upper 20s 20s. . we will all the elements in place. dry air, clear skies. we have a little bit of a breeze. the freeze warning is in place covering everybody expect downtown san francisco and maybe a little bit of the east bay shoreline. also a touch along the immediate coast. burden by the climate effect of the coast there. this is again until nine this morning. this probably may not be reinstated because our next system is coming from the northwest. that will actually be a rain producers tonight. 50s again today. not as much sunshine today as yesterday. rain coming up in just a bit, back to you. our top stories this morning. several people are injured following a tour bus crash in san francisco. >> this is video of the scene september to us by a kron 4

viewer. this happened before 6:00 last night along the embarcardero with a bus collided with a suv. >> avery harper has the latest details on the investigation. avery, good morning. >> reporter: good morning. yeah, things along the embarcardero are quiet now, but this is not what it looked like yesterday. take a look at that video again. eight people were injured. seven sent to the hospital with minor injuries. and this all happened after, according to the sfpd, a car cut off a double decker bus causing the driver of the buck to step on the brake. a different car slammed into the back of the bus. >> there were a lot of police cars. a lot of ambulances. people being taken away on the stretchers and being put into the ambulance. >> reporter: now, that bus was owned and- rated by the big bus tours company of san francisco. the owner of that company says that they will be reaching out

to those victims to offer them support. but not much else is known about the status of those victims right now. back to you. >> thank you so much. we will check back for an update later this hour. you remember that it was just last month when the city sightseeing tour bus lost control and crashed in union square. 20 people were hurt in that accident. the chp released its report on the city sightseeing tour bus company last week. it found that four out of six tour buses inspected had to be put out of service. the chp says some of the violations include steering issues, brake lights not working properly, inning exits not working along with a fuel leak on one of the buses. city sightseeing sent a statement saying they fixed many of the mechanical issues. palo alto police are investigating a dead i have officer-involved shooting that happened on christmas. this morning police say the man called 911 himself and then

charged at responding officers with a knife. kate cagle with the investigation. >> reporter: a fellow client says the suspect had only been staying at this mental health treatment facility for four days. now he is dead and police are trying to piece together a motive. it was 9:00 christmas night when someone inside this mental health facility called 911. the caller said someone here wanted to harm someone else. police are saying that was a false emergency. when officers got here they say instead the 911 caller himself was holding a knife and charged at number in the street. two officers shot at the man who later died at the hospital. >> rapid, bam, bam, bam, bam. >> reporter: mike heard the whole thing from his nearby condo. >> no question in our mind those were gunshots. >> 24 hour care. >> reporter: in this online video the executive director explains momentum for mental

health is a holistic program. >> we have support of housing sites. >> reporter: the program teaches independent living skills and promises to help residents cop with mental health issues. it is licensed by the department of social services and the california department of mental health. the ceo sent this e-mail to employees calling this, quote, a sad and tragic incident confirming that it was a la silva client shot and killed by police. >> the people that i have met from here have been very, you know, respectful and they kind of keep to themselves. >> reporter: momentum for mental health ask not return my request for comment. as for the officers, neither was hurt but both are on paid leave. standard procedure after a police shooting. the district attorney's office is conducting a parallel investigation trying to go figure out exactly what happened here. the palo alto police department

will be releasing the names of the officers involved in upcoming days. kate cagle. this morning we are learning more about a police shooting near the hayward bart station. police say they found a backpack linked to the man suspected of shooting at a bart police officer. inside that backpack was a ski mask, burglary tools and a bb-gun. the suspect is identified as charles getting. police say he shot a bart officer in the arm during a search in the parking structure. another officer returned fire and hit getting. investors disorder a body inside the u-haul truck he had been pushing. the officer is out of the hospital this morning. getting is being treated for his injuries. he is expected to survive. coming up steph curry led the wars yours to a win on christmas day. but his assist off the court this holiday season. a 1,200 acre wildfire is now 60% contained in southern california.

