knocking down some trees and causing some airport delays. in moraga.the wind brought down this tree on the side of the road. and in san francisco, the storm brought down a tree limb on webster and branch streets. there is a wind advisory in effect until sunday at 2-a-m. there is concern that gusty winds will bring down more trees and powerlines. and in the north bay. the rain caused a big rig to lose control crashing into the center divider and flipping over. kron4 was first on the scene yesterday. >> marty:drivers from the other side of the freeway stopped and got out of their cars to help the driver. it happened on highway 101 near lincoln avenue in san rafael during the morning commute. the truck was carrying produce which spilled all over the highway. both sides of highway 101 were blocked for hours as crews cleaned the debris. the truck driver is expected to be okay. and make sure you download the kron four mobile app so you can track the rain and the traffic impact anytime and anywhere. you can check out up-to-the- minute radar and see the forecast in your neighborhood.

we also have real-time traffic maps. it's a free download for iphone and android devices. >> marty:our other top story. the san francisco police officer shot in the head in the city's sunset district is concious, but is still in critical condition. that is new information released by the s-f-p-d. earlier this morning. swat teams brought one person into custody. it all started at around 8:15 last night, after reports of a man causing a disturbance at the lakeshore shopping center.

after officers found the man, he started shooting at the officers. one of the bullets grazed an officer in the head. then the shooter ran toward stern grove, near sloat boulevard and 19th avenue. take a listen to how officers eventually captured the man. officers used a flash-bang device to distract the man and arrest him. police say he is a mentally disturbed. he is currently at san francisco general hospital for treatment. witnesses near the shopping center say this may have all started as a robbery. and earlier this morning s-f-p-d interim chief toney chaplin

those two people have not yet been arrested. happening now. the family of three-year-old elijah dunn wants the state to change how arresting officers handle drivers who are under the influence. >> reporter:dunn was killed in a d-u-i crash last month. kron four's spencer blake reports the family has started a petition drive they hope will get anyone arrested for d-u- i.off the road. this petition - justice for elijah dunn - calls on state lawmakers to get tougher on those who drive under the influence. chuck maloiki, whose grandson elijah died in this crash on i- 680, says nobody should be allowed back on the road immediately after a d-u-i arrest. >> :"we're trying to make it to where you automatically get your license taken away, period. no matter what. even if it's the first offense! take your license away. you can't drive!" >> reporter:right now, the law is different for an alcohol- related d-u-i and a drug related one. for alcohol, arresting officers take the driver's license, give them a temporary one, and wait for the d-m-v to decide whether or not to revoke the license altogether. for drugs, however, the law does not call for officers to

send the license off to the d-m- v. that's why yarenit malihan, the woman officers arrested for a drug d-u-i in the wreck that killed elijahstill has a license as she awaits her court hearing. >> :"everybody's innocent until proven guilty, but when you do a field sobriety test on somebody, you know what they did already. you know they're guilty of it already." >> reporter:the family's petition says, no matter the impairing substance, first time offenders should not have a license until after their hearing. it calls for second time offenders to lose their license indefinitely, and demands there be *no bail for an impaired driver if they injured or killed someone under the influence. >> :"it's not only for elijah. it's for everybody out there who's lost a loved one, who's lost somebody close, and also for people in the future so that it doesn't happen to anybody else." so far the petition on change dot org has almost two thousand signatures. elijah's grandfather says one of their biggest supporters of the petition right now is madd, which isn't just mothers against drunk driving, but also mother's against *drugged driving. in sunnyvale, spencer blake, kron four news.

>> marty:an uber driver is in jail for assaulting a police parking assistant who was giving him a ticket in downtown mountain view. 62-year-old ghulam mohammadi was arrested on suspicion of assault with a deadly weapon. he was booked into santa clara county jail. mohammadi is accused of backing into the police assistant's car, which was pushed backwards. police say the assistant was able to step away and didn't suffer any injuries. uber has not responded to a request for comment. playoff baseball is heating up. and while the giants may be out, we'll hear from the team's president about what we can expect this offseason. for the weekend: it's the pumpkin festival and parade in half moon bay. come and witness gigantic car sized pumpkins on display. it's all happening in downtown half moon bay from 9:00 to 5:00. the event is free to attend.

