(rebecca) that's right james. and now, officials from united are saying every passenger on that flight is now getting a refund. this comes as united airlines is vowing to make changes after what happened. this is video of the moments leading up to the confrontation. someone sitting behind doctor david dao, started recording, after he was asked to give up his seat. other passengers in the plane say dao never raised his voice. but you do hear him insist he's not giving up his seat. (rebecca) two 'more' of the airport police officers involved in

the incident have been put on leave.. also attorneys for dao took a step toward legal action. filing court papers asking that reports and other material in the case be (rebecca) back to you james. ( james ) another passenger from irvine says he experienced a similar problem when he flew with united earlier this month. geoff fearns was returning home to l-a from hawaii and paid an extra thousand-dollars for a first class ticket. he says after he got into his seat a united employee confronted him... saying he needed to get off the plane because the flight was full and a 'higher-priority' first- class passenger was entitled to his seat. but fearns refused to get off.

in hayward when investigators say undercover officers tried to stop a stolen car wanted in connection with multiple armed robberies.investigators say when they tried to stop the car the driver drove into the detectives police vehicles, injuring the two detectives. during the incident, the detectives fired their weapons at the suspect driving the vehicle and hit mondragon. "she's 16-years old, that's what needs to be remembered, she was sixteen."hayward police is one of the agencies investigating the shooting since it happened in their city.elena's family is demanding answers."we're not here to blame people and to find blame, were here to collect accountability from people, be it the person that was driving the car or the officers, someone needs to be accountable for their actions, my niece, she was innocent in this whole thing."miguel minjares is elenas uncle.the family asked investigators to release all video of the shooting but haywards police chief told the family there is no dash cam video of the incident and a body camera worn by one of the officers

101 ( james ) the santa clara county district attorney's office has released a new report showing a jump in violent crime. kron4's charles clifford looks at the suggestions made to law enforcement to deal with the

problem. here in san jose, the district attorney's office has created a new crime strategies unit. it's a joint effort between the d-a's office and law enforcement agencies across the county. the unit's goal is to take a hard look at crime data and find ways to effectively use limited law enforcement resources. in a new 32 page report titled "crime in santa clara county" the crime strategies unit concluded that overall santa clara county is one of the safest places in america, but there are a few troubling trends.sotthe report also identifies two main ways the d- a's office and law enforcement could turn that trend around. the first is by putting more resources into solving gun related violent crimes.sot

and efficiently process guns and link gun crimes.>the second area of concern, is residential burglaries. the report found that most burglaries are committed by a handful of people.sotin addition to gun crimes and residential burglaries, the strategies unit also plans on gathering data on gang activity and using that information to help stop the spread of gang related violence.finally, the d-a's office has submitted a request to the county board of supervisors to hire 5 criminalists to help process guns and dna evidence faster. in san jose, charles clifford kron 4 news ( james ) in antioch. . . a new set of eyes is coming to a crime-riddled intersection. the city council approved the installation of new surveillance cameras as a part of an effort to crack down on crime. a total of three cameras and six license plate readers will be installed at the intersection of east 18th

street and cavallo road. the city will pay for the cameras with more than 170- thousand dollars collected from measure-c. a special tax approved by voters in 2014. city council members say the police department will manage and monitor the cameras. ( james ) officials say they hope the cameras will be up and running by june. ( james ) students and parents are upset after a burglar targets instruments belonging to one popular bay area high school marching band. two dozen instruments were taken from armijo high school last week in fairfield. fairfield police say the burglar had to jump over two fences to steal the

( james ) california's child vaccination rate is up. it comes in the first year the state has required nearly all public school children be immunized. according to state public health officials nearly 96 percent of this year's kindergartners received all required vaccines. that's the highest rate since the current immunization regimen was put in place in 2001. a law passed three years ago prohibited parents

from opting out of vaccinations due to personal beliefs. as a result, california's immunization rates have been climbing. that law was tightened in 20-15 following a measles outbreak in disneyland. ( james @ bam ) another big story we are following this morning.. two san francisco police officers are now cleared in a deadly shooting. it happened back in february of 2015 after officers shot and killed a 21-

year-old guatemalan immigrant. kron4's alecia reid has the details. the district attorney says in order for them to have charged the 2 officers involved in this deadly shooting, they would've had to prove beyond a reasonable doubt that the officers did not act in self defense or in the defense or others.pkgafter interviewing at least 3 dozen witnesses, reviewing the medical examiners report, a toxicology report, and reports from an independent examiner, district attorney george gascon has decided the two officers that shot amilcar perez lopez to death are not at fault."let's say you do not believe the officers as to the fact that they were in fear for their lives, or you do not believe the expert in the timed reaction, the reality is the officers are justified under the law to protect others." perez lopez was shot half a dozen times, mostly in the back. the d-a says it was lawfully done. plain clothes