for your money this morning let's look at the stories that might effect your bottom line. if you use sprint or verizon, you could have some money coming your way, but you will have to act fast. customers have until thursday to claim refunds for unauthorized third-party messages. those include texts for things like horoscopes or sports scores. the carriers are accused of burying the charges in bills so customers wouldn't notice them. sprint and verizon have greed to pay $158 million to customers. current and former subscribers who paid for unauthorized texts beginning back in july 1st of 2010 can file a request for part of the settlement. if you have recently stayed

at a high at hotel they are asking customers to monitor credit card statements after discovering malware. the malware was found on hyatt hotel come suter systems used to process customer payments. they are working with outside security experts to figure out what happened. head officials have not confirmed whether any sensitive information was stolen by the hackers. the company is now using stronger security measures and says customers can feel confident about using payment cards at hyatt hotels worldwide. and it's off it to another chilly start all the way across the bay and points beyond. we are talking temperatures sub freezing in the north bay. napa at 31. let's take a live look outside at the bay bridge total plaza. the sunrise slowly coming up

you know what? by the way, you get a decent amount of sun out there. more than in the bay area today as the system moves in from the pacific. good news on that. temperatures will be a little bit on the mild side for us today comparatively speaking, but not as much as in the seven-day forecast. look at that. santa rosa 29. downtown san francisco at 39 even. it's colder this morning than yesterday morning. clear skies. light on the winds is what we have been having. satellite and radar there is the next system to look out for. pretty much all day to build. it will spread cloud cover and that chance of rain on the marine locations by the latter portion of today. so perhaps for the morning hours at least a good deal of sunshine. but not the wall-to-wall sunshine we experienced from yesterday. watching the temperatures being plotted for you into motion. by 2 p.m. take time as you can see in the north bay to guess some warming going because of the cloud build up by 11:00 though not cooling as

much down tonight although quite a bit of 30s in the peninsula and east bay. we should maybe steer clear of a hardcore freeze maybe perhaps tonight due to the extra cloud cover and precipitation being mentioned, rain being mentioned in the forecast. 2 p.m. tomorrow this system is moved out. temperatures improving a little bit. you have to wait for calm of days to see improvement on that. as far as the clouds, let's do that for the day. you see the scattered clouds to 5 p.m. some showers to the south bay. another batch building up to the north. that moves on through. you may start your day off with a few little showers on monday, but immoving sky conditions by mid-morning. still some scattered clouds may lingering through the balance of the day. a mild trend for the week ahead. mid 50s territory on the east bay shoreline. that all important seven-day forecast draw your attention to

wednesday. a little system there that may cause scattered cloud cover. nightly lows in the inland valleys on the chilly side near around freezing. back to you. >> thanks a lot. we are learning more this morning about an armed robbery near uc berkeley that took place earlier this month. police describe the male suspects as middle school age. back on december 18 police say the two suspects took a victim's cell phone at gunpoint. it happened about 8:30 in the evening near dwight way. both city and campus police searched for the suspects but so far they have been unable to find them. also this morning california health officials are warning of an uptick in cases of norovirus. it's also known as the winter vomiting disease. officials have confirmed 32 outbreaks since october of this year and they have likely sickened hundreds of people. the disease is very contagious. you can get it through contact with an infected person by eating or drinking foods and liquids that contain the disease or touching contaminated things

and then touching your own mouth. a health official says make sure you wash your hands frequently with soap and running water for at least 20 seconds. freezing temperatures have san joaquin county valley sit res growers working overtime. the national weather service has issued a hard freeze watch for much of the valley this morning. for citrus growers that means running water and turning on wind machines to raise temperatures in their groves. the freeze watch is later in the season, so much of the crop is already now harvested. want to tell you about an act of generosity this holiday season. some warriors star steph curry teaming up with feed the children program to provide support for oakland families in need. curry and his family handed out foots and gift at bb memorial cathedral. >> reporter: the curry family, including riley, handed out care packages to 400 oakland