>> marty:in sports. the cleveland indians and the toronto blue jays squaring off in game one of the a-l-c-s. this was the second time these two cities met in a championship series this year. their n-b-a teams, the cavs and raptors met in the conference title just a few months ago. and that is the first time that's ever happened in sports history. this game was a pitchers dual until the 6th. that's when cleveland's francisco lindor hits a blast to center. giving them a 2 -zip lead. and that would be all the runs cleveland would need as the indians pitching staff shut down the blue jays high powered offense. holding them to just 7 hits and 12 strikeouts. final score 2 nada indians. game 2 is today at 1:08. and happening today.

the cubs and dodgers face off in game one of the n-l-c-s. cubs ace jon lester is facing off against rookie kenta maeda. first pitch is set for 5:00. the cubs of course are coming off a 3-1 series win against the giants. giants president larry baer told fans the giants expect to be busy this offseason. at the top of the giants wish list is a closer. they could be big players in this year's baseball winter meetings in early december. also happening today. some bay area college football teams are in action later today. the stanford cardinal are taking on notre dame in south bend. stanford looking for a road win after back to back losses. kick off is set for 4:30. and san jose state is hosting the university of nevada- reno.

kick off is at 7:30. cal has a bye this week. in niner's news. quarterback colin kaepernick will be looking for his first win in nearly a year as he is set to start tomorrow against the buffalo bills. the last time kaepernick won a game was against the ravens last october. besides niner fans, n-f-l scouts will be watching closely to see how much rust cap has shaken off. the six-year veteran takes over a team that ranks 31st in the league in total yards. sunday's game is set to kick off at 10:00 a-m. u.s. supreme court justice ruth bader ginsburg is now apologizing for comments she made about colin kaepernick's national anthem protest. justice ginsburg did not issue a direct apology to kaepernick. but she did release a statement saying, she was barely aware of the anthem protest. and that her comments were "inappropriately dismissive and harsh." this is not the first time she

a little bit more rain on the way tomorrow cooler monday should be fairly dry the might get some scattered showers the out the area. >> marty:in bay area news. an update now on a story we've been closely following here on kron 4. the contra costa district attorney has filed hate crime charges against two men they believe brutally beat a sikh man in the east bay. the d-a's office has been facing pressure from the community 41-year old maan singh khalsa is recovering from his injuries after the brutal beating last month. he was punched, stabbed, and his turban pulled off. he also had his hair cut off. khalsa's hair is a sacred article of his faith. which is what prompted the hate crime charge. one of the suspects, chase little of texas was arrested and posted bail. the second suspect has not been arrested. he is colton leblanc also from texas. a warrant is out for his arrest. when the attack happened, the victim was at a red light near the hilltop mall in richmond. police tell us 5 men were in a

car, and started yelling at him and throwing beer cans in his direction. then two men got out and beat him up. >> marty:khalsa was hurt so bad his pinky needs to be amputated as well. as for the suspect with the bench warrant, the district attorney hopes he turns himself in before federal warrant enforcers get involved. >> marty:raiders fans have heard this before. but the raiders are one significant step closer to leaving oakland, again.

nevada lawmakers approved a 750 million dollar hotel tax to help build the team a new stadium in las vegas. and it becomes official on monday when nevada's governor is expected to sign the plan in las vegas. the stadium is expected to cost nearly 2-billion dollars. a new tourist tax will pay for part of it and the raiders have committed 500-million dollars to the project as well. billionaire casino mogul sheldon adelson says he will cover the rest of the cost. u-n-l-v's football team would also play home games at the new domed stadium. however, this is still far from a done deal. 75 percent of nfl owners still have to approve the move. that vote won't come until early next year. and the league's commissioner has said recently he wants to see the raiders get a new stadium in oakland. owner mark davis released a statement saying. "all parties have worked extremely hard to develop and approve this tremendous stadium project that will serve as a proud new home for the entire raider nation." >> marty:oakland mayor libby schaff is speaking out on the potential move by the raiders. she met with reporters during last nights state of the city address.

