out the trash when he made his getaway and ran out the door. a deputy ran after him but midgett. he was booked into jail last caesars year and was set to be released next month. midgett was charged with felony drug possession last august and is still wanted on a narcotics warrant out of houston. in sonoma county this morning. a 19 year old man is in jail. accused of using a stolen credit card to rent a luxury sports car.

police say mohannad halaweh of rohnert park was arrested after an employee saw the mclaren sports car parked for hours at a grocery store. the employee got suspicious and called police. they found out there was a problem with the credit card used to rent the car. but the story doesn't end there. investigators are also looking into whether halaweh used stolen credit cards to rent million dollar vacation homes on two separate occasions. if convicted, the man could face up to six years in state prison. that's just for the sports car case