how about the golden gate? >> it's okay. it's all right. i like the bay bridge better. >> all right. the sun in a different spot here. and as we can see, yeah, high clouds are thickening up to some stratus although i think we will have improvement before things start to change in earnest. freeze warning in place for us until nine this morning. good coverage area expect for downtown san francisco and the coastal regions along the east bay shoreline. temperatures right now still holding in the upper 20s. santa rosa in the north bay 31 for napa. richmond 34. san francisco is 39 and san jose right at the freezing mark. so around the perimeter of the bay we see upper 20s and lower 30s. satellite picture here is our next system towards the north. we will spread some of that stratus across the skies. i think most of the bay area will be spared of any showers really until late this afternoon at least or into the evening hours when it starts to build. san jose temperatures up to 52 about 2 p.m. but quickly falling

even with the induction of the cloud cover i mentioned. here is the breakdown. by noon temperatures uniformly in the 50s. 4 p.m. we are talking partly cloudy with showers developing late. more details on the timing of this coming up in a bit. back to you. >> thank you so much. a 1,200 acre wildfire in coastal southern california is now 60% contained. this is new video showing us the fire out there a glow of orange. there are roughly 400 firefighters out there right now trying to put this fire out. firefighters are saying that gusting winds up to 50 miles per hour has pushed this fire towards homes. how fire crews are fighting against some really tough weather conditions to stop this fire from spreading any further. >> reporter: a volcano-like eruption lit up the hills in ventura county on the eve of

christmas day. 40 to 50-mile-per-hour winds shot embers and flames across the 101. drivers racing to escape. our news crews were in the thick of the fire zone. >> ahead back to my car. i am going to park along the side of the freeway. you can see the ashes blowing everywhere. it's just super intense right now. >> reporter: despite the intense winds, helicopters made water drops in thick smoke under the cover of darkness. >> we got two helicopters here right now. one just made a drop. in fact, if you stand by, we are going to get hit with the what the are here. and they are going to come back around here.

here he comes again. >> reporter: the lamar beach residents packed up and left as they stared down an inferno inching closer to their homes. >> there is one, two, three, four, five, six of us now. we are probably going to head to santa barbara. i think our house will be okay. it was built not too long ago. i don't think there has been a fire here. i am 29 years old. i don't think there has ever been a fire at this hillside here. >> reporter: in fact, this area hasn't burned since the 1970s with a nearly five year drought feeding the flames. now to national news, wild weather claiming its lives of at least four people in texas. officials say tornados were to blame for several car accidents near the intersection of two major highways just east of dallas. the victims were killed in those collisions. another tornado ripping through a suburb damaging several homes. authorities say the storm set a

trailerpark on fire near dallas. another officer-involved shooting to tell you about in chicago. police say that a 55-year-old woman was accidentally shot and killed by officers during a domestic disturbance calm. the woman was hit as officers struggled with the 19-year-old man. officers are saying that the man approached them in a hostile way when they arrived at the home. police officers fired their guns killing both victims. the shooting remains under investigation this morning. this morning a fire that damaged a mosque in houston is being called suspicious. the fire was reported friday afternoon at the islamic society of greater houston. the two-alarm blaze caused major damage to the building but no one was injured. the fire started right after people finished praying. >> burned church, a burning synagogue or temps, it's not good to see it like that. it's just a place where people look for peace. people look for solutions and people communicate with god.

and it's very, very sad. >> officials say the blaze had multiple points of origin which led them to believe this fire may have been set intentionally. the investigation is ongoing right now and they say a recent spike in vandalism to mosques have prompted hate crime investigations. multiple shots have been fired at a suburban mall in atlanta causing the mall to go into lockdown. this was the scene inside the mall after shots were fired near the food court. you can see people rushing towards the exit. police say a group of men were arguing outside the mall when someone pulled out a gun and started shooting. the shooter then ran into the mall, firing multiple shots. shop owners say they will not be able to make it if customers don't feel safe going to the mall. >> well, this is the last time i am coming to this mall. it's not safe. >> i mean, what are you going to do? you have scanners at the door for people? i mean, you can't do that. what do you do? >> there are no reports of any

