ghost ship fire happenedin december -- is facing another lawsuit. the lawsuit was filed last week - by the father of one of the victims. it's just the latest in a string of lawsuits... it claims the building owner was aware of fire hazards -- but did nothing about them. it also claims the building didn't have proper fire prevention equipment - like overhead sprinklers and smoke alarms. (steve)happening now in the east bay, students at albany high school are holding a rally to denounce racism in their school.in the past week, several students at the school were disciplined for making nazi salutes in the hallways and posting racist images on instagram.kron 4's charles clifford is live for us tonight at the high school with details. this afternoon, memebers of the black student union here at albany high held a unity rally to try and end the week on a positive note.in all 7 9th graders were recently

disciplined for making racist gestures and posting racist images online. at least some of those students were allowed to return to school this week and that has many in the student body upset.at tonights, rally students say they wanted to show support for the victims of the recent problems. they also want to send a message that this sort of behavior won't be tolerated on campus. apparently the message may have gotten through to at least one of the kids involved in the racist acdts. a teacher actually read an email she had received from one that students.

(catherine) daly city police are looking for the man they say exposed himself to a 12-year-old girl... he's also accused of doing the same thing to a teenager.. a suspect sketch has now been released.. police say the first incident happened monday night around 6 - near westmoor park...when the man exposed himself to a 19-year-old woman.. they say he did it again wednesday - this time to a 12-year old girl walking home from school on miraposa avenue. sgt ron harrison/daly city police-well what makes this so dangerous is we have an unknown individual exposing to people who are walking, doing their daily activities and life. he's exposed himself to a 12 year old girl and an adult female and we want to locate him and arrest him before these acts continue.

police have released this picture of the suspect's car.. it's believed to be a silver or gold 2003 toyota camry... with a sticker on the driver's side bumper. (steve) a tragic collision between a big rig and a sports car claimed a life this morning in san jose. video from our helicopter partnership with abc7 news shows the scene just before 8 o'clock here at the intersection of park avenue and mcevoy street. kron four's rob fladeboe is atthe scene now with a live report. rob? this area is just west of downtown san jose. park avenue is a fairly busy thoroughfare but there is a lot of construction going on here and there is a lot of truck traffic. the car was traveling eastbound when it

collided with the truck here at the intersection of mcevoy. the late model pontiac firebird, it's roof mostly sheared away on impact, ended up pinnedbeneath the trailer of the big rig truck. the driver of the car was apparently killed on impact but a passenger in the car, a 10-year-old girl, was trapped for a time and had to be rescued. officer albert morales.albert morales/san jose police"just the way the car was wedged beneath the truck there was a survivor in the backseat and medical personnel and firefighters arriving on scene were able to extract the juvenile from the wreckage. she was immediately transported to a local area hospital. unfortunately the adult make driver was pronounced dead at the scene..."the young girl escaped with only minor injuries. a man on a bicycle who rides park avenue every day says the early morning sun

dollars worth of jewelry was stolen from a jewelry store in san francisco's chinatown. . now the police department is releasing pictures and video of the alleged thief. (catherine) kron four's philippe djegal tells us what the store owner says the suspect got away with... (philippe) a diamond necklace... and a whole tray of diamond rings worth between 80 and 100-thousand dollars. that's what the owner of loretta's jewelry company on waverly place says was stolen last friday... when san francisco police allege this man burglarized the store in broad daylight. officer giselle talkoff/sfpd- "the jewelry store owner was inside at the time that this occurred and was pretty rattled." the store owner says she was standing right behind the counter inside at around three o'clock in the afternoon that day... when she saw the suspect use a hammer to bash this window three times before it eventually broke... and, then that's when he grabbed the jewelry and then ran off. officer giselle talkoff/sfpd- "they knew what they were doing. went in, grabbed it and made out with all that jewlery." the owner says she had never seen the suspect

(catherine) cigarette prices are about to go higher in california.... a new tax is taking effect this weekend.. voters approved it in november.. the current tax is 87-cents a pack...and it's increasing by two-dollars on saturday. it's hoped the extra money will raise more than one-point-four-billion dollars a year. much of that money is set to go to health plans for people with low incomes. anti-tobacco groups have praised the tax = saying it will encourage people to quit smoking..or not start in the first place. (catherine) in the south bay- a lawsuit has been filed against the city of santa clara -- claiming its at-large election system has prevented asian- americans from being elected to the city council.. the lawsuit was filed by a retired social worker - who argues something is wrong considering the fact the city's asian population is 38 percent. the suit asks for a district system - instead of an

at-large or 'block' vote. none of the five asian-american candidates who ran for city council seats last year were elected... and supporters of the lawsuit argue that some of them 'would' have been elected under a district based system. the california voting rights act prohibits at-large systems in jurisdictions with racially polarized voting patterns. (catherine) a new foot- trail now re-connects two parts of big sur - which were divided after a recent bridge collapse in stormy weather. more than 400 people who live in the area were stranded when pfeiffer canyon bridge on highway-1 was demolished earlier this month... thanks to a team of local volunteers... at least the new trail is giving locals and visitors away to get in and

