( james ) breaking news we are following out of san francisco. a man was shot outside a night club on 19th street between mission and capp street around one this morning. the victim was taken to the hospital. we don't have a condition on the man. right now police are still on the scene. police say the gunman has not been caught. ( james ) breaking overnight... one person is in the hospital this morning after an officer involved shooting in antioch. this is video of the scene. it happened around 10:15 last night. police say they were responding to a call when shots were fired. the gunman then fled the scene and a long pursuit ended at

mammoth way and wawona court. it is unclear at this time if the person who was transported to the hospital is the gunman or an officer. kron 4's averi harper is on her way to the scene and will have details within the hour. ( james @ bam ) a big story we are following this morning... one person was taken to the hospital after he was shot on highway 101 in san jose. police now say that person, was a 17 years old boy. this is video of the scene. officers say they are looking for two hispanic men who were wearing bandanas and driving a white charger. the shooting around 6:45 last night near the story road exit. police say these types of shootings are a serious safety risk to the public.

( james @ bam ) the shooting in san jose comes exactly one week after a shooting on interstate 80 in richmond. and now, friends and family gathered to honor 24-year-old demarcus doss. family and friends say, he died protecting his friend in the passenger seat who survived. kron4's ella sogominan was in richmond where a vigil was held for him. pastor kellis love works with ceasefire an organization to end gun violence in the bay area.he now mourns the loss of his own son who was shot several times on interstate 80 in richmond last thursday. pastor kellis love, step father "it's a feeling that i've never felt before. and i'm trying to use this feeling to really reflect on the issues that need to be addressed because i don't want no body to feel the way i'm feeling

right now."1 week to the date friends and family gathered near the scene at san pablo and barrett in rememberance of demarcus doss.the 24-year old aspired to be a correctional officer. he is described by family to have been a hero down to the last moments of his short lived life.shanyla robinson, sister"he was a man. you can't say that about a lot of 24-year-olds, sadly to say. but demarcus was a man he went out like a champ."his sister says demarcus died protecting his friend who was in the passenger seat during the shootinghis friend survived her injuries.demarcus was able to hold on long enough to say goodbye."he fought them

bullets he was still breathing with a bullet in his head he fought them. and he waited until i got there."24-year-old elliot johnson of richmond was charged along with two 17 year olds who are not named because they are minors. officers are looking into whether the suspects have gang ties and if they targeted the victims. kellis love jr., brother"i'm glad that justice has been served maybe when another person is thinking about committing a crime or killing someone they'll think twice now. maybe demarcus is going to save much more than just one life." s( james ) and happening today... the chp is expected to provide an update on the investigation into the shooting. police have previously said there have been about 80 shootings on bay area freeways in the last 15 months. ( james ) also in the east bay... police say the man wanted for ramming his car into two fremont police detectives in hayward, was arrested last night in san francisco. and we now know the 16-year- old who was killed in the incident, was two months pregnant. the shooting happened tuesday near cal-state east bay. hayward police say , two fremont police detectives spotted a stolen car parked in an apartment complex.

investigators say, that stolen car was wanted in connection with several armed robberies recently reported in fremont and other bay area cities. officers say, the driver, whose name has not been released, backed up into the undercover police car and fremont detectives started shooting. 16-year- old elena mondragon, was hit by the gunfire and later died. her uncle says it's possible the man arrested may be the father of her baby.

( james ) another big story we are following this morning... president trump plans to increase funding for defense and homeland security. while reducing funds for several government agencies. all of this outlined in his new budget proposal. the proposal was released yesterday. in his one- point- one trillion dollar budget blueprint, defense spending would go up by an additional 54- billion dollars. and, to offset that, major cuts are being proposed to the e-p-a, departments of state, agriculture, and labor, among others. ( james ) members of the president's cabinet praised the budget outline. this despite deep cuts to their own departments. house minority leader nancy pelosi says she cannot see how the budget will survive. house speaker paul ryan did stress that at

this point, it is just a proposal. ( james ) president trump also breaking his silence on his claim that his predecessor wiretapped trump tower. seeming to redefine what he meant. members of the house and senate intelligence committees are still waiting on information from the f-b-i. they've seen no evidence of wiretapping. but have yet to rule out surveillance altogether. the white house is insisting that congress has not finished its work into investigating the claims made by president trump. press secretary sean spicer also left open the possibility that the president was caught up in surveillance. and ripped news outlets claiming journalists have pushed a false narrative on ties between the trump camaign and russia. ( james ) a big story we are following this morning... attorney matthew muller has been sentenced to 40 years in prison for a violent kidnapping for ransom in vallejo. a kidnapping that was initially dismissed as a hoax by police. kron four's dan kerman has the latest on the story. it was in march of 2015 that matthew muller broke into the mare island home of aaron quinn, drugged and tied up quinn and then kidnapped his girlfriend denise huskins , raping her twice before releasing her days later. during a sentencing hearing thursday huskins gave a tearful accounting of her ordeal to a federal judge saying she still has nightmares and keeps a hammer by the bed.sot marianne quinn/aaron quinn's mother 26-37i didn't know it was that awful for her, i didn't know of the violence , i didn't know she didn't talk about it much it upsets her to talk about stuff too much.huskins

