c 7 news. the victim's car was able to get off the freeway and ended up parked on frisbie and harrison. the car had several bullet holes on the driver's side. the victims' conditions is still unknown at this time. this is the third time in the last three weeks that there has been a shooting on a bay area freeway. just this past monday. there was a report of a road rage shooting that occurd on 580 in oakland. police say one driver was tailgating another driver. then, a gesture was made -- and then one driver pulled a gun and opened fire. no one was hurt. but bullets did hit one of the cars. and on november 30-th there was another shooting. this on the 580 frutivale off- ramp in oakland as well. a man and a woman were hit, both were taken to the hospital in stable condition. no word on any arrests in that case. >> reporter: providing electricity as well as others involved. kai the attorneys for the gush of fire and griffin men have filed wrongful death lawsuits in connection with the tragedy that claimed 36 lives.

>> reporter:while the gunman was preoccupied with the clerk at the cash register, the clerk's brother sneaks up from behind and grabs the gunman. all three start fighting for the gun. the two store employees over power the would-be-robber, disarming him, accompanied by a pretty royal beatdown. here you see a customer walk in, shocked by what's happening and immediately walks back out, while calling 91 on his cellphone. the two brothers sat on top of the robber until alameda county sheriff's deputies arrived. during the melee, the first clerk in the video was shot in the hand. his brother was shot in the leg. regular customers of this family owned business are glad to hear that both brothers survived the incident >>:"all i gotta say he was real brave, god bless him big time" "i'm just glad that my man over here is okay and his lovely wife and everybody is safe and quiet and the bad guy is gone"

sot robert aguirre/homeless advocate it's happening on city streets too. campsites here at curtner and almaden road. at 6th and virginia and here at story road and highway 101 among many others despite ambitious efforts by the city and county to get some 4,000 homeless people off the streets. sot robert aguirre/homeless advocate given 72 hours notice, steve and a dozen others were evicted by caltrans this morning, saying they would simply pitch their tents again tonight across the freeway because there is no place else for them to go. a broken watermain creates a muddy mess on evans avenue in san francisco's bayview district. take a look at this aerial video from our helicopter partnership with abc7 news that shows all the water and mud on the street. it even flowed into a private bus yard. the intersection of evans and rankin remains shut down at this hour as crews work to fix the broken pipe and repair the street.

the ordeal was caught on camera. dora scheidell reports. --reporter pkg-as follows-- nats: did you tell them? they're coming, they know. they're coming. you can hear phil warner's voice as he tries to keep the young boy calm. phil warner, witness: i just heard screaming, help, help, help. phil had come to sundance to ski with his daughters. and was in the chair in front of the young boy. he heard the screams and quickly realized, the boy's backpack was caught. the ski lift operator immediately stopped the lift. phil warner, witness: he called down there and i could hear him on the radio. it wasn't long after the ski lift operator called for help, that ski patrol arrived to assess the situation. phil warner, witness: we know your arms are hurting but take some deep breaths. i can't they hurt so bad. ski patrol realized they needed a ladder. but the longer he had to wait, the more frightened and restless the boy became. nats phil warner, witness: i was just afraid that he was going to keep kicking and fall and then do some damage, break his leg or something. once they got the ladder, they were able to climb up and get the backpack off the boy. nats: pull, almost there. yay!

starting early in the morning and lasting all day long, the crowds at sfo were intense. there were major delays throughout the morning as you can see here. plus long lines with so many people traveling. on a normal day, sfo sees about 62 thousand people coming and going, but on this day - a duty manager said they had 82- thousand both coming in and going out. plus, all of the rain caused problems. some passengers said they took extra time to make it to the airport. others talked about how they try and figure out a strategy to keep calm and carry on. sot/tc: 00 robert clark/holiday traveler: i was just glad, we didn't forget the kids, you gotta have humor. most of the young kids traveling say they brought along cards,

and phones so they could play games to pass the time. at one point in the morning there were delays up to 90 minutes. return to index of stories... >> vicki: you can see the aerials from our helicopter partership with abc7 news showing the gaping hole in the ground as crews pump out water. it's estimated that this section of the roadway will remain closed until midnight. it's believed the cause of the break is the age of the pipe. it's a common problem in the city. kron4's maureen kelly explains what's being done to fix it. gallons of water shoots out of pumps.in order to clear the massive 20 foot by 20 foot wide, and six foot deep hole that crews had to make in order to find the break in the 12 inch water main. the sf puc say it's a tranmission line.meaning it moves water from one area to the other.and so no water service was cut off for any residential customers.but some of the surrounding business were without water.