out of the area.. the trail is closed from a half-hour after sunset until a half-hour before sunrise. bicycles and pets aren't allowed.. as for a new bridge....that could take as long as 9 months to complete. (steve) take a look at this... a motorcyclist is launched off a cliff... and the whole thing was caught on camera. a group of motorcyclists were riding through southern california's angeles national forest... then one rider loses control of his bike and goes flying off the cliff... the accident was captured by a fellow rider... who rushes to the man's rescue. the motorcyclist was found injured but alert in some thick bushes. emergency officials arrived and airlifted the rider to a nearby hospital. amazingly... he sufffered only a fractured shoulder. a tennessee teenager and the man who kidnapped her have

(catherine) in the east bay... a suspect is in custody - accused of stabbing a man inside a walmart last night. it happened at the walmart on lone tree way in antioch last night just after 9-pm... police say the two men involved had been arguing...and they ran into a store restroom where the stabbing happened. officers found the victim and the knife....and arrested the suspect...who's facing felony assault charges. the man who was stabbed is recovering in a hospital and is expected to be okay.. (steve) we are learning new information about missing tennessee teen and her alleged kidnapper. investigators are releasing new surveillance

images of 15-year-old elizabeth thomas and her former teacher 50-year-old tad cummins. the two were caught on camera at a wal-mart in oklahoma city earlier this month. as you can see... both have dyed their hair and altered their appearance. the first confirmed sighting of the two. investigators say this kidnapping is still an amber alert and should be taken seriously. authorities believe cummins is armed with two handguns. (steve) in south carolina... church shooter dylann roof is expected to pead guilted to state murder charges. prosecutors say roof will enter the plea on april 10-th to avoid another death sentence. 22 year-old roof was convicted of killing nine black parishoners at a charleston church in 20- 15. because this is the first federal case in which a hate crime defendant has been sentenced to death... it's unclear if or when the federal

government can carry out the sentence... so south carolina prosecutor are calling this new plea agreement, quote, "an insurance policy"... meaning that if something happens at a federal level, roof would be forced to serve life in prison on state charges. confirming at least two white house staffers were involved in helping house intelligence committee chairman devin nunes... in gathering intelligence materials. the official who wants to remain annonymous... says ezra cohen-watnick and michael ellis helped gather the intelligence last week... but it's unclear if either of the two actually showed the california republican materials regarding surveillance in the election. a spokesperson for nunes says the lawmaker will not confirm or deny who his sources are. and in a one- on-one interview nunes claims the source is lying... devin nunes:"but i can tell you that those reports are mostly wrong.this is something that i've known about for a very long time. uhhh... from people who were not affilitated at all with the white house or anybody there... the challenge was finding a place to be able to view this information to be able to get my hands on this information. so i think what's in those stories is that there is a lot of innuendo. there are people who probaly knew about this, knew about me being there.but the fact of the matter is that doesn;t make them a source of

my information."(steve) nunes is under fire for telling both president trump and the media about the materials ... before telling democrats on the intelligence committee. some democrats have called on nunes to recuse himself from the panel's probe into russian meddling in last year's election. nunes says he won't do that. (steve) about four thousand people who went to trump university will be getting most of their tuition money back. a judge approved an agreement for president trump to pay 25-million-dollars to settle two lawsuits against the education program. the university opened in 2005.. it was shut down five years later after new york education officials ordered the program to stop operating with out a license. former students who are eligible are expected to get about 90 percent of their money back.

(catherine) north carolina's governor rolled back the state's controversial bathroom bill this week.. but it's not clear yet if it's going to be enough to bring back all the business and sportingevents which had been boycotting the state... some critics say the roll- back should have been a full repeal....and argue that it still leavesthe gay and transgender community vulnerable to discrimination. the compromise was worked out under pressure by the n-c-a-a, which threatened to continue withholding events until at least 20-23. the n-c-a-a president is set to review the new law next week. (catherine) starbucks is rolling out what they call...the world's strongest coffee. they're calling it...."black insomnia." it's apparently not for wimps..... and has 58-point-5 milligrams of caffeine per ounce... that's three times more than starbucks' dark roast.. "black insomnia" has already been listed as one of the most dangerous caffeinated products. just one cup would mean taking in roughly 700-milligrams of caffeine. to put that in perspective...the f-d-a recommends a limit of 400- milligrams a day.