boyfriend aaron quinn told the judge, muller had chosen a path of torture rape and terror and should be sentenced to life in prison. but muller's attorney argued his suffers from mental illness and the sentence should be 30 years. ultimately a federal judge followed the recommendation of prosecutors and sentenced muller to 40 years in federal prison for what he called a heinous atrocious, horrible crime. sot quinns motheri know aaron and denise wanted a life sentence but 40 years plus 5 years probation means he will be in his mid 80's but i would feel better if aaron and denise never had to worry about him being out on the streets even when he's 85 standup dan kerman/sacramento 126-136while the federal case is over, the civil case is still ahead. huskins and quinn suing the city of vallejo for at one point

saying huskins made the whole thing up and saying she owed the city of vallejo an apology. at the federal courthouse in kerman kron 4 news.142/std ( james ) a film production teacher from san francisco has been arrested on charges of child pornography .. 71- year old john morrison was arrested at his home on monday after investigators reportedly found more than 6- hundred videos and images of child porn. morrison is being charged with one- count of possession and three- counts of distribution of child porn. morrison was released from custody after posting bail. he is expected to be in court on today. ( james ) the owner of a business that police say was posing as a dental lab... has been arrested. investigators say a raid uncovered narcotics and equipment used to make meth- amphetamines. the investigation started three months ago after police received a tip. police say there are two different investigations going on... one for the narcotics that were found, and another for the dental equipment found. joseph hirsch was arrested and police say he is suspected of providing dental treatment to patients without a license. he has also been charged with possession of a controlled substance. ( james ) in the north bay... police in napa arrested a man they say posed as a salesman and then attacked a victim at her home. on monday, police say they got a call from a woman who says she was assaulted at her home. police say lester ivy is the man who assaulted her. ivy was reportedly going around the neighborhood selling magazines

when he encourtered the woman at her pine street home in napa. responding officers found ivy and arrested him. police are now looking into ivys background and encouraging people to call if they had contact with him. they are also issuing a warning. if you do not recognize someone at your door, do not answer it. ( james ) family members of a napa man who was shot and killed by police are now speaking out about the incident. the napa police department says on monday night 23-year-old noel russell was carrying a knife and threatening people when two officers shot and killed him. kron 4's charles clifford visited with russell's family who say they don't think he deserved to die. pacific union college in napa county.sotsotthe napa police department says that on monday evening two officers responded to reports that russell was acting strangely near a home depot. he was also allegedly threatening motorists and people on foot with a knife. shortly after making contact with russell, both officers fired the service weapons at him. he died a short time later. this is video of the scene from our helicopter partnership with abc 7. the two officers involved in the shooting have been placed on paid administrative leave and the napa county sheriff's department is conducting an investigation into the incident.noels' family is stunned by the news and they want to know why the officers , who were armed with handguns, felt it necessary to kill a young man carrying a knife.sot< samuel champion says there's no use of a taser. there's no use of different ways to detain him.> the napa police department also said this week that the russell was wanted on two warrants for drug possession

( james ) as concerns grow among undocumented immigrants about a president trump's immigration crackdown, one immigrant rights organization in san jose says, it has been swamped with calls for help. and now they are responding by making sure families know their rights. and are prepared in case ice comes to their door. kron4's lydia pantazes shows us how the program works. "we need to be educated about our rights."it's a lesson that for many in this group could mean the difference between being with their family.... "imagine your at the door and you hear a loud knock at the door and you see ice officers outside."and being deported... "they don't realize that they're not just targeting criminals, they're targeting innocent families."this woman... who did not want to be identified... is part of what's known as a mixed status