how they are getting ready to march in the rose bowl parade. >> reporter: the high school marching band is preparing for their time in the national spotlight when they will be marching in the 127th rose bowl parade. >> left and right. >> maintain a four step distance, please. >> reporter: for the first time in the school's history they will be part of what is one of the most celebrated events of the year. it took years to get there. >> there was a pretty long application process. took us about two years to get everythinged ready. we he need letters of recommendations. >> reporter: they managed to land a prime spot. >> in the rose parade the band is the 65th unit out of 93. so we're a little beyond midway through the parade. we hope the temperature is nice and warm. >> reporter: while the band has performed in the macy's thanksgiving parade, band

the far east bay numbers 27, for example, at anitoch. so quite a bit in the way of some cold temperatures to start things often. satellite and the radar picture, well, echoes are far up towards the north. you can see some of the cloud cover deck is making itself known in the bay. we are going to call it a variable cloudy story with some of the showers developing later today. because of that temperatures not as generous in the afternoon highs today as we saw from yesterday. 11 p.m. still some shielding going on for most of the metro area in terms of the 30s. they will develop tonight even with some of the that cloud cover and precipitation. so it's going to be a cold raw rain going on for us. warming up tomorrow. cloud cover will remain probably through the day as you will see, but we will warm up in the north way it looks like the same process been for tomorrow night with some 30s making themselves known as well. futurecast for us, we see scattered showers through the day today. by 5:00 already some showers counsel to the south. another batch you can see up

towards the north. but it's pretty -- pretty quickly gone by already 7 a.m. still stuck with variable clouds on balance for the late morning hours tomorrow and even into the afternoon. it's going to be inverse of what we have for today. in other words, the day will start off cloudy and turning to mostly clear by tomorrow fight. temperatures for the south bay mid 50s to be found for today and then all important seven- day forecast we mention wednesday is kind of an expectation day. we might see scattered clouds with all of that, but it looks like we will warm up to about 60 or so as we ring in 2016. marty. >> thank you so much. let's turn to politics this morning. in decision 2016 it is very rare for big donors and politicians to talk about their relationship and the big money that binds them together. but cnn caught up with a republican party donor who has given millions of dollars to politicians and he spoke with a presidential candidate who benefited from the donation. >> . >> reporter: foster freeze has written his biggest check to

support his good friend. rick santorum. in 2012, the retired billionaire money manager threw santorum a lifeline when he supported him with more than to million dollars. >> i think is a champion little guy. he is very presidential. >> reporter: in his heyday freeze was making $10 million a month. he won't say how much he will give this campaign season, but explained why he donates. >> i get a accepts of satisfaction that i'm continuing the process that created my success. >> reporter: freeze prefers to give the super pacs, which can take as much as he is willing to give. >> when the super pac came along, i realized that i could just write a check that's a lot more effortless and best thing to work. >> reporter: santorum doesn't believer freeze is trying to influence him. > >> he wouldn't be supporting a guy four years ago that was 1% in the poll. he is in for it.

>> reporter: he says donors like freeze are out gunned. >> there are a lot more people giving because they believe in something. they far outnumber the people who give for access. yet the people who give for access give much larger dollars i according to a non-partisan watchdog so far super pacs have raised $315 million and spent almost $100 million. much of it on ads. but those ads still leave republican candidates far behind the frontrunner, who hasn't spent a dime on television advertising. super pacs are a disaster. they are a scam. they cause dishonesty and you better get rid of them because they are causing a lot of bad decisions to be made by some very good people. i am not blaming these folks. but i guess i could. >> reporter: some experts say big check writers are driven by a mix of business and ego.

>> they think they will support what they want and they are giving to people they know that will answer their phone calls and give them access and listen to what they want on a public agenda. >> republican presidential candidate donald trump is seeking credit for an obama administration plan to step up deportations next month. trump says the move only came after his regular calls on the campaign trail to deport the estimated 11 million undocumented immigrants in the u.s. the raid focuses on hundreds of families that have entered the u.s. since 2014. it's the first large-scale effort to deport families that have fled from violence in central america. the race is on to repair the uss hornet in alameda before the heavy rains come to the bay area. the tirade aircraft -- it has sprung some leaks and officials say it needs to be fixed before el nino arrives. a crew is working between the

storms to apply a coating to the deck that should last for the next few years. the navy vessel served during world war ii and was retired in 1970. gas prices are going up again in california. experts say that a shortage caused by problems with the state's refineries is to blame. the nationwide average for a regular gallon of gas is just $2. that compares to $2.81 here in california. gasbuddy.com says there has been an unplanned maintenance issue at the refineries in the state and the prices could be rising more before they fall. let's go ahead and check some prices around the bay area. in san francisco it's the $2.78 a gallon for regular gas. oakland the average is just a bit less. $2.69. san jose is right in the middle. $2.70 for a gallon of regular unh had -- unleaded. the force is strong in the new "star wars" film as it sets another box office record.