officers craig tiffe and eric reboli intervened during an altercation between perez lopez and his roommate. witnesses say the 21 year old was chasing abraham pete down the street with a knife. police and witness accounts say perez lopez ignored demands to drop the knife and was erratic when he was shot to death."if the knife had been dropped before the shots were fired, it would have likely ended at the edge of the sidewalk where perez lopez was standing before he stepped off the sidewalk, or in the street between the two parked cars."there have been protests for an independent investigation. and now this determination has the community in arms, as they get ready to start protesting.sot - oscar salinasstandupthe da's office tried reaching out to perez lopez's family in guatamala, but have had no luck.the d-a says they've notified the family's lawyer and the guatamalan consulate. in the meantime, the

( james ) we are learning about the shooting at a southern california elementary school. for more, here is rebecca strom. (rebecca @ landing) the new details we are learning, are about the other child who was injured in the shooting. school officials have identified the injured student as nolan brandy. and his parents say the nine-year-old is recovering well. the family is thanking the community for an outpouring of support after the shooting. nolan was injured when 53-year-old cedric anderson walked into his estranged wife's classroom and opened fire. his wife, karen elaine smith, and an eight-year-old student, jonathan martinez, were killed.

jonathan martinez was born with a genetic condition and had survived heart surgery. according to friends anderson shot his estranged wife after threatening her for moving out. the couple married in january and separated in the middle of march. smith moved out of their home and had been staying with family. ( james @ landing ) bart is facing some criticism after issuing a public service announcement telling riders how to stay safe on bart. the p-s-a was called "avoiding creeps 101" the transit agency tweeted it out wednesday. a handful of people took exception with the fact that bart was not telling "creeps" to keep their hands and eyes to themselves... but was instead, putting the onus on the victims. telling people to not sit by yourself, not get distracted, and trust your instincts. so yesterday afternoon bart came out with this. it's called "don't be creepy 101." a new visual aide telling people to keep their hands to themselves and don't leer. this is not a dating app. ( james ) in the south bay... tenants' rights groups say there's nothing

short of a renters crisis happening right now in san jose. kron four's rob fladeboe takes a look at the debate surrounding an effort to put a stop to so called 'no cause' evictions of renters by landlords. "i'm here to stand up for tenants in their fight against 'no cause' evictions..."now living in a motel, ruby dominguez told a group of supporters outside city hall that she was indeed evicted from her apartment for no good reason.ruby dominguez/evicted from apartment"i lived in a 2- bedroom duplex for 27 years and never caused any trouble and then one day i got a 30 day eviction notice..." dominguez, according to the group working partnerships usa, is one of the more than 2,000 no cause evictions reported in san jose since 2010.jeff buchanan/working partnerships u.s.a"these tenants have done nothing wrong, they played by the rules, paid their rent on time but suffered evictions from wealthy landlords who are profiting from rising rents and weak tenant protections that allow them to evict

( averi ) all lanes on state highway 92 in san mateo are open after a fatal crash closed the westbound lanes wednesday night, according to the california

highway patrol. the incident was first reported at 10:10 p.m. on the highway, just west of el camino real, chp officials said. a preliminary report indicated that an suv struck a pedestrian. emergency crews. a sig-alert was issued at 10:35 p.m. because all westbound lanes were blocked. shortly before midnight, the sig-alert was cancelled because the scene was cleared and all lanes on highway 92 were open. map showing highway 92 near el camino real in san mateo ( mark ) thanks averi. we will check back with you through out the morning. ( james ) it's been nearly a month since fremont police shot and killed a pregnant 16- year-old... and this morning the family is looking for answers. elena mondragon was killed on march 14th in hayward when undercover officers fired into the car she was riding in. they say the car was stolen and connected to multiple armed robberies. elena's friends and family addressed the hayward city council earlier this week. they say they want to know why there is no video of what happened.