family.her and her children are us citizens but her husband is undocumented."you actually drove two hours to get here, yes but this is important to me, i actually requested the time off of work because i work but this is more important right now." she's taking part in a know your rights workshop at siren... the services, immigrant rights, and education network in san jose. "we remind folks not to answer their door if ice is knocking at their door, to ask for a warrant and if they do have one, to slide it under their door."but in the past few months the workshops have grown to include family preparedness plans.for example worksheets like these that families fill out together to prepare in cause they are separated... ( james ) now to the dubs... the warriors looking to start a new win streak were taking the magic from oracle arena. and steph curry and golden state put this game early, but it did come with some drama. in the opening minutes, steph tweaked his right ankle when he stepped on evan fornier's heel. he had to head to the locker room but was able to return to the game minutes later. and guard klay thompson was on fire in this one. he scored 21 out of his 29 points in the first quarter alone. he would add 4 rebounds and 5 assist on the night as well. the warriors bench also came to life. scoring 47 points in this one. the final score, warriors blow out orlando 122-92. a nearly 7.5 carat diamond at a state park in arkansas. officials at crater of diamonds state park say the rock found saturday by a 14-year-old boy. is the seventh largest found since the park was established in 1972. the diamond is the size of a pinto-bean and similar in color to coffee. now finding a diamond at the state park isn't uncommon. the crater of diamonds state park does let people search for the gems. and you get to keep whatever you find. his sister says he died protecting his friend who was in the passenger seat during the shooting. she survived her injuries. doss's step- father is a pastor and works with "ceasefire," which is an organization to end gun violence in the bay area. ( mark ) 24-year-old elliot johnson of richmond was charged along with two 17-year-olds who are not named because they are minors. family members say doss aspired to be a correctional officer. ( darya ) new details in the deadly police shooting in hayward earlier this week. we now know that the 16-year-old girl who was killed was two months pregnant. the shooting happened tuesday night near cal state east bay. hayward police

say two fremont police detectives spotted a stolen car parked in an apartment complex. investigators say the stolen car was wanted in connection with several armed robberies recently reported in fremont and other bay area cities. officers say the driver backed up into the undercover police car and fremont detectives started shooting. the man who rammed is car into the officers has been arrested. 16-year-old elena mondragon, from antioch, was hit by the gunfire and later died. her uncle says it's possible the man arrested may be the father of the unborn child. ( mark ) the man convicted of kidnapping a vallejo woman, raping her and holding her for ransom has been sentenced to 40 years in prison. back inin march of 2015... mathew muller broke into the home of aaron quinn and kidnapped his girlfriend denise huskins. during a sentencing hearing yesterday huskins gave a tearful account of the events to a federal judge saying she

still has nightmares and keeps a hammer by the bed. muller's attorney argued for a 30 year sentence saying that muller suffers from mental illness. the judge eventually decided on 40 years. huskins is now suing the city of vallejo because at one point police said huskins made the story up and and said she owed the city of vallejo an apology. ( darya ) a high school student in fremont has a confirmed case of tuberculosis. the student attends irvington high school in fremont. officials say the exposure happened sometime between fall of 2016 and early 2017. they say there is no risk of additional exposure at this point. an alert was sent to parents saying the alameda county health department is working to identify people who may have come in contact with the infected person. people can become infected by spending a lot of time in close contact with someone who has an active case of t-b. ( mark ) happening now... a family in vallejo is searching for their father who

has been missing for weeks. 48-year-old james stepps was on his way to see his grandaughter late last month, but never made it. after calling local hospitals, jails and even the coroner's office, his wife called a tow yard. that is where she found his "mitsubishi eclipse." it was abandoned on rollingwood road, just blocks away from his daughter's house where he was headed. family members say it is unlike him to just disappear. ( mark ) police say there are suspicious circumstances surrounding the location of the car, and the condition it was in when it was discovered. police are not releasing much information because they say it will compromise their investigation. of a napa man who was shot and killed by police are now speaking out about the incident. the napa police department says that on monday evening two officers responded to reports that 23-year-old noel russell was threatening people with a knife near home depot. shortly after making contact with russell, both officers opened fire. he died a short time later. russell's family says they want to know why the officers felt it was necessary to kill a young man carrying a knife. ( darya ) police say two warrants were out for russell's arrest for drug possession and assaulting a peace officer. the two officers involved in the shooting have been placed on paid administrative leave. ambulance.. 44-year old yadira arroyo stopped her ambulance after someone jumped on the back of it.. when she and one other e-m-t got out to check it out... the man who was on the back of the ambulance..got in ...and then drove off hitting both of them. arroyo was killed. officials say she was a 14-year veteran and leaves behind five children. the other e-m-t was taken to a hospital and is expected to survive. ( darya ) police have identified the man they believe was involved in a homicide in pittsburg earlier this month. police are looking for this man... giovante boyd. they say he is connected to a deadly drive-by shooting that happened back on march 5th. police say robert moffett was found dead in his driveway on carpino avenue. another man was also injured in the shooting but he is expected to be okay. police say boyd should be considered armed and ( mark ) the owner of a business that police say was posing as a dental lab... has been arrested. investigators say a raid uncovered narcotics and equipment used to make meth- amphetamines. the investigation started three months ago after police

