our top story this morning... evacuation orders have been lifted for thousands of people who were forced out of their homes in san jose because of massive flooding. although the floodwater is receding, many people still can't go home because of the toxic and muddy mess that was left over. kron4's lydia pantazes spoke to some of the people who live in the one of the hardest hit areas. nats... crews busy pressure washing streets in the rockspring neighborhood.... as crews clean... people who live here were allowed to go into their homes for the first time. "we went to get in to get our stuff, they're allowing that." long nguyen and his family only took out essential items... no one who lives here is allowed to stay overnight. "i'm just trying to go inside and grab as much as i can right now because i don't know when they're going to let us go back in and grab the rest of our belongings." "i wish they would let us know more, like a timetable when or

how long we have to wait or what are the steps being taken, they're not letting us know too much about what's going on." some of the people who went back in took precautions... wearing bags over their shoes to avoid contamination or surgical masks.. "we just want to protect ourselves for our health and everything." "and you think? it's just rain but that rain water goes across roadways and picks up water and oil and gasoline and all of that." add in the cars that were also under water... adding even more fluids in the water. "it may have gone into homes where it picks up chemicals, kitchen detergents and insecticides and then the dumpsters were floating and they're floating with water and anything in the dumpster can come out." which is why people can't come back until these streets... are clean.

for those people who were able to return to their homes found water and mud everywhere. water got into just about every inch of this home on william street. the owners say, they have lived here for decades. their basement was completely submerged. and they say will be months before they can put this flood behind them. i've been in this house since 1977 raised two children here, lots of memories, lots of family coming in. lost lots of personal momentums down in the basement. very sad. can't be replaced. crews are expected to be out on williams street for at

least the next week. all week we've been checking in around neighborhoods in coyote creek. kron 4's charles clifford returned to a flooded spot he first showed us a few days ago -- to see what has changed. natsjust be careful when you step down here. there's a lot of debris.thursday afternoon, bryan rodriguez showed kron 4 the flood damage to his home here along 16th street in san jose. this is what the house looked like on tuesday when coyote creek flooded the backyard and the downstairs of their househe's still trying to wrap his head around it all sotyou just don't expect to see a lake in your back yard. especially when coyote creek is a stagnant pool for 6 or seven months.and this is what it looks like now . at first glance, the most obvious problem is mud.sotmud everywhere. . mud!when the house finally drained, they found muddy floors, water damage to the walls, and ruined furniture. there's also a clear line showing just how high the water reached.sotand all of this was stagninat water and this will all need to be decontaminated.brain says that they have flood insurance and should be able to fix the damage. he does however have a lot of question for the people who manage the water flow upstream from his home and the homes of his neighbors who also were flooded out.sotit's unimaginable that someone wasn't watching the situation better. i don't know if it was the city or the water district or both with mother nature thrown in, which you can't control . there needs to be some lessons learned for

horses that were left behind during the evacuations. officials say 250 people who lived near coyote creek were evacuated from their homes. but fire crews deemed it unsafe to evacuate the horses at the same time. the horses were in chest deep waters. during this time, many animal lovers and horse owners were going against the orders of the fire crews, and used kayaks to check on the horses and give them fresh food and water. all the horses have now been transported to higher ground in the same area. officials say there were a total of 26 horses and two mules left behind. the logic behind moving them from where they are is if it gets bad again we don't want the horses to be trapped. so my understanding is they want to get all the animals out of there. some of the rescued horses have gone to police stables while other ones have been taken to other stables. rescue crews say all the horses are doing fine. they expect to have all the horses out of the area by today.

many people who were evacuated from their homes were not allowed to bring their pets along with them to the evacuation centers. however, volunteers from the san jose animal service decided to step in and house about 12 -animals in all. 10 dogs and two cats. most of the pets are from people who are still at the evacuation centers. volunteers say, they do not expect to get anymore people bringing in their pets. but if they do, they say they will gladly take them in. if you have a pet that needs to be housed, you can go to the san jose animal center located at 27-50 monterey road, just off umbarger road. if you want to help any of the people affected by the massive flooding log onto kron4 dot com... there we have links where you can donate to the red cross and to the flood victims relief fund. and make sure you have the kron-4 mobile app to stay up to date with the crisis in san jose. again all the links and infornation are on kron4 dot com.

