a little bit of patchy fog. not as much compared to yesterday. also see here we have cloudy condition as well. time flies. here's a quick check of the day planner for today. a cool day. now in the 50s. only into the upper 50s and probably be right around 2:00 p.m. reach that number in the afternoon and stay in the upper 50s for late afternoon and into the early evening. looking for a west, southwest brees at about 5 to -- cool in oakland due to the cloudy conditions. we'll have to watch that. you can see temperatures right now as you're stepping out the door. we have low 50s. 55 in livermore. low 50s in santa rosa. under cloudy conditions.

donuts as a crowd starts to circle. the chp telling kron4 this was one of two side shows. the second happening on 880 in front of the coliseum. the chp saying that at least 100 cars were involved in the side shows and that there were no reports of any injuries. i did reach out. they have not gotten back to me. no arrests took place for either side show. reporting in oakland. kron4 newsful. >> a federal lawsuit has been filed against bart. the widow of a wart police officer -- suing the agency. bart denied sergeant todd smith search training. he was shot by a fellow officer while they were looking for

stolen property. when the two unexpectedly entered a dark bedroom. this happened in january of 2014. the lawyer said the deputy chief denigrated officers who requested additional training. the training exceeds state standards. happening today congress will be meeting in special session to try and reach an agreement to prevent portions of patriot act from expiring. anne terror provisions are set to expire at midnight tonight. last week the senate failed to reach a deal to keep the provisions in place. the u.s. attorney general says the country will be facing a lapse. it trumps fear over national security. some sad news out of washington, d.c. this morning. beau biden, the son of joe biden, has died after battling

it turned out to be a computer collectible. it's worth $200,000. it's a rare apple 1 computer. it's very similar to the one you see there. it's was one of only 200 made back in the 1976. a worker sold the computer to a private collection and wants to split the proceeds with the woman who recycled that computer. >> new this morning a 4.1 earthquake hit southern california just after #k this morning. that's about 60-miles east. so far no reports inform damage

27 of those deaths have been in texas. as much as three and a half inches fell in the houston area but no new evacuations have been ordered and we understand that the people in texas have had enough of the rain and flooding. >> antegood news now is in the texas area those storms have moved well off to the east and north. dallas and houston finally starting to dry out. they are looking add even more sunshine for at least the next three days. they really need that break because those rivers are just at capacity and they're overxaflt as well. the good news they're getting a chance to dry out. a little bit of ask therred shower activity out toward the gulf of mexico but he can see for dallas and houston metro area they are drying up and they're heading over to the northeast. so looks like finally a much needed break in the texas area. in our neck of the woods we're

54 in fremont. santa -- when i come back we'll talk about some baseball whether we've got the giants anteas once again playing both home this afternoon. manier detail opposite that later. >> all right. thank you. turning to national news this morning. former speak of the house dennis hassert has not been seen. he was lying to the federal bureau of investigation about his role surrounding sexual abuse allegations against him. new questions that he was apparently trying to cover up. pamela browns has the latest. they tell cnn didn't -- the longest -- paying hush noun a student at the yil high school where he once taught. more than a million dollars to keep allegations he had actually abused him quiet. >> he has not commented publicly but he abruptedly

resigned from this lobbying firm as well as from a chicago -- did not discuss actual abuse. instead, it factions on how the 7 #-year-old former wrestling coach moved the money he was paying the former student. he agreed to pay an unnamed individual $3.5 million to cover up his past misconduct. according to court records it started two years ago when the fbi starting investigate mystery transaction. bank withdrawals. the fbi alleges self-of the withdrawals were less than 2,000. >> they have an obligation to record when you are withdrawing close to $10,000 and there's a pattern of doing this. it's call structuring. that's why they would be looking into this. >> prosecutors say when the fbi asks pastor -- he was keeping the cash for himself.

pamela brown reporting for us. he believes -- in a country home in wisconsin this weekend. the justice department say he's not been arrested because he does not pose a flight risk or a danger to the community. in other news this morning, sacramento county say their search for a missing 6 year old girl has turned into a homicide investigation. burned remains. that's on largest city son has been missing -- from south scrisk -- 25-year-old on suspicion of murder. he's the boyfriend of the girl's mother. >> but he suffered a seizure and didn't realize that she went missing but now police think that he was lying. >> there has not been a moment where he's decided not to be cooperative. it's the changeful events and the discovery of new evidence

and take a look at this. a police officer caught some amazing video out of a bolt of lightning hitting a bridge right in front of him. it happened as the officer was driving earlier this week. there it is in south mississippi. the lightning strike nearly blinded his vision. to catch a video of a lightning bolt at such close range is very rare. the officer says he went back later on and found a chuck of singed concrete. no surprise there. just imagine if he'd been going a little bit faster. >> yeah. it almost looks fake but it's imimpressive how close he got.

discover the champion in you! . . i've been going through a lot right now with my mom. she's been battling colon cancer. this is a tough time and a tough city. he just gives me more strength. he's always positive. greater things to come... hope and belief that god is always working for you and on your side. life changing. i can be closer to god without feeling like i'm too young for this. and it was really moving. and everybody together under one roof. what more could i ask for? i'm a college student and he really spoke to me. what god has in your future will supersede what you've seen in your past. he's inspired me to go through the right path. really energizing and rejuvenating my soul after a tough day. all you have to do is say, "god i'm an open vessel and i'm ready to receive" and he will change your perspective.