( darya ) president trump has approved a disaster declaration for california ... to fix damage damage from january storms. the action makes federal money available to state and local governments as well as non-profit groups. the money covers emergency work and repair or replacement for damage that happened between january 18th and january 23rd . the disaster declaration covers 16 - counties, including napa, san mateo, santa cruz and yolo. the white house says, other declarations may be made later depending on damage ( mark ) in pleasanton... homeowners along foothill road who have watched chunks of their property fall into the creek belowcan breath a sigh of relief. the alameda

county water agency board...has agreed to help with emergency repairs. government officials say this will jump-start the process of mending the arroyo de la laguna creek. you can see the creek chipping away at the backyards of homes on foothill road. water board officials say repairs could cost between one to one point five million dollars. say two fremont police detectives spotted a stolen car parked in an apartment complex. investigators say the stolen car was wanted in connection with several armed robberies recently reported in fremont and other bay area cities. officers say the driver backed up into the undercover police car and fremont detectives started shooting. the man who rammed is car into the officers has been arrested. 16-year-old elena mondragon, from antioch, was hit by the gunfire and later died. her uncle says it's possible the man arrested may be the father of the unborn child. ( darya ) the man convicted of kidnapping a vallejo woman, raping her and holding her for ransom has been sentenced to 40 years in prison. back in march of 2015... mathew muller, a harvard educated attorney... broke into the home of aaron quinn and kidnapped his girlfriend denise huskins. during a sentencing hearing yesterday huskins gave a tearful account of the events to a federal judge saying she

still has nightmares and keeps a hammer by the bed. muller's attorney argued for a 30 year sentence saying that muller suffers from mental illness. the judge eventually decided on 40 years. huskins is now suing the city of vallejo because at one point police said huskins made the story up and and said she owed the city of vallejo an apology. ( mark ) a high school student in fremont has a confirmed case of tuberculosis. the student attends irvington high school in fremont. officials say the exposure happened sometime between fall of 2016 and early 2017. they say there is no risk of additional exposure at this point. an alert was sent to parents saying the alameda county health department is working to identify people who may have come in contact with the infected person. people can become infected by spending a lot of time in close contact with someone who has an active case of t-b. searching for their father who has been missing for weeks. 48-year-old james stepps was on his way to see his grandaughter late last month, but never made it. after calling local hospitals, jails and even the coroner's office, his wife called a tow yard. that is where she found his "mitsubishi eclipse." it was abandoned on rollingwood road, just blocks away from his daughter's house where he was headed. family members say it is unlike him to just disappear. ( mark ) police say there are suspicious circumstances surrounding the location of the car, and the condition it was in when it was discovered. police are not releasing much information because they say it will compromise their investigation. killed by police are now speaking out about the incident. the napa police department says that on monday evening two officers responded to reports that 23-year-old noel russell was threatening people with a knife near home depot. shortly after making contact with russell, both officers opened fire. he died a short time later. russell's family says they want to know why the officers felt it was necessary to kill a young man carrying a knife. ( darya ) police say two warrants were out for russell's arrest for drug possession and assaulting a peace officer. the two officers involved in the shooting have been placed on paid administrative leave. ( mark ) oakland police say new training helped officers end a standoff in berkeley peacefully. we told you about the standoff yesterday on the kron 4 morning news. police say the man who crashed into a police car before leading them on a chase from oakland to berkeley is a known felon. after the chase ended the man was in a brief standoff with police. officers say they have been using simulation training videos to practice non-use-of-force scenarios. they say the training helped them end wednesday night's standoff peacefully. carolina. these are aerials from the scene yesterday. the fire started late last night, and firefighters were battling the fire into the morning. people living nearby had to be evacuated. fortunately, no one was injured in the fire and there were no signs of anyone trapped in the building. the cause is under investigation. ( darya ) and take a look at this dramatic escape as europe's tallest active volcano erupted. a group of scientists and a b-b-c camera crew were there when mount etna erupted in italy yesterday. ten people were injured, but everyone is expected to be okay. a camera woman there posted this picture of her after the explosion... you can see she has a massive hole where a lump of rock burnt through her coat. another person says she was being pelted by rocks and had to dodge burning boulders and boiling steam.

( mark ) a 22-year-old man is arrested in los angeles after attacking a woman with a hammer. it happened last week in korea-town, but police are just releasing the surveillance video now. a 24-year-old woman was standing in front of a business when the man came up to her and asked if she was korean. she said yes and then he left. seconds later...he came back armed with a hammer and hits her several times in the head. a security guard saw the attack and came to help ( mark ) the attacker was charged with a hate crime.