a big story we are following this morning... a female body found along alameda creek may be that of 18-year-old jayda jenkins. jenkins went missing after her car crashed into the water off of niles canyon road january 21. the body has not yet been identified, but deputies have notified jenkins' family of the discovery. the body was found just after 5:30 when a man who was walking his dogs along the creek found it close to coyote hills in the ardenwood area. officials say the body appears to have been in the water and exposed to the elements "for some time." we'll bring you updates to this story all morning long. coming up.. police have arrested a man in connection with the death of a c-h-p officer. what someone who witnessed the accident that killed the officer had to say. and... president trump's chief strategist steve bannon made a rare public apperance. the tension between the president and his top aides. also..

folowing... police have made an arrest in connection to the death of c-h-p officer lucas chellew. chellew died wednesday night after being injured in a crash while chasing a suspect in south sacramento. the officer was on his motorcycle at the time. and now, police say a 26- year-old alberto quiroz from sacramento was arrested for vehicle theft, evading an officer, and resistaing arrest. one young man saw the accident play out. witness: "he lost control and crashed into a pole then laid face down on the ground." chellew comes from a law enforcement family. his dad is a retired c-h-p captain. his sister is a c-h-p officer. and his wife's father works for the marin county sheriff's department. he's being remembered as a dedicated officer who was liked by everyone. the police chief of

anaheim, is reacting to video of an off-duty l-a-p-d officer firing a weapon during a struggle with a 13-year-old boy. this is a story we first told you about yesterday on the kron4 morning news. reporter, chip yost, has the reaction from city officials. anaheim officials pressed for calm after a night of raucous protests that followed an incident in which an off-duty policeman scuffled in his front yard with a boy, drew a weapon and fired a shot into the ground. the shot came after another teen pushed the officer over a hedge and others surrounded him. mayor tom tait said thursday he was "deeply disturbed" and angered by what he saw on video of the incident, but he also denounced violence and damage caused by demonstrators.

101 another big story we're following this morning.. the santa cruz police department and santa cruz city officials say they feel "deceived" and "outraged" by the department of homeland security. according to the santa cruz police chief, they were misled by ice officials about a gang raid last week. the chief says the feds asked for and received help from santa cruz police in that raid. but the chief also says the feds told him the operation was to dismantle the local presence of a big el salvador- based gang. and not to arrest or detain the gang members based on their

immigration status. the deparment of homeland security unbenounced to us at the homeland security department had acted outside the scope of this operation and had detained and removed a number of individuals from the location based upon their immigration status. this has violated the trust of our community and we can not tell you how disapointed we are by the betrayal of the department of homeland security. santa cruz is a sanctuary city. the chief says the department is revising their policy on immigration actions and will present that policy to the city council on tuesday. in the east bay... serious questions are being raised about the oakland police department and how a deadly situation could have been avoided. last week, police were called to east oakland by neighbors who reported a man firing a rifle in the neighborhood. now, a victim has come forward saying, the gunman should have been arrested sooner. kron 4's dan keramn has the details on what happened... it was last friday the 17th

some tense moments in san leandro after a hand grenade was found at a waste collection site. this is a picture of it on one of the conveyer belts. a team of experts were brought in and determined the grenade was no longer active, and posed no danger. everyone inside of the building was ordered to evacuate as a precaution. officials are warning anyone who may find a grenade not to handle it, find a safe place, and call police. a candellight vigil was held for the man who was shot and killed in san francisco while playing 'pokemon go' last year. friends and family gathered in san mateo to mark the six- month anniversary of calvin riley's death. saying his life was taken too soon. the vigil was held last night at central park. riley was killed in august while playing the popular game near ghiradelli

city pumping out water and trying to sanatize effected areas. officials are allowing people to return to their homes and pick up whatever belongings are salvageable. county officials say some people may be facing as much as 10 thousand dollars or more in flood damage to their homes. and.. police have arrested a suspect in connection to the death of a sacramento area c-h-p. police say 26 year old alberto quiroz has been arrested for mulitple felonys. investigators believe the quiroz was riding a motorcycle that officer lucas chellew was pursuing at the time of the deadly crash. also.. back in action for the 1st time since the all-star break, the dubs did what they do best, beat the l-a clippers. it didn't look good for golden state early on in this one. going into the half down by 12. but thanks to a 50 point explosion in the 3rd, the dubs were able to pull away and win this one. steph curry led the team with 35 points in this one. final score 123-113 dubs.

