this afternoon. all the children were at home. the source of the gunshot is still a mystery here. >> reporter:this was the happy scene late wednesday afternoon as relieved parents like scott kiedaisch were reunited with their kids after a lockdown, prompted by an ominous alert of a gunshots near the school, lasted almost five hours. >>scott kiedaisch -- this was a very scary situation. your heart drops. >> reporter: shortly after 9:30 wednesday morning, a san jose police swat team was called in after a school employee reported hearing several gunshots in the neighborhood. heavily armed officers fanned out across the semi rural area to investigate, closing down busy monterey road. >>captain ed schroder/san jose police -- our initial preliminary investigation shows it was behind the school but not

actually at the school. >> reporter:police quickly determined there was no 'active shooter' and focused on a small cluster of homes just south of the school, where one neighbor said the gunfire was the result of someone shooting at squirrels. >>captain ed shroder/san jose police -- this is something that has been brought up. we have not confirmed it one way or the other and what it was done. but it has not been ruled out. >> reporter:the school sought to reassure parents their kids were safe but al wilcynski said he would have liked to know a little sooner. >>al wilcynski/parent -- they have kept us up date drop the day. --throughout the day. >> reporter:a handful of nearby residents were evacuated as police focused on an area just south of the school, which is technically inside the san jose city limits, where discharging firearms of any kind is illegal. the lockdown was downgraded a couple of hours into the ordeal and eventually

released any information on the suspect that they are looking for. happening now. >> grant:the coast guard are investigating the source of two oil sheens in the bay. one of the sheens surrounds a tanker docked outside a rodeo refinery. >> reporter: police here at the headquarters are trying to look at all leads and unfortunately there was-that unfortunately there was no surveillance video. coming home late, it is dark and then there is a forced entry

by several masked individuals with guns. that is what happened. >> reporter: four masked men forced their way into this home and skybridge estates. a holding a family at gunpoint and ransack the house for money and jury. one member of the family was struck in the face with the gun. but was not seriously injured. the suspects escaped in a dark color sedan. >> sure you lock up your home. --make sure >> reporter: many who live nearby is disconcerting they say. >> we have had three break- ins and the last year and half. >> reporter: there has been a series of home invasions over the last couple of weeks. surveillance cost

22-year old man. has been given the death penalty. darnell williams was sentenced this morning for shooting and killing eight year old alaysha carradine. carradine was at a sleep- over in july of 2013 - in east oakland. sierra lamar's disappearance trial from three *other separate attempted denied. >> catherine:a santa clara county superior court judge denied the motion tuesday -- for antolin garcia-torres. he's the man accused of kidnapping and murdering the morgan hill teenager in 20- 12. >> catherine:he's also accused of trying to kidnap three other women from a morgan hill safeway in march

of 2009. garcia-torres' fingerprint was found on a stun gun battery left behind in one of the attempted kidnappings. linking him to the crimes. the judge says there's not enough evidence to show there's prejudice against garcia-torres. >> catherine:lamar was last seen heading to school four years ago -- and investigators say her d-n-a was found in his car. prosecutors want the death expected to start later this year. >> catherine:now to a big national story we are following tonight. north carolina leaders are asking for calm tonight after last night's violent protests following an officer-involved shooting and killing of a man in charlotte. >> catherine:protests of the killing sparked protests that injured more than a dozen police officers and closed down parts of an interstate highway. >> grant:now, both police and the family of the man who was killed are speaking out. from our partners at c-n-n. emily schmidt reports. >> reporter:people in tulsa oklahoma are demanding answers - after police released video of an officer shooting and killing an unarmed black man. >> reporter:40-year-old terence crutcher was shot by a white officer last friday. some of the video clearly shows he had his hands up. >> reporter:but you don't see what he was doing as he was shot. officer betty shelby fired the fatal shot - and she's on administrative leave.
