breaking overnight... a man is shot and killed in san jose and the gunman is on the run this morning. we have a map of where it happened just before 10:00 last night. officers responded to reports of a man shot in tihe 1900 block of tully road. the man died at the scene. there is no description of the shooter this morning. we will continue to follow this story on kron four morning news. our top story this morning. president donald trump finally names his supreme court justice nominee. judge neil gorsuch has been nominated for the seat, which was held by justice antonin scalia, who died last year. president trump made the announcement last night at the

happening today. the widow of the man who carried out a deadly terrorist attack on a florida nightclub will appear in an oakland court. lawyers for noor salman are fighting for her release from jail.. they say salman had no knowledge of her husband's plan for the shooting. her husband omar mateen is resposnible for the pulse night club attack in orlando back in june. 49-people were killed and another 53- others were wounded. salman, who lives in the east bay with her family, was arrested last month. also happening today. several protests expected in the east bay... this as polarizing breitbart news editor milo yiannopoulos is set to speak at u-c berekely. it is the last scheduled stop on his tour and it is being sponsored by the school's republican club. yiannopoulos's tour has frequently sparked protests, like this one at cal poly last night. that appearance was cancelled over security concerns. cal officials

say while there have been calls for today's event to be halted, but it will be allowed in the name of free speech. happening now. police in the east bay are searching for an inmate, who escaped from custody in hayward. 27-year-old prisoner shawn new escaped while being transported on interstate 880 yesterday. kentucky officers left the santa rita jail and were on their way to s-f-o to catch a flight to the state of kentucky where he is wanted. they were sitting in traffic when new jumped out of the car. he was wearing handcuffs at the time. new was arrested last month in hayward on d-u-i charges. authorities don't know whether the escape was planned or a spur of the moment decision. once captured, new will also face escape charges in california. still ahead on the kron four morning news. many reactions to aborition this

the supreme court nomination could influence decades of decisions... including the right for a woman to have an abortion. kron four's spencer blake spoke with pro- life and pro- choice advocates in the bay area. though i spoke to walk for life volunteer vivian dudroand pro-choice advocate amy everitt each ábefore president trump officially announced the nomination of judge gorsuch, their thoughts on the future didn't hinge much on áwhich candidate he chose.they both have a feeling abortion will be a major topic for the new court."the right of abortion isn't in the constitution, according to the kind of scholars that i think president trump is probably looking at.""during the campaign he said he was going to nominate anti-choice justices who would overturn roe versus wade."but the degree of change we might see is where they differ most. dudro says any reasonable person would agree that even constitutional rights have reasonable limits to them.she thinks, if gorsuch is a

the san bruno mall is safe this morning, after a bomb threat was found to be false. this is video that a kron four viewer sent us. there was a breif evacuation at the tanforan mall last night around 6:00. mall security says it got a report of a bomb placed somewhere inside the mall. after investigating san bruno police and the san mateo county sheriff's bomb squad found there is no threat. oakland raiders fans in high spirits this morning... the team 650 million dollars short in a 1 point 9 million dollar las vegas stadium plan. and now, another big money backer is bowing out. kron 4's jr stone shows us reaction from the city of oakland and fans of the silver and black. sot i mean that's like a glimmer of hope to us.oakland raiders fans feeling pretty good after hearing reports that the team is now 650 billion dollars short in a 1.9 billion dollar las vegas stadium plan.sot maybe the nfl will see that and when they at their next meeting the nfl will say maybe it ain't such a

the man accused of killing morgan hill teenager sierra lamar is back in court today. the 15-year-old girl vanished on her way to school back in 20-12. her body was never found. opening statements wrapped up in a san jose courtroom yesterday in the trail of antolina garcia-torres. he is charged with murdering the teenager. prosecutors say garcia-torres' d-n-a was found on lamar's clothing, and her

hair was found in his car. the defense says the d-n-a was cross-contaminated by sloppy handling and lacks blood or other evidence. legal analysts say the trial will come down to how the evidence is presented. the jury is set to hear from as many as 100 witnesses in a trial that could take months. sierra lamar's mother is expected to be one of the first witnesses called by the prosecution. the city of san francisco is suing president trump . san francisco's city attorney filed a federal lawsuit against the president yesterday. it takes aim at the executive order he signed on january 25th... which withholds federal money to cities that fail to comply with federal law. city attorney dennis herrera says the order is unconstitutional. he says it is an

however, the panel is expected to approve his nomination and advance him for a vote in the full senate. in the east bay... a man is in jail this morning for allgedly having mail belonging to at least 30 other people and stealing someone's identity. police reported to a suspicious car in the 2000 block of eucalyptus way in antioch around 8:00 in the morning yesterday. they saw this man, josesph malfitano in that car. he matched the descrption of a mail theft suspect they were looking for. they found several different mail items in his car that belong to others. he was also in possesion of an altered driver's license with a victim's personal information on it instead of his own. still ahead... nancy pelosi reacts to the president's supreme court justice nominee. we'll show you what she had to say about his choice.

