son in critical condition. governor confirmed in a press conference 59-year-old john russell houser from alabama. >> happened during the showing of the movie train wreck. waited until 20 minutes into the movie, stood up and opened fire killing two. louisiana police held a news conference early this morning on the shooting, last half hour. we carried it live on the kron 4 morning news. in case you missed it, here is some of what they said. >> this is such a senseless tragic act. why would you come here and do something like this? and so just like the victims we're searching for answers too. two innocent people lost their lives, numerous other people were shot. it's only through medical science that we have more survivors than we do deceased victims. >> the shooting comes just six days after james holmes was

found guilty in the aurora, colorado, theater shooting. happening today, jurors in the penalty phase of the holmes trial will continue to hear testimony. the jury decided unanimously that the attack was cruel enough to justify the death penalty for holmes. on july 19th, 2012, holmes opened fire during a showing of the dark knight rises. 12 people killed and 70 others injured. attorneys are asking to spare his life. called holmes' childhood piano teacher, middle school friend and cross country coach. stay with us as we continue to follow the latest details out of louisiana and colorado this morning. we have full coverage all morning long on air and online at kron4.com. another big story two wildfires burning near highway

50 which has shut down that road way and near lake berryessa with some evacuation orders lifted. started as a car fire on highway 5 oh, 0. containment only at 5%, 100 acres burned. mandatory evacuations underways. spreading wildfire near lake berryessa. >> 15% contained nearly 7,000 acres have burned. highway 128 remains closed this morning. kron 4 jack is joining us from winters at the community center which has been set up as an evacuation center. >>reporter: good morning, mark i am here at the winters community center still a red cross evacuation center. the good news is some folks that were evacuated have been allowed to go back to their home. excuse me. there is a leaf blower nearby. people that live in the golden

bear community were told last night they're able to go back to their homes which is great news. unfortunately still mandatory evacuations in several more communities. video from yesterday of the fire itself. it's reached almost 7,000 acres 6,900 acres is what cal fire is saying the overnight numbers are. still only 15% contained. big problem is the terrain out there. they say it is hilly it is rocky, it is very tough for them. but they are throwing just about everything they have at it. 1,300 firefighters, multiple engines. they have air planes, helicopters all working this fire. we had a chance to talk to cal fire yesterday and talked to them about this and where we go from here. >> the drought is having an impact definitely. a lot of old brush very, very

dry. critically low fuel moisture levels. we're optimistic, but it's real why i going to depend on -- really going to depend on mother nature and how the winds go. hoping today brengz cooler testimony -- brings cooler testimony urz less wind and make fire fighting easier for those firefighters. the community center is is still open. not sure if there are many people left here right now. still closed down, obviously they're still asleep inside. we'll talk to them as soon as we can. >> thanks for the information. we'll check back with you. checking wildfire conditions around northern california and we're going to focus on the lake berryessa fire. how is it looking? >> it's looking okay. this is the camera looking in that direction, the closest one we have from the bay area. as we take a look at current conditions at the moment it's mild. not too much in the way of hot temperatures just yet. here's a quick look at the actual conditions right now

county firefighters received help from cal fire. firefighters contained it by about 9 last night. officers able to identify the young arson suspect after talking about two teenagers in the area when the fire started. name of the boy not released because of his age. officers looking for a vehicle that may be connected to the hooting death of a hayward police officer -- shooting death of a hayward police officer and a man arrested on suspicion of killing the sergeant is in jail and set to make court appearance later today. 24-year-old mark estrada was booked into jail for the murder of sergeant scott lunger. believed to be shot during a traffic stop. authorities want you to take a good look at the vehicle. police say it was seen near the shooting shortly after happened. they won't say how this car may be connected to the shooting. this was the somber

procession in the east bay yesterday afternoon. dozens of law enforcement vehicles escorted the body of slain hayward police sergeant scott lunger. fellow officers saluted as the hearse carrying his body arrived at the chapel of chimes funeral home. learning more about him this morning, first baseman of the try valley a's and they'll miss him this morning. spoke to a teammate, bruce fraser who said he always knew sergeant lunger had a difficult day job and they talked about the danger of police work, especially approaching cars during traffic stops. >> he said he was careful. there were times he wasn't able to make games because he'd been working that night. there were also times where he'd only get a few hours sleep after getting off of work and then still come to the game. >> the try valley a's will still be playing this sunday at gra in

