incident in the east bay. >> vicki:a young couple involved in some sort of confrontation ending with a young man losing his life, his girlfriend is now behind bars. >> steve:earlier today the victim's mother spoke to kron4's haaziq madyun.in a story you will only see here on kron4 >>"i miss my son dearly, i miss him so much" >> reporter:michelle davenport, a heart broken mother grieving over the sudden death of her son, 22- year-old ian eldon irby. it happened in this parking lot wednesday around 5:22 pm here at the glenwood condo mother says there was a knock at the door >>"i opened the door and it was his girlfriend and she said ian has been hit by a car" >> reporter:davenport saw her son's body right where she is standing. she says initially first responders told her that ian had a pulse.then. >>"then another officer said is there someone you can call like a chaplain? i said is my baby okay? he said no" >>"it was a homicide"

still no arrest in the murder of a grandmother in her own home. police say her body was set on fire to try and cover up the crime. >> vicki:officers spent the day yesterday searching the remains of a burned down home trying to figure out who killed the 59-year-old woman. police say the murder happened sometime between 10pm monday night and 2 am tuesday morning. police currently have no motive for the murder or any leads on who the killer is. >> steve:a man charged in connection with a confrontation with a bart police officer has been acuitted today.in a case that happens to be the first in san francisco to involve footage from police body cameras. jurors found michael smith not guilty on seven counts including resisting arrest and misdemeanor battery against a police officer. >> steve:you're looking at footage from the incident in july when smith was arrested by bart police officers. they claim he was resisting arrest.but bystanders reported seeing him being punched in the head as he was being detained. an excessive force investigation led jurors to believe he was unlawfully treated and all charges have been dropped.

not deploy them. this we will see. >> reporter: some are skeptical and think that this new solution making things worse without the barriers. the city system are working on a long-term support upgrade project but it will cost of millions of dollars and is years away. maureen kelly, kron4news >> steve:police in kentfield keeping a close eye on the area of laurel and locust avenues. which neighbors say is prone to flooding. you can see a significant amount of standing water in the street. the storm drains are working, but picking up a lot of debris that may cause flooding. >> steve:the novato fire district says it is also monitoring the creek levels. by the early afternoon, the fire district saying no creeks had been breached.

but that could change as the stormy conditions strengthen. >>- "mainly what the thing that we're looking at is erosion. we can see from drought that, you know, trees have died and when trees dries we don't have inside or along the banks and that's when we see erosion. fences and then retaining walls can come down, so that's what we're more concerned about." >> steve:the novato fire district also says strong winds have been problamatic. more trees and powerlines are expected to fall down. >> steve:the fire district says noif you see a downed tree or pole, call 9-1-1. >> steve:the south bay also being lashed by heavy rain and high winds with no let up since about noon. >> pam:as kron four's rob fladeboe reports now, the stormy weather is making it's presence known along highway -17 and the santa cruz mountains.
