"we still needed wrapping paper and bows and his son josh and one more toy than his daughter jade and he was adamant about getting that one more toy" she says to speed things along, the two split up inside the store, each taking one of the children with them. she says at one point she saw one of her friends in the checkout line. when did you know something was wrong? "she said, somebody got stabbed up back there, and i was like in target and she was like yeah" she said she immediately called his cellphone but there was no answer "so now i'm scared" she asked a man standing near by if the man injured was black, white or latino? "he said, no, he was black and he was with his son and i just ran to the back" when she got there tyrone griffin was bleeding profusely "i was going crazy and he was like, josh? still worried about his son, still worried about his baby, the only reason they did anything to him in the first place" witnesses told davis that griffin got into an altercation with two men after asking them to turn down some profanity laced music playing in the presence of his son. the two men were arrested and remain in custody, yet to be charged you want these people to go to jail? still ahead on kron four news. versace is being sued by a former employee for unfair business practices at their livermore outlet store. christopher sampiro says during his training period. he was instructed by a manager to casually say "d-410" to alert co-workers when a black customer entered the store.

according to the lawsuit. he was fired after just two weeks because he didn't "understand luxury." in court documents. versace denied sampiro's allegations and asked a judge to dismiss the case. a case status conference is scheduled for march. a setback for the san francisco police officers union. it has been trying to stop some changes to the city's use of force policy. a san francisco superior court judge refusing to block implementation of the new police. kron 4's dan kerman is live at police headquarters with more on the changes and what the union doesn't like about them >> reporter: as a result those changes will be implemented. san francisco superior court richard elmer has rejected an attempt by the san francisco police officers association to

close -- california entered its sixth year of drought. but things 'do' continue to improve. >> grant:catherine heenan is here with some of the latest numbers on how we're doing. >> catherine:it continues to be true that northern california is getting lots of drought relief. as for southern california - it's still stuck in historically dry conditions. a look at the bay area over the past year is encouraging. we have the latest numbers -- showing that san jose rainfall was 100 percent of the historic average. san francisco - a healthy 98 percent. and oakland - 80 percent.

but the numbers really drop when you move farther south. los angeles - got 65 percent of the historic average. with the numbers dipping lower and lower. by the time you reach irvine -- it's only 52 percent. as for the latest map from the u.s. drought monitor. the darker the colors -- the drier things are. this shows you where things stand as of this week. parts of central and southern california are still clearly in trouble. while the northern tip of the state is essentilly drought- free.

>> reporter:tonight -- we are looking at new rules for californians that start with the new year. this includes guidelines for gun owners in a state that's already tough on firearms. kron 4's ella sogomonian spells it out. >> reporter:gun sales in california are on the rise. officials say sales of semi- automatic rifles have more than doubled in the state over the last year.

this increase likely due to the new gun control legislation signed by governor jerry brown in july. other features that are soon to be banned have also spiked in purchase rate. including rifles with bullet buttons for the quick swap of ammunition magazines. an estimated one-million- firearms were purchased in california as of december 9th. compared to just over 700- thousand sold in all of last year. ap-ca--california gun sales up california gun sales up ahead of new gun control limits here's a quick look at other new state laws that are set to kick in january first.

starting next week. your phone must be mounted on your dash, the center console or in one of the lower corners of the windshield. it cannot be anywhere that would block your view or your airbags. you must use hand free technology, such as voice command or bluetooth. if you have to touch a screen,

the new law only allows for a single swipe or tap of the driver's finger. only drivers 18 or older can use hands-free devices in the car. police can pull drivers over for breaking any of these new rules. the base fine for a first violation is 20 or 50 dollars depending on the violation. another new law going into effect in the new year impacts the ways young children must be buckled in the car. this law was passed by legislature back in 20-15 and will take effect the first of the year. children under the age of 2 will have to ride in a rear-facing car seat. the only way a child is exempt is if they weigh 40 pounds or more.or if they are taller than 40 inches. the law will still require children under the age of 8 to be properly restrained in a child safety seat in the back seat of the car. another new law starting next year. sexual assault on an unconcious or severely intoxicated person will now become a crime without

security guards and police have really had their hands full. this began last night - and it appears these brawls were loosely organized on social media. this is just one of many wild scenes.a mall in new jersey. the yelling and fighting turned to panic when people mistakenly thought they'd heard gunshots.

the hunt is on tonight in oakland - after a deadly shooting. police say it happened this afternoon near the intersection of 88th avenue and macarthur boulevard. we know one man is dead. his name has not yet been released. there's no word yet on whether the gunman has been arrested.or a possible motive. a kron 4 crew spotted a heavy police response and lots of evidence markers on the ground. the shooting happened just down the street from castlemont high school the man who took a baseball bat to his mothers head.fatally striking her on christmas morning.has been arrested by santa clara county sheriff's deputies. you're looking at the booking photo of 39-year-old matthew salewske. authorities report he is now in custody. on sunday deputies were called out to a domestic disturbance

in gilroy. when they arrived.they found salewske's 70-year old mother suffering with significant head trauma. she later died. reports say her son has been booked on suspicion of murder. the investigation into the death is still ongoing. things are back to normal at the crossroads shopping center, less than a full day after shots were fired in this parking lot. sot- "this area here -- unusually its supposed to be safe." that is until around 9-15 monday night. witnesses tell pleasant hill police investigators several shots were fired outside this starbucks coffee shop. fortunately, no injuries were reported. sot- "doesn't seem like anything ever happens." police say shootings in this area, let alone pleasant hill are uncommon. sot- "this is a common meeting spot. starbucks all around contra costa county." those who frequent the area for coffee or to do their holiday shopping, say this case should