addition a high school but now in memory of the sergeant. the funeral service tentatively set for next week. told at the neighborhood church in castro valley next thursday morning at 10. viewing scheduled if for wednesday at the chapel of the crimes but no time announced yet. happening today, marine corps veteran break ground on the hayward 9/11 memorial project. memorial will be adjacent to the historic old city hall building on mission boulevard. tribute to those who died in the september 11th attacks, as well as hayward police officers and firefighters who have fallen in the line of duty throughout the city's history. and a not guilty plea for the man accused of killing five people in a modesto home last weekend. martin martinez was formally charged. stems from the death of his girlfriend's two-year-old son last year. died of head injuries while he was in the care of martinez.

james. hot spot not northeast area -- in the northeast area because of the fire burning that has highway 50 shut down. that is closed. alternates are highway 88 and also interstate 80 if you're headed up to the north lake area. they have a detour set in place for you instead of highway 50, but it is through city streets, so that's definitely going to be some delay there. so for sure if you're headed up to lake tahoe at any point this weekend, you definitely want to take highway 80 or 88 through kirkwood into south lake. switching to cameras now bay bridge toll plaza very heavy traffic getting into downtown san francisco. normal for this hour of the morning. 10 to 15 minutes because it's backed up into the mik arthur maze and the meter lights are on. traffic a bit sluggish into the city. san mateo bridge heavy there as well. on the right-hand side of your screen that's bumped up to about 15 minutes from hayward to

doctor. asking to impose an injunction on the current law. this morning you soon won't be able to smoke in parks or on trails banning all smoking on city trails and parks. commission brought the ban to the council attention after a two year investigation. it limits secondhand smoke and kree a little a better environment in pleasant ton. federal government wants social media companies to alert authorities of any terrorist activities on their site. twitter and facebook are fating back. sites already ban overly graphic content and alert police if they suspect someone might get hurt. companies are worried they could be held responsible if they miss a tweet video or blog that hits of an attack.

in the sierra shut down. lake berryessa is the other with evacuations. highway 50 fire started as a car fire. shut down from placerville to south lake. 5% contained mandatory evacuations. on the right is the growing wildfire in lake berryessa. 15 to 20% contained in the last few minutes. jackie is monitoring the rag fire that started near rag canyon. he's joining us from winters. jackie. >> reporter: morning mark. i'm here at the winters community center and this red cross center is still open, although they have allowed some people to go back to their homes for folks that live in the golden bear community. they were told around 9:00 they were able to go back to their homes, but there are multiple commutes in that area of lake

berryessa that are under mandatory evacuation. pictures from yesterday of the fire and as you said the latest information we have came from cal fire just moments ago where they say that fire containment moved from 15 to 20%. we're at 6900 acres that have totally been burned at this point, so close oh, 7,000 ache -- close to 7,000 acres of scorched earth in the lake berryessa area. cal fire is putting all their resources into the fire at this point. 1,300 firefighters nd bulldozers working this fire, hoping to contain it. real problem for firefighters is is the terrain out there. they say it is hilly it is rocky. there is not a lot of access to that fire area, so what they're hoping is that they can get this thing under control and contained within the next few

days. one of the good things they're looking at right now they say over the next couple days they believe the wind will die down and they'll be able to get a ring around this thing and get total containment. obviously hoping to talk to he vac ease here -- evacuees here this morning of. we're going to talk to them as soon as we see them. >> we'll check back with you at the top of the hour. team coverage continues. james has been tracking the humidity and also, of course the winds this morning. >> yeah, which is the big things on the minds of firefighters as they're battling in rugged terrain. embers get ought up in winds and gusts and drop hundreds of yards away and start another spot fire. the gusts much calmer today than yesterday. winds are coming from the southwest at about 10, pretty

