latest police chief to step down, last month a bombshell, and the mayor ed lee asked for resignation after a deadly officer involved shooting in the bay view neighborhood, tony chaplain is named the acting chief and earlier this year, back in february, san jose chief retired from the department is on the left there, and he took on the chief position at the tracy police department, eddie garcia the officer on the right is named the permanent san jose chief. to the controversy surrounding that six month jail sentence for a former stanford swimmer convicted of rape. kron 4 obtained new documents, a giant pile of them. >> part of the sentencing brock turner told the judge he had no experience drinking or anything to do with the party culture

there are now pictures of turner spoking a hash pipe these are taken off of his cell phone used as evidence for the prosecution during trial. the pictures prove that he died to judge when denying when using substances and turner sent text messages to his sister in high school and stanford about drinking and looking to smoke, buy, and sell weed. also wanting to do acid and use lsd and mdma and a photo of him smoking of a bong and drinking, but that's not released despite extra requests made to get a copy of that the judge did see all of this evidence when sentenced turner to six months in county jail, coming up tonight there are several reports out there now that turner took a picture of the victim naked and sent it to his

stanford swimming friends we'll go over what the court documents say actually happened tonight at 6:00. grant. >> the pressure on the judge who sentenced brock turner to only six months in jail is mounting tonight, kron 4 was there today as other rape survivors and advocates delivered a petition with over 1 million signatures to the state commission that has the power to remove the judge from the bench. >> members of the national woman's advocacy group came to the state building in downtown san francisco carrying boxes representing the estimated 1.2 million signatures of people asking the judge be removed from office. with the crowd of media trailing behind the boxes were delivered to the california commission of judicial performance a little known government body that can dole out discipline to jurists the building survivors spoke out about the lasting trauma they've experienced. >> you relive that moment over and over and over again. >> as people held signs reading

protect survivors not rapists they express frustrations for what could be a continuation of the culture. >> there is protection that the justice system didn't work unfortunately it still doesn't work today. >> there was a bicyclists representing the two bicyclists who stopped the attack and tackled brock turner the main person behind the recall effort of judge percy says it sent a chilling message. >> saying don't worry, we have your back. >> back up stairs, no one from the commission met with the activists they were forced to just leave the boxes on the counter. >> we hope to hear from the commission that they are going to move forward and if they don't, we will be following up. >> the california commission on judicial performance can remove a judge from the bench for misconduct, it happens very rarery. so far only 11 times in california history. the commission says they get

about 1200 complaints a year and usually only 10% of those are found to warrant investigations if an investigation is opened in this case, it could take six months or longer to complete. kron 4 news. a growing coalition of state legislatures are lining up behind the effort to move aaron percy, sent a letter to the commission on judicial performance in san francisco asking for a review of conduct, also sent a letter to the district attorney asking for him to write a review of the sentence. this will allow another judge to impose a stiffer sentence, coalition of legislatures are asking that if he did not resign they'll explore other measures to hold persky accountable. it is noting he is without his supporters. spoke with a attorney saying.

for the past eight months santa clara county deputy says there is no evidence persky is bias. >> the judge is a fair thoughtful judge who considers all factors in making decisions. critics say the lenientsy was based upon privilege saying he based the decisions on the fact did he make a mistake in the case? >> judges are human, we all over look things this is a very thorough, thoughtful judge, i would be surprised if he made any decision with anything but the facts and anything presented at sentencing and probation report. >> says she has witnessed judge

unconscious victim. brown is already a registered sex offender with a felony conviction on his record, the victims just 14 and 15 years old, no other details have been released no other victim. a female construction worker was stabbed to death near the job site the victim was working construction at a site on shiply street between harrison and fulsom she was reportedly escorting a man and a woman away from the area she was gone for some time and her co-workers notice that's when they went to look for her and found her stabbed near this liqueur store, the victim's co- workers spotted the two suspects near the scene police were able to get this in time to find and arrest them. the construction worker was taken to the hospital but died shortly thereafter. police have not released the name of the victim or the two suspects involved in the fatal stabbing. san jose police continue to

right now. welcome where we're getting new pictures from the rape case how they might have played a roll in his sentencing. good evening everybody new court documents sent to kron 4 news shows the former swimmer behind bars for rape has a history behind partying goes against the squeaky clean images, we are here now with a look at new details and photographs. turner had told the judge that coming from a quote, small town in ohio, i had never really experienced celebrating or partying that involved alcohol, the prosecution says these photos prove otherwise, these were sent out today about 500 pages worth of documents that we received. these were images taken from his cell phone right after his arrest and used as evidence during trial. this one here is of him smoking a hash pipe. the pictures according to the prosecution that he lied to
