talks about who will replace him are already under way i'm steve nannes reporting. more bay area news: >> marty : a convicted rapist could be set free to live on the street. after several failed attempts to move 51-year-old fraisure smith into homes in fairfeild, suisun city and concord. state officials renewed a motion that would release smith on transient status. that means he would stay in different motels and hotels. the solano county district attorney's office is fighting the motion. more than 4-thousand possible placement opportunites in 4 different counties have already rejected smith. officials say, they are running out of options. smith is set to be released on transient status next month. unless a suitable home is found. also in the east bay: police have arrested a man they say was spying on women in a u- c berkeley bathroom. police say, back in may, joseph barbir used a camera to record women using a residence hall restroom. investigators say, at least one- hundred women were secretly recorded.

campus police also believe barbir used signs directing women to that specific restroom. he is facing more than two dozen counts of invasion of privacy with a camera. police say, at least two of the victims were minors. in the south bay: a woman is pleading for the public's help--- after her late husband's ashes were stolen from her home. the crime happened friday morning on howen drive in saratoga. the victim arrived home to find two burglars running out of her house. once inside the home. the victim discovered that her husband's ashes were taken. she says the ashes were in a box which looked like a jewelry box. the woman says, she won't seek any criminal charges. if her husband's ashes are returned safely. and still ahead of the coming el nino could become for celebration in california but also because for concern. we will explain as become back at at&t park could be a great

ends in a wild crash. the driver goes through an intersection, and then t-bones another vehicle. police then jumped out of their cruisers and arrested the driver. the driver of the car that was hit was taken away in a stretcher. police say the car they were chasing was stolen. during the chase that car sideswiped at least two other cars. the driver also blew through red lights, drove the wrong way -- and *may have hit a pedestrian. there's still no word about the condition of anyone involved in the crash. happening now in the bay area: a library is shut down because of bed bugs. and it's the second time this week. the most recent infestation is the north branch of the berkeley public library. the pests were discovered friday morning by bed- bud sniffing dogs. officials say, the bugs were found in a downstairs men's restroom, under desks and on a chair. the branch will stay closed through monday for heat and steam treatment. and is scheduled to re-open tuesday. the bedbug- sniffing dogs will be checking other library

middletown. it was a happy ending for a rancher who lost his horse during the chaotic early days of the valley fire. here is video showing the rancher reuniting with the 20- year-old horse named 'lightning'. lightning's owner was able to track his work horse down after the middletown animal hospital posted a picture on facebook. lightening came to animal hospital after being spooked off his own ranch and getting into a fight with a stallion on another property. he was treated for his wounds, as well as dehydration and exhaustion. a santa rosa non-profit cared for lightening until his owner came forward. the vet says they have been very busy since the fire broke out. >>:i think we have treated around 200 animals including chicken sheep and goats and birds. and then another two or