believed to be from the 1930's.but some of the over one thousand miles of pipeline underground dates back to the late 1800s.the sfpuc says they are ramping up their pipeline replacement project.the goal is now to replace 15 miles of pipeline a year. we try to put in a few thousand feet at a time it is a long process some projects can take a year or 18 months depending on how busy the street is. the more new pipe they can get underground will hopefull mean the fewer emergency water main breaks creating muddy messes on city streets. maureen kelly kron4 news. the manhunt for the suspect in the berlin christmas market attack is over tonight. he was killed by police during a shootout in italy. but his death has not ended the terror threat in germany. scott mclean with our partners at c-n-n explains. the death of 24-yr old anis amri has brought a europe-wide manhunt to an end, but it has

connection with these investigations. police knew amri had links to a network of isis recruiters in germany. in a new video released by the terror group's media site, amri pledged allegiance to the leader of isis. for months, amri was on a german intelligence list of the most dangerous islamists in the country -- a list 549 names long. paul cruickshank/terrorism analyst:the worry is that there are other people connected to this attacker still at large. both italy and germany tried to deport amri back to tunisia unsuccessfully. that fact led to a conversation between the german chancellor and the tunisian president. angela merkel/german chancellor: i told the president that we need to be able to speed up the process of returning nationals. and that's not all -- merkel says she's will look at other way to prevent a similar attack. in washington, im scott mclean. one of anis amri's brothers is speaking out. he had this message for the people of berlin today. "we apologize to the people of berlin, those who were killed were innocent people. we ask for their forgiveness and we apologize to them again." the attack on the christmas market in berlin left 12 people dead and dozens more injured. police say the hijackers who took over a libyan plane this morning wanted to go to rome.

new details are coming out about a horrific attack at northern california gas station where an employee was burned alive. what we now know about the victim. and a robber tries to hold up an east bay store. but some employees had other ideas. see how they fought back. a masked man walks in with a gun, points the weapon at the store clerk.demanding money. this is surveillance video of the incident recorded tuesday at around 7:45pm here at the royal market in hayward.

while the gunman was preoccupied with the clerk at the cash register, the clerk's brother sneaks up from behind and grabs the gunman. >>:"so we've had more and more situations where not only shop owners but citizens are taking these types of situations into their own hands" all three start fighting for the gun. the two store employees over power the would-be-robber, disarming him, accompanied by a pretty royal beatdown. courageous or crazy? "well in these types of situations people making split second decisions and in this case it worked out well for them" here you see a customer walk in, shocked by what's happening and immediately walks back out, while calling 91 on his cellphone. the two brothers sat on top of the robber until alameda county sheriff's deputies arrived. >>:"the suspect in this case is a 15-year-old male juvenile" during the melee, the first clerk in the video was shot in the hand. his brother was shot in the leg. regular customers of this family owned business are glad to hear that both brothers survived the incident "all i gotta say he was real brave, god bless him big time"

bay area freeway in the past three weeks. an encouraging update tonight on the south san francisco attacked and hit in the head last month. the department says robby chon is out of the hospital and is going through intense rehabilitation right now. he will be home for chirstmas. as far as his condition goes. he is said to be doing okay. chon was struck in the head with a skateboard on thanksgiving day while chasing a suspect. that suspect is under arrest. in keeping with a holiday tradition. governor jerry brown announced his pardons today. he granted 112 pardons and one commutation. no names really stick out on this year's list. many of them were for low level crimes that had been committed years ago. one thing you noticed going through the list. many of the offenses involve marijuana and other drugs.