we now go in-depth on pot smoking speakeasies. since early november, it has been perfectly legal for an adult over age 21 in california to smoke marijuana even without a medical condition. however,there is a state of legal limbo. that's because it is still against the law to buy pot without a 'medical' marijuana i-d card. that will change in 2018. but as kron4's maureen kelly found, one bay area city has a number of undergound clubs where it's already happening. i know of many 6 downtown right now there are maybe more that i don't know about but

across town, the chair of oakland's cannabis regulatory commission says in all there are roughly 10 pot smoking speakeasies operatating in this city right now. and that number is a moving target. residents could walk on by one of these joints.and have no idea that weed was being sold and consumed.that's because for most of these illicit enterprises, weed is secondary to what's happenign there.cut 3:28 people have a dream i want to sell coffee i want to sell clothing i want to do all these things and they can't afford to pay the rent just by doing that so they have this secondary thing where's the private club in the back in the closet you name it.they are called measure z clubs.named after the 2004 oakland ordinance that made arrests for private adult use of marijuana law enforcement's lowest priority. 03:49 as long as it's not a problem for somebody we are going to allow it to happenbut the existance of these clubs is not something the city of oakland is exactly happy aboutand they haven't completely ignored them.this 2014 report from the city's administrator points out the city attorney has clarified that commercial settings are not sheilded by measure z.at least five of these so called clubs were closed by police that year.where tens of thousands of dollars in cash, substantial amounts of weed and in some cases other drugs and guns were discovered.43 other possible unlawful cannabis dispensaries were identified between 2005 and 2014. by nuisance abatement division, sent cease and desist letters and or cited. hummel thinks these clubs are a good thing but he thinks the acts of communal smoking normalizes something that was stigmatized for decades. and gives some people a place to smoke without bothering others. 4:38 our smoking ordinance makes it really difficult for a private residence to imbibe cannabis, so if you are in an apartment if you are public housing you really have no legal place to do itstandupi approached several different oakland cannabis industry insiders to see if they help me get inside one of these z clubs and each time i was

the white house has now suggested that the trump administration may crackdown on states like california that have legalized marijuana use. press secretary sean spicer says the issue rests with the justice department. but he does believe that there will be a "greater enforcement" of federal laws against medical use. the justice department has several options if they do decide to crack down. one would be filing lawsuits claiming state pot laws are unconstitutional. president trump had said on the campaign trail that he does support "medical" marijuana.

dropped from 14-thousand to around 4 thousand. and this morning kron 4's will tran i s live in the rock springs neighborhood with a look at the cleanup efforts. despite the floodwater receding, many people still can't return home permanently because of the toxic mess left behind. crews are pressure washing streets in the rock springs neighborhood. you can see many of these homes and cars have a red "x" on them, meaning they have been searched by state inspectors. people who live there were allowed to go into their homes for the first time since the flooding. families could only take out essential items since they are not allowed to stay there overnight.

in just a few hours governor jerry brown is set to hold a news conference to to talk about future flood prevention. he is expected to announce a new plan to improve dam safety and fix the state's water infrastructure. this morning's news conference is set for 11:00. and with all of the flooding in san jose it was not just people who had to be evacuated. james fletcher is here with that side of the story. the san jose fire department is evacuating the horses that were left behind during the evacuations. officials say 250 people who lived near coyote creek were evacuated from their homes. but fire crews said it unsafe to evacuate the horses at the same time. the horses were in chest deep waters by the time the flooding was at its worst.

began his career in the late 70s as a police cadet with the concord police department. there he climbed the ranks for almost 30 years- finally retiring in 2007 as a master police officer.sgt. ray kelly, alameda county sheriff's office " "but he wasn't ready to call it quits.after he retired foley came back to work this time with the alameda county sheriffs office at the santa rita jail.it was here behind the jail he was unfortunately struck by an inmate bus wednedsay morning around 6. the scene captured by our helicopter partnership with abc7 news.deputy foley later died of his injuries. "" sgt. kelly with the sheriffs office says it was a tragic accident.that the man behind the bus that carries up to 50 inmates and weighs several tons - is now devastated knowing he had something to do with the death of a friend. he and one other deputy were the only two inside.sgt. kelly says it was dark and the weather may have been to blame. happening now... serious questions are being raised against the oakland police department on how they handled a deadly police shooting. last week, police were in east oakland after a man started firing a rifle in the neighborhood. this is video from the scene courtesy our helicopter partnership with a-b-c-7. eventually he was shot and killed by police following a stand off. people are now coming forward saying that the same man opened fire in the neighborhood two times earlier in the week. a homeless man who sleeps in his car in the that neighborhood says that same man shot at his car earlier in the month. he then went to police, but says they did nothing to arrest the shooter. it the attorney