the victim's nissan was later spotted by an officer near highway- 4. officers pursued the car to vallejo, where the suspects were taken into custody. on monday- two people were carjacked at gunpoint in a bart parking lot in oakland. it happened at the macarthur bart station parking garage at around 11:50 at night. those two people have not yet been arrested. happening now. the family of three-year-old elijah dunn wants the state to change how arresting officers handle drivers who are under the influence. dunn was killed in a d-u-i crash last month. kron four's spencer blake reports the family has started a petition drive they hope will get anyone arrested for d-u- i.off the road. >> reporter:this petition - justice for elijah dunn - calls on state lawmakers to get tougher on those who drive under the influence. chuck maloiki, whose grandson elijah died in this crash on i- 680, says nobody should be allowed back on the road immediately after a d-u-i arrest. >> :"we're trying to make it to where you automatically get your license taken away, period. no matter what. even if it's the first offense! take your license

away. you can't drive!" >> reporter:right now, the law is different for an alcohol- related d-u-i and a drug related one. for alcohol, arresting officers take the driver's license, give them a temporary one, and wait for the d-m-v to decide whether or not to revoke the license altogether. for drugs, however, the law does not call for officers to send the license off to the d-m-v. that's why yarenit malihan, the woman officers arrested for a drug d-u-i in the wreck that killed elijahstill has a license as she awaits her court hearing. >> :"everybody's innocent until proven guilty, but when you do a field sobriety test on somebody, you know what they did already. you know they're guilty of it already." >> reporter:the family's petition says, no matter the impairing substance, first time offenders should not have a license until after their hearing. it calls for second time offenders to lose their license indefinitely, and demands there be *no bail for an impaired driver if they injured or killed someone under the influence. >> :"it's not only for elijah. it's for everybody out there who's lost a loved one, who's lost somebody close, and also for people in the future so that it doesn't happen to anybody else." >> reporter:so far the petition on change dot org has almost two thousand signatures. elijah's grandfather says one of their biggest supporters of the petition right now is madd, which isn't just mothers against drunk driving, but also mother's against *drugged driving. in sunnyvale, spencer blake, kron four news.

kron 4. raiders fans have heard this before. but the raiders are one significant step closer to leaving oakland, again. nevada lawmakers approved a 750 million dollar hotel tax to help build the team a new stadium in las vegas. and it becomes official on monday when nevada's governor is expected to sign the plan in las vegas. the stadium is expected to cost nearly 2-billion dollars. a new tourist tax will pay for part of it and the raiders have committed 500-million dollars to the project as well. billionaire casino mogul sheldon adelson says he will cover the rest of the cost. u-n-l-v's football team would also play home games at the new domed stadium. however, this is still far from a done deal. 75 percent of nfl owners still have to approve the move. that vote won't come until early next year. and the league's commissioner has said recently he wants to see the raiders get a new stadium in oakland. owner mark davis released a statement saying. "all parties have worked extremely hard to develop and approve this tremendous stadium project that will serve as a proud new home for the entire raider nation." oakland mayor libby schaff is speaking out on the potential move by the raiders. she met with reporters during last nights state of the city address. >> :"and it does not distract our focus from doing our job which is to do a responsible viable option for the raiders to also consider staying in oakland at the end of the day it is up to the nfl owners" on the field the raiders are on a roll, they are currently 4 and

>> marty:after nearly 17-hours of surgery and then five more hours of individual surgeries, twin brothers born conjoined at the head will now be able to live separate lives. it took the work of 40 medical experts to perform the surguries at a hospital in the bronx, new york. this is a photo of jadon mcdonald, finally laying on his own. his brother anias needed extra surgery to reconstruct his skull. doctors say the boys have a long recovery ahead. the illinois twins were born attached at the crown of the head. it was a difficult surgery that almost didn't happen. the lead surgeon was considering stopping the procedure at one point. because the boys shared more brain tissue than anyone realized.

park employees were called to get him after reports that the gator had been showing up at a boat ramp. the gator was later released into the park. the owner of the park says the capture actually saved the animal. the park owner is now asking the public to help him come up with a name for the gator.