general jeff sessions... and homeland security secretary john kelly... are defending the agents actions, after california's top judge sent them a letter asking them to stop. the depertment of justice and d-h-s responded saying .... state and local policies barring police from turning over suspects for deportation, have forced federal agents to make arrests at public places. just a short time ago, san francisco's district attorney spoke out against the practice. we'll tell you the three words he has for the feds ... tonight at six. catherine now back to you. daughter was a victim. kron 4 ella sogomonian was there too and has the exclusive interview. this mom was in tears and outraged she tells me her daughter had attended the san francisco city impact school since she was in kindergarden but she recently pulled her out after she felt her daughter was no longer safe - and says tonight's allegations toward a volunteer confirmed her beliefs.39-year-old chad brian litz worked as a volunteer nurse practicioner at san francisco city impact since 2013.today he was arrested and charged for alledgely practicing medicine without a license and identity theft.litz now faces five felony counts.the mother and daughter who is 12-years-old want to go unnamed but are both disturbed by the news. saying litz treated the child last november - they say he gave her a pill when she had a stomach ach without informing a parent - afterwhich she felt worse almost cancelling her birthday party."he didn't tell me what it was his back was turned behind. all he said was here take this and you'll feel better and i'm thinking in my head, should i? like, i don't know. this was the first time

bay.... is the deadly oakland apartment fire.(steve) we have learned in january, an oakland fire captain recommended the building be closed down because of life- threatening hazards. kron 4's spencer blake is in oakland tonight... where an attorney for the master tenant gave us new information. spencer,what did you find out? because of conflicts of interest, the same legal firm that represents the master tenant, urojas, will ánot be representing individual victims and their families. the concern is that a resident who files suit would likely list both the owner and the master tenant in their suit, so the law offices of john burris would be representing both sides in a case like that. but, with the deplorable conditions people were allegedly living in months before the fire, the chance for litigation is still there. suing the property owner ... and the man who ran it. lapine was one of the dozens of people who were at the "ghost ship" for a dance party. the complaint says, the couple who ran the collective, along with the owner, knew about the fire hazards inside the converted warehouse and did nothing about it. the building had been illegally converted into housing. kron 4 spoke to lapine's father one week after the fire... he came to the scene to see it for himself. ( pam ) this is one of a number of lawsuits that has been filed over the fire. the building owner and its operators have not commented on the latest legal action. we should add ... no criminal charges have been filed in the case. also... we are still waiting for word on what caused the fire... we do know all 36 people died

accident left a man dead early this morning in downtown san jose.(steve) it happened on busy park avenue, just west of the downtown businessdistrict. as kron four's rob fladeboe reports now, a young girl, trapped in the wreckage for a time, was rescued and will survive. the late model pontiac firebird, it's roof mostly sheared away on impact, ended up pinnedbeneath the trailer of the big rig truck. the driver of the car was apparently killed on impact but a passenger in the car, a 10-year-old girl, was trapped for a time and had to be rescued. officer r albert morales.albert morales/san jose police"just the way the car was wedged beneath the truck there was a survivor in the backseat and medical personnel and firefighters arriving on scene were able to extract the juvenile from the wreckage. she was immediately transported to a local area hospital. unfortunately the adult make driver was pronounced dead at the scene..."the young girl

they say... exposed himself to a 12-year-old girl... he is also accused of doing the same thing to a teenager.. a suspect sketch has now been released.. police say, the first incident happened around 6- monday night - near westmoor park... when the man exposed himself to a 19-year- old woman.. they say, he did it again wednesday - this time to a 12-year old girl who was walking home from school on miraposa avenue. police also released a photograph of the suspects car... they say, it is a silver or gold 2003 toyota camry. (steve) in the east bay... two burglary suspects are in custody after breaking into a berkeley home last night. authorities say it happened just after 8 p-m on sacramento street near stuart street. police arrested the two as they were walking away from the home. the suspects have now been identified as 51 year-old reginald patillo and 38 year-old kizzie sandling. when police searched patillo's car... they found suspicious tools and an empty

since part of the macarthur maze.... collapsed. it was april of 2007, when a tanker crashed at the interchange. it burst into flames... and the heat was so intense... it weakened huge sections of steel. the beams gave way... causing part of the road to collapse. it took crews a little over three - weeks to repair all the damage from the fire ... and fix the roadway. as nasty as it looks.... only one person was injured. at around three o'clock that afternoon... police say an alleged thief broke through the front windows of the business. the owner says the man stole between 80 and 100-thousand dollars worth of diamond rings and a necklace. police are releasing surviellance video and pictures of the man on foot during his getaway in hopes of developing new leads. in san francisco, philippe djegal, kron four news. here in san jose one man was killed while his passenger survived a horrific crash early friday. it happened at the intersection of park avenue and mcevoy street just before 8 a.m. a pontiac firebird colliding with tractor trailer rig. the pontiac wedged beneath the bed of the trailer. the adult male driver pronounced dead at the scene while his 10 year old passenger, trapped in the vehicle before being rescue by firefighters, escaped with minor injuries. it was the 11th traffic fatality of the year in the city. in san jose
