separate instances and of all your at the first instant you heard the gun fire nearby >>:yes it was the chp conducting the first accident which was a six car vehicle collision, and while there were during the investigation and about 205 in the morning we heard gunfire about a few hundred yards north of them. they saw a vehicle pulled over on the right hand shorter-- shoulder and when they drove to investigate the found someone who had been shot and later pronounced dead at the scene we have our investigators have been called from home and we have our crime scene investigators who have collected the evidence from the scene. they're working with our detectives right now who are trying to piece together everything that happened. trying to determine where the victim had been prior to, and while all of this happened

woah this is not true >>:he never wanted anything that would hurt his mom >> marty : a wildfire continues to burn in the el dorado national forest this morning. the kyburz fire has burned around 200 acres -- but has given fire crews some trouble. it is only 30 percent contained this morning. --- highway 50 has now been partially re-opened. one lane is now being used to get traffic through in both directions. crews say evacuations have been lifted for nearby homes. firefighters are still trying to determine what started the blaze. a wildfire continues to burn near lake berryessa this morning as well. so far the wragg fire has burned 10 and a half square miles -- that's nearly 7-thousand acres it too is only 30 percent contained this morning. there are about 140 buildings - including homes - still threatened by the blaze.

firefighters have contained enough of the fire to call off evacuation orders for homes in napa. but evacuations are still in place for the quail canyon and sackett lane neighborhoods. nearly 2-thousand firefighters are on the scene working to get the fire under control. still ahead in the extreme measure being taken in san francisco to stop people from urinating in public. and then a story about women pushing baby strollers on a local trail coming up

continue to get more information throughout the morning. happening now: a warning for women pushing baby strollers in the north bay after a series of attacks on a scenic trail. police say a woman was walking a long the shoreline parkway trail in san rafael when a man came up to her and demanded money. the woman pulled out her wallet. that's when the man hit her in the neck, took the wallet and ran off. police say this is the third attack on women on this trail this year. the first attack happened back in january. all three women were pushing their kids in strollers. and then in may a woman reported being knocked down, dragged into the bushes and assaulted. in that case the man threatened to hurt the child. right now police don't have a suspect in any of the three cases and it is unclear if the attacks are connected. more bay area news now: a milpitas fitness trainer is under arrest and accused of sexually assaulting a teenaged client. police say william mccowan works from his home in milpitas. they arrested him july-9-th after getting information that a 16 year old girl might have

been assaulted by him. detectives are looking into the possibility that there are more victims. in san diego the right to die fight continues. a judge says he plans to dismiss a lawsuit from advocates who want to end their lives. christy o'donnell is terminally ill and wants a doctor to giver her medication to end her life. she says she'll appeal the ruling.but doesn't expect to live long enough to see it through. o''donnel has cancer in her lungs, brain, spine, and ribs. she can't use morphine and faces a painful death. >>:for any judge or any law or legislator tommy--tell me that my daughter has to watch me died painfully. that is wrong >> marty : o'donnell along with three others. including a san diego doctor. are plantiffs in the suit. the judge says a written decision will come on monday.

more bay area news now: this morning one north bay town is taking the future of one of its parks into its own hands. neighbors of millennial park in san anselmo collected enough signatures to put a flood plan on the ballot. the plan would turn a popular park into a retention area in case of a flood. but opponents of the measure say the benefits of the project aren't worth what it will cost the park and its visitors. kron 4's emily turner has the details. save our partk >> emily :the fight to save san anselmo's millennial park wouldn't just save the swing sets and ball fields, says opponent dan maguire- it would also save the tax payers >>:the money that would be spent is not going significantly helped >> emily :he helped make sure the project proposal goes up for a vote by the whole city in november. that project* would turn millennial park into a water retention basin to help with flooding. the project is slated to cost 17 million

new details this morning about the memorial service for fallen heyward police officer scott lunger. the service has been moved to oracle renin in oakland it is scheduled for next thursday and there were some dramatic moments in a heyward courtroom yesterday many of sgt lungers' colleagues were there as the man charged with his murder was in court for the first lunger was shot early wednesday morning during a traffic stop. he was a 48-year-old father of two. authorities say the suspect.mark estrada was wounded in a gunfight with another officer. he now faces first degree murder charges with special circumstances including murder of a police officer. members of estrada's family were also in the courtroom.and were visibly upset. >>:if you talk to his teachers or anybody that knows and they say that he is too kind and that he could not do something like this >> marty : estrada's mother insists her son is innocent.

4 news weekend. police yesterday investigated the shooting on i 80 that ellis started just before 1:00 this morning. first there was a multi car accident on the freeway. an hour later when police officers were on the scene they heard gunshots. this morning we talk to live with lt. bob. and an update on the investigation >>:it was the chp conducting the first accident it was a sixth vehicle collision. and while they're doing that investigation at about 2 05 in the morning they heard gunfire just a few hundred yards north of their near the over crossing. they sought a vehicle pulled over on the right hand shorter- shoulders-. and when i drove up to investigate they found someone who had been shot and later pronounced dead at the scene we have our investigators have been called from home and our

crime scene evidence investigators who have collected the evidence from the scene. they're working with our detectives right now who are kind of--trying to piece together everything that happened at the scene last night. where the victim had been prior to and how and why all of this happened >>:do we know yet if it was a drive-by shooting? do know the circumstances behind the shooting? >>:we do not have all the details right now we do not have the motive for the shooting and in fact we do not have the true identity of. the of we're still awaiting that information from the corner. --coroner we're pushing for it as quickly as possible to bring justice not only to the victim of for that person's family and friends >> reporter :and i would assume that you guys are putting the call out as well for people who might have been on the highway at that time to give you a call?