happening now. police in the east bay are searching for an inmate, who escaped from custody in hayward. 27-year-old prisoner shawn new escaped while being transported on interstate 880 yesterday. officers from kentucky left the santa rita jail and were on their way to s-f-o to catch a flight to kentucky where he is wanted for fraud charges. they were sitting in traffic when new jumped out of the car. he was wearing handcuffs at the time. he was arrested last month in hayward on d-u-i charges. authorities don't know whether the escape was planned or a spur of the moment decision. once captured, new will also face escape charges here in california.

happening today... the man accused of killing morgan hill teenager sierra lamar is back in court. the 15-year-old girl vanished on her way to school back in 20-12. her body was never found. opening statements wrapped up in a san jose courtroom yesterday in the trail of antolin garcia-torres. he is charged with murdering the teenager. prosecutors say garcia-torres' d-n-a was found on lamar's clothing, and her hair was found in his car. the defense says the d-n-a was cross-contaminated by sloppy handling and lacks blood or other evidence. legal analysts say the trial will come down to how the evidence is presented. the jury is set to hear from as many as 100 witnesses in a trial that could take months. sierra lamar's mother is expected to be one of the first witnesses called by the prosecution. coming up... there is

a bay area mall is safe this morning, after a bomb threat was found to be false. this is video that a kron four viewer sent us. there was a breif evacuation at the tanforan in san bruno mall last night around 6:00. mall security says it got a report of a bomb placed somewhere inside the mall. after investigating san bruno police and the san mateo county sheriff's bomb squad found there was no threat. and across the nation... a series of bomb threats targeting jewish community centers. three waves of bomb threats over the last month.. including the osher marin jewish community center in san rafael two-weeks ago.. have prompted increase security at centers across the nation. dozens of jewish community centers have been targeted since the beginning of the year. this follows a spike in reported hate crimes last year amid a contentious election. together." so far no evidence of any

happening now... bart police are trying to identify this man. he is under investigation for sexual battery. they did not release any other details about the investigation. investigators ask if you recognize this man - to contact bart police. also happening today. the widow of the man who carried out a deadly terrorist attack on a florida nightclub will appear in an oakland court. lawyers for noor salman are fighting for her release from jail.. they say salman had no knowledge of her husband's plan for the shooting. her husband omar mateen is resposnible for the pulse night club attack in orlando back in june. 49-people were killed and another 53- others were injured. salman, who lives in the east bay with her family, was arrested last month. covering california... record high enrollment numbers at california state universities... could mean a tuition hike for all of its 23-campuses. in march... university leaders are voting on whether to impose the change. it would be the first tuition hike in six-

years for the nation's largest public university system. the proposed annual hike would increase the current undergrad tuition by 270- dollars for the 20-17-20-18 school year. the c-s-u's vice chancellor says record high enrollment numbers and insufficient state funding could leave no other option but to raise tuition. just last week the u-c system also raised their tuition for the next school year. one person is dead and three others are injured in a stabbing and police shooting in hollywood. authorities say a man stabbed someone near a liquor store before going into a "jack in the box" on sunset boulevard yesterday. this is cell phone video from inside that "jack in the box" after police shot and killed the attacker. witnesses say they saw him swinging a knife at people inside. then at least one officer shot at the man. three people are at the hospital this morning with stab wounds. there is now update on their

condition this morning. three robbers led los angeles county police on a high-speed chase with a baby in the car. the chase began in the santa clarita area yesterday. the car went up to 90 miles per hour. at one point the robbers were throwing objects out the window. the chase ended on a dirt road when the car crashed into a gate in palmdale. after a few minutes the robbers surrendered.... the driver exited the car with a baby wrapped in a blanket. deputies took custody of the child and arrested the three people. happening now... a hummingbird's nest is slowing down upgrades on the richmond- san rafael bridge. preliminary steps to the $70-million-dollar project are ready, but hummingbirds are a protected species under the migratory bird treaty act. the nest currently has an egg inside. officials say the discovery could set the