she has the latest details on the investigation. good morning. >> reporter: good morning. eight people were injured in the crash and seven were sent to the hospital with minor injuries because of the bus crash. take a look at what it looked like yesterday all bug embarcadero near broadway where the crash happened and according to the sf pd, a car cut off a bus causing the driver to break the that is when a different car, suv, hit the back of the bus and the driver is not at fault. we were able to talk to a witness and listen to what they have to say. >> there were a lot of police cars, a lot of ambulances, people being taken away. on the stretchers. and being put into the ambulances. >> reporter: that buzz is owned and operated by the big bus tourist company of san francisco. we were able to talk to the vice president about what they will be doing for the victims.

on the investigation. >> reporter: a fellow client says that the suspect had only been staying at this mental health treatment facility for four days. now he is dead and police are trying to piece together a motive. it was 9:00 pm on christmas night when somebody inside this mental health facility called 911. the college says that someone here wanted to harm someone else. police are saying that that was a false emergency. when officers got here, they say that instead the 911 caller himself was holding a knife and charged at them in the streets. two officer shot at the man who later died at the hospital. >> really fast -- rapid -- four or five shots. >> reporter: he heard the thing from his nearby condo. >> no question in our minds that those were gunshots. >> 24 hour care. >> reporter: in this video, the executive director explained momentum for mental health is a holistic program from this group. >> we have supportive housing sites. >> reporter: the live-in

kron 4 news. learning about a police shooting that happened near the hayward bart station and police say they found a backpack link to the man suspected of shooting a police officer. inside that backpack was a ski mask, burglary tools and a bb gun. the suspect has been identified as charles getting. police say that he shot an officer in the arm during a surge in the parking structure. another officer returned fire and that hit him. investigators later discovered a body inside a u-haul truck that getting had been pushing. the officer is out of the hospital this morning and he is being treated for his injuries and he is expected to survive. steph curry led the warriors to a big win against the cavaliers on christmas day. coming up we will take a look at his -- off of the quarter this holiday season. new information on a 1200 acre wildfire . we have information on the containment numbers, the fire burning in southern california. before we go to the play, we will tell you about how sprint and verizon customers can see money coming their way

morning about an armed robbery near uc berkeley that happened earlier this month. police describing the male suspects as middle school age. it happened back on december 18, and police say that the two suspects took a victim's cell phone at gunpoint. it happened about 8:30 pm near dwight way and voted street. but city and campus police officer search for the suspects and so far have it -- have been unable to find them. >> california health officials are warning of an uptick in cases of norovirus also known as the winter vomiting disease. health officials have confirmed 32 outbreak since october of this year and they have likely sickened hundreds of other people. the disease is very contagious and you can get into contact with an infected person by eating or drinking foods and liquids that contain the disease or touching contaminated things. and then touching your mouth. health officials say to make sure that you wash your hands frequently with soap and running water for at least 20 seconds. five china has ended its long- standing one-child policy.

>> avery has details on an investigation. >> reporter: things quiet, now, but that's not what it was like yesterday. take a look at the video of the scene, eight people were injured in the tour bus crash. several had toking taken to the hospital for minor injuries. according to san francisco police, a car cut off a double decker tour bus, a different car hit the back of the bus. they say that was an s.u.v. now police are saying the bus driver was not at fault for this accident. we were able to speak to someone who saw the crash. his ton what they had to say. >> a lot of police cars, ambulances, people being taken away on stretchers and being put into the ambulance. >> reporter: now, that bus is owned and operated by the big bus tours company of san francisco we were able to talk to the vice president and ceo of that company, saying they will be reaching out to the
