if mechanical error played a role. >> reporter:that brings into question the rest of the fleet of city sightseeing buses. while 9 of the 27 bus fleet passed a chp inspection back in september. the chp's motor vehicle unit plans to return to the company's bus yard this week to conduct another inspection, both of buses and maintenance records. >> reporter:the driver of that bus now has a lawyer who says he's doing his own investigation into what happened. >> catherine:kron 4's maureen kelly interviewed the attorney - who says the bus suffered a multi-system failure. >>--he feels terrible about the whole situation.he's grateful no one was killed.

>> reporter:attorney robert cartwright of the city sightseeing bus.now identified as kenneth malbar of san francisco.who is recovering at san francisco general hospital with a broken back, ribs, ankle, foot and a punctured lung. >> reporter:he was one of the people wreckage.according to his attorney malbar was stopped at the corner of post and taylor.and as the light turned green.he heard an explosion.and then the bus began to excelerate.you can see it barreling down post in this surveillance video.according to driver.there was nothing he could do to stop it. >>---he tried to the brakes.they just flopped.he tried the emergency brake, the tired putting itno neurtral.he tried turning the bus off.nothing worked. his lawyer says plowing into the scaffolding on the corner stockton was the best thing he could do to keep the bus from heading farther downhill.and possibly hurting or even killing other people. >> reporter:the attorney says his team is trying to find out whatever it can about the bus itself.he says it's a 2000 orion. while we know the chp never inspected this bus, city sigtseeing says it was checked out in october.the bus driver's attorney says it was also
