when you talk about -- police use of force. baltimore does everything that everyone says you shouldn't do. a couple of things. they don't have any separate investigative authority. the police -- the same police who committed the same force now have investigate to themselves. >> and a lot of instances you want to have state troopers or policemen know that you missed a power. no. 2, baltimore allows the officers to refuse to speak to investigators for a peer of ten days. now as we all know, eyewitness testimony dramatically goes downward as time goes on. ten days gives a lot of time for officers to get their stories together, get together other information to present the best case. officers say they need it because they're under stress. they need it decome prezzed why

bay. that's because visibility is cleared out as a bell except for the cloudy conditions. we are tracking some stronger wind gusts out towards the delta. fairfield we are seeing winds coming in from the west. delta breeze will continue to bring down temperatures. we are looking at 50s across the board and 55 in oakland and a little milder in livermore at 57. check out your high for our east bay. temperatures will be fairly pleasant but definitely cooler than yesterday. 75 in pittsburgh and still pleasant. a little cooler from martinez at 68 degrees. a little milder in fremont low 70s is feeling very comfortable. your giants playing the

breaking news this sunday, a woman and an infant are dead this morning after an alleged drunk driver slammed into the backyard of an apartment. giving us the latest joining us by phone is officer ryan sanchez officer sanchez, thank you for joining us. were you on the scene last night when this happened? >> yes, i was. >> could you take us through what occurred last night? >> last night, we received a car regarding a vehicle into the rear of the apartment complex at 975 mare ta involving possible injuries. >> and when you arrived at the scene, what did you see? >> officers found two people

that had severe injuries and ultimately, there was a 40-year-old female and a 14 month old child >> our heart has to go out to the family of those people who lost their lives last night but special heartbreaking is the death of the 14 months old. >> absolutely, it impacts everybody involved, the entire community and the apartment complex. i know everyone was pretty involved in it and they were very emotionally traumatized with the ordeal. >> we understand two other children were hurt as well. >> yeah, there were two other children a 6-year-old and a 7-year-old who had manor injuries and transported to the hospital and treated and released. again, there is more injuries. >> what can you tell us of the

suspect, any prior involving dwi? >> we don't have that information readily available. all i can tell you was the suspect was a 35-year-old livermore resident who was driving a vehicle with respect of possibly higher rate of the speed and lost control of the vehicle and veered off the road and it came to towards the apartment complex and struck the tree and went into the backyard of two different residents there. >> we just looked at video of that and the wreckage is really remarkable to see and really heart reming to see and to understand what happened there. thank you very much for joining us this morning giving our viewers an update. that's officer ryan sanchez from livermore

here to talk about it mark ferrell who proposed the first of his kind of tobacco ban, thank you for joining and tell us a little bit of what is behind this and what prompted this. >> chewing tobacco is and spoking tobacco is a huge form of cancer in the united states. over 500 000 teenagers in the united states alone tried chewing tobacco every year for the first time. i have three young children who are amazing and i am coaching my son's team right now and i want to make sure for his team and every team in san francisco that we decode them without chewing tobacco. >> you were telling me earlier that you played ball and you also used dips for a while. >> it is simply part of a culture whether it is college or beyond and that's what we are

trying to solve for. >> how wide ranging is this, tell us what this encompasses. >> the legislation itself is simple. it says in every single athletic field in the city of san francisco. if you think of our city limits tobacco it is going to be banned next year. >> we are talking virtually every park in th field in the city, right? >> yes. >> exactly. >> it certainly applies to at&t park and also all of our college athletic field as well. >> it has been for quite a wild. do you think this is going to lead to a ban in mlb? >> that's certainly the hope. major league baseball has been supportive of this legislation from the beginning. >> it has. >> players association have a collective bargaining agreement and chewing tobacco

was part of that in dipping in the field right now. that contract is up in the field right now. we are hoping this will the catalyst to help this change. >> the timing is right. >> absolutely, we have legislation up at the state that would apply throughout all the fields in california. >> how do you enforce something like this? >> that's something we are working out. the one thing that's positive is that we have had a number of players in our major league baseball teams and our giants as well have come out and supporting this. major league baseball have been supportive and they want to make sure they're playing a hand in supporting this as well. >> tony begin gwenn had something to do with this as