a candle light vigil was held for the man who was shot and killed in san francisco while playing 'pokemon go'. friends and family gathered in san mateo to mark the six- month anniversary of calvin riley's death. the vigil was held last night at central park. riley was killed in august while playing the popular game near ghiradelli square. police have ánotá yet identified a gunman in the shooting. two washington d-c police officers are in the hospital this morning after being shot. the shooting happened late last night. police have not released many details but they did say that both officers were conscious and breathing when they were taken to the hospital. the gunman was shot and killed by police. so far police have not said what led up to the shooting. the white house has announced plans to begin enforcing federal marijuana laws. the new policy could cause a conflict between the federal government and the states like california... that have voted to legalize pot. reid binion has the details. angel" / pot dispensary worker: "when did this happen? i was like super shocked."a

in the east bay... the 20- year-old student... accused of stabbing a berkeley school principal... has now been charged with attempted murder. we first told you about this story on tuesday. angel juarez is being held without bail accused of attacking the principal at a private special education school called via center. that's located on sixth street in berkeley.... officials say the victim was treated for non-life-threatening stab wounds and has been released from the hospital. juarez was arraigned yesterday on attempted murder charges

and assault with a deadly weapon. the police chief of anaheim, is reacting to video of an off-duty l-a-p-d officer firing a weapon during a struggle with a 13-year-old boy. this is a story we first told you about yesterday on the kron4 morning news. chip yost has the reaction from city officials. anaheim officials pressed for calm after a night of raucous protests that followed an incident in which an off-duty policeman scuffled in his front yard with a boy, drew a weapon and fired a shot into the ground. the shot came after another teen pushed the officer over a hedge and others surrounded him. mayor tom tait said thursday he was "deeply disturbed" and angered by what he saw on video of the incident, but he also denounced violence and damage caused by demonstrators.

water got into just about every inch of this home on william street. the owners say, they have lived here for decades. their basement was completely submerged. and they say it will be months before they can put this flood behind them. replaced. crews are expected to be out on williams street for at least the next week. in just a few hours governor jerry brown is set to hold a news conference to to talk about future flood prevention. he is expected to announce a new plan to improve dam safety and fix the state's water infrastructure. this morning's news

conference is set for 11:00. and with all of the flooding in san jose it was not just people who had to be evacuated. james fletcher is here with that side of the story. the san jose fire department is evacuating the horses that were left behind during the evacuations. officials say 250 people who lived near coyote creek were evacuated from their homes. but fire crews deemed it unsafe to evacuate the horses at the same time. the horses were in chest deep waters by the time the flooding was at its worst.. during that time, many horse owners were going against the orders of the fire crews, and used kayaks to check on the horses and give them fresh food and water. all the horses have now been

here's a quick look at the top stories we're following this morning... most of the evacuation orders in san jose have been lifted and the flood waters are still receding... leaving behind a muddy mess. the number of mandatory evacuations has dropped from 14-thousand to around 4 thousand. the alameda county sheriff's department is mourning one of its own.... deputy mike foley has died after being hit by an jail transport bus while on the job at the santa rita jail. the only people in the bus at the time were two deputies, one driving and the other in the passenger seat. the sheriff's office released a statement describing foley as one of the hardest working deputies in the agency. a woman's body is found along alamdea creek and police believe it may belong to 18-year-old jayda jenkins. jenkins went missing after her car crashed into the water off of niles canyon road january 21. the body has not yet been identified, but deputies have notified jenkins' family of the discovery.

about this story on tuesday. angel juarez is being held without bail accused of attacking the principal at a private special education school called via center. that's located on sixth street in berkeley.... officials say the victim was treated for non-life-threatening stab wounds and has been released from the hospital. juarez was arraigned yesterday on attempted murder charges and assault with a weapon. more details are being released in the killing of kim jong nam, the half brother of north korea's leader. police in malaysia say he was killed in an airport after two women put a nerve agent on his face.. those two women along with two other suspects are now in custody. the women claim they thought they were participating in a reality tv show and the liquid they used wasn't harmful. however, police say security cameras show them washing their hands immediately after the attack, indicating they knew it was toxic. the police chief of anaheim, is reacting to video of an off-duty l-a-p-d officer

firing a weapon during a struggle with a 13-year-old boy. this is a story we first told you about yesterday on the kron4 morning news. chip yost has the reaction from city officials. anaheim officials pressed for calm after a night of raucous protests that followed an incident in which an off-duty policeman scuffled in his front yard with a boy, drew a weapon and fired a shot into the ground. the shot came after another teen pushed the officer over a hedge and others surrounded him. mayor tom tait said thursday he was "deeply disturbed" and angered by what he saw on video of the incident, but he also denounced violence and damage caused by demonstrators.