much staying at that level not increasing too much, maybe up to 13 miles per hour later this afternoon. but these gusts are expected to die down. currently about 13 miles an hour gusts and that's mild compared to yesterday when we had 20 miles per hour gusts. relative humidity gone down a bit at 73, expecting that to fall into the 40% range. that's kind of what we're expecting with the conditions there to develop over the course of the day. as for temperatures, daytime highs around the fire at about 79 to 80 degrees. that will happen around 3:00 this afternoon. and the hope is that they can get a better handling on this -- handle on this before next week because these numbers look more like 99 to 100 to the middle of next week. we're tracking those for you. great shot from s p fo. we've -- sfo. brilliant colors in the sunrise

to make first court appearance. 21-year-old mark estrada was booked into jail last night for the murder of scott lunger. he was shot during a traffic stop wednesday morning. take a good look at the vehicle you see here. police say it was seen another the shooting shortly after it happened and officers want to speak to the people inside. they won't say how the car may be connected. meanwhile, sergeant lunger's funeral is set for next week ne neighborhood church in castro valley next wednesday at 10. viewing is is scheduled for wednesday at the chapel of the times and no time has been announced. happening right now police investigating an apparent murder-suicide in have a lay 0. two -- have a lay 0 two people killed one injured. three people shot, two died at the scene. third taken to the hospital.

he waited 20 minutes stood up ask is opened fire. he tried to escape, but police quickly arrived. he went back inside the theater and killed himself. two wildfires to tell you about this morning. heading to south lake tahoe, you'll want to avoid highway 50 because a wildfire has grown so fast along highway 50, it is now burning more than 100 acres. halfway between placerville and south lake tahoe and highway 50 is closed from placerville to meyers. there are mandatory evacuations in the white hall area and sand flat campground. this fire is only fooi% contained this -- 5% contained this morning. not clear when it's going to reopen wildfire near lake berryessa in napa county 15% contained. burned 6,900 acres. within the last of half hour, we've learned the fire is 20%

contained. 1,300 firefighters are battling the blaze and evacuation orders still in effect for several commutes. quail ridge and canyon creek areas are still under mandatory evacuations this morning. we had stronger winds yesterday that firefighters were dealing with. james, how are things looking now? bay area is much calmer. fairfield which had sustained winds at about 22 miles per hour that's backing off now just about 14. as 4 the lake berryessa area, this is the kind of weather we can expect over the course of the day today. winds coming from southwest still at about 8 to 13 miles per hour. gusts are going to be much calmer today than they were yesterday, so that's some help for firefighters. on the flip, temperatures much warmer yesterday maxed out at 77. today looking for temperatures to get up to about 80 degrees. then looking for this type of forecast to stay in through the weekend.

the problem comes next week when temperatures rise to near 100 for parts of the area, especially near lake berryessa hoping firefighters get a handle on this before the temperatures spike. live look outside as we give you a quick local forecast. brilliant skies out in this morning with patchy clouds at best. a lot of sunshine coming down. you see here from the sfo camera the same story a few puffy clouds with plenty of blue skies, no delays the at the airport. temperatures are nice and cool. upper 50s to hoe 60s usual pattern. how is is the time the -- now is is the time to get had that morning run. mid-50s in san jose, on the chilly side in the south bay san jose 58. making up for it this afternoon. great looking temperatures for the inland valleys upper 70s to low 80s for everybody.

north bay, east bay south bay all in that 78 to 82 degree range. that will be the general range that encapsulates every inland community. 66 in san francisco 73 in oakland. most of our bay shoreline communities you can see will be in the low to mid-70s. most communities will be right there in the low to mid-70s. great looking day on the bay and great looking weekend ahead. take a look at saturday and sunday. temperatures hov earn reel nicely there. next week we begin the warm up as soon as monday. we get in hand highs into the upper 80s. tuesday, wednesday thursday, flirting with triple digits. there are a couple problems starting out with a car fire showing the east shore freeway down. westbound 80, car fire blocking the right lane. firefighters are on scene making things slower in the area