( mark ) this morning we know the name of the child injured in a shooting at a southern california elementary school. school officials say he's nolan brandy. and his parents say the nine-year- old is recovering well. the family is thanking the community for an outpouring of support after the shooting. nolan was injured when 53-year-old cedric anderson walked into his estranged wife's classroom and opened fire. his wife, karen elaine smith, and an eight-year-old student, jonathan martinez, were killed. according to friends, anderson shot his estranged wife after threatening her for moving out. the couple married in january and separated in the middle of march. ( james ) there is a jump in violent crime in santa clara county. that is according to a new report released by the district attorney's office. in san

jose, violent crime went up by 14 percent. a new crime strategies unit was set up to analyze crime data and find ways to effectively use limited law enforcement resources. the report found that gun related crimes and home burglaries were the two biggest problems. a supervising deputy district attorney says most burglaries are committed by just a handful of people. ( james ) the strategies unit also plans on gathering data on gang activity and using that information to help stop the spread of gang related violence. the d-a's office submitted a request to the county board of supervisors to hire five criminalists to help process guns and d-n-a evidence faster. ( james ) two san francisco police officers are now cleared in a deadly shooting. it happened in february of 2015 when officers shot and killed a 21-year-old guatemalan immigrant.( mark ) kron4's alecia reid has the details. the district attorney says in order for them to have charged the 2 officers involved in this deadly shooting, they would've had to prove beyond a

( james ) san jose city council will consider a so- called "just cause" ordinance next week. it would make it harder for landlords to evict renters. since 2010, more than 2-thousand people in the city have faced no cause evictions. that means they have been evicted despite paying their rent on time and playing by the rules. some

property owners argue it will make things worse leaving no room for dialogue. but others say the measure is so new that it's hard to tell what exactly it would mean for landlords and their tenants. ( mark ) california's child vaccination rate is up. this comes in the first year the state has required nearly all public school children be immunized. state public health officials say nearly 96 percent of this year's kindergartners received all required vaccines. that's the highest rate since the current immunization policy was put in place in 2001. a law passed three years ago prohibited parents from opting out of vaccinations due to personal beliefs. that law was tightened in 20-15 following a measles outbreak.

confrontation. someone sitting behind doctor david dao started recording after he was asked to give up his seat. other passengers in the plane say dao never raised his voice. but you do hear him insist he's not giving up his seat. ( rebecca ) two 'more' airport police officers involved in the incident have been placed on leave.. also attorneys for dao filed court papers asking that reports and other material in the case be preserved in case there is a lawsuit and dao's family member is expected to speak during the 8:00 hour. we will bring that to you live when it happens. back to you.

( mark ) airlines are pushing back against any effort to ban them from overbooking flights. the c-e-o of delta airlines calls overbooking "a valid business process." another group representing many of the big u-s carriers says the practice lets airlines keep fares low while managing the rate of no- shows on any particular flight. federal rules allow airlines to sell more tickets than they have seats, and airlines do it routinely because they assume some passengers won't show up. ( james ) happening today... a west contra costa county school district employee accused of molesting children is set to appear in court. 60-year-old ruben gonzalez faces 47 felony charges. he worked as a yard supervisor and then bacame a night janitor. police say his victims were all children who lived in his pinole home and were members of his family. investigators say the abuse has been going on for more than a decade. gonzales is being held on 46 million dollar bail. a month since fremont police shot and killed a pregnant 16- year-old... and this morning the family is looking for answers. elena mondragon was killed on march 14th in hayward when undercover officers fired into the car she was riding in. they say the car was stolen and connected to multiple armed robberies. elena's friends and family addressed the hayward city council earlier this week. they say they want to know why there is no video of what happened.

according to a new report released by the district attorney's office. in san jose, violent crime went up by 14 percent. a new crime strategies unit was set up to analyze crime data and find ways to effectively use limited law enforcement resources. the report found that gun related crimes and home burglaries were the two biggest problems. a supervising deputy district attorney says most burglaries are committed by just a handful of people. ( mark ) the strategies unit also plans on gathering data on gang activity and using that information to help stop the spread of gang related violence. the d-a's office submitted a request to the county board of supervisors to hire five criminalists to help process guns and d-n-a evidence faster. custom built bikes were stolen out of a trailer last week in corte madera. those bikes belong to a woman's cycling team and are worth up to sixty thousand dollars. the cycling team..known as "twenty 20"..is made up of more than two dozen women. they have won nine olympic gold medals. the team also has some famous donors like barry bonds. kron-four spoke to the woman who started the team. she says this theft is really personal. ( rebecca @ land ) police are now looking through surveillance footage. a sponsor for the cycling team is offering a ten thousand award for information leading to an arrest. ( mark ) a burglar stole thousands of dollars worth of instruments belonging to a

popular bay area high school marching band. two dozen instruments were taken from armijo high school in fairfield. fairfield police say the burglar had to jump over two fences to steal the instruments. the school district says they are working with police to catch the thief... including turning over video to police from the school's surveillance camera.

wednesday. a handful of people took exception with the fact that bart was not telling people to keep their hands to themselves. but instead bart put the burdon on the victims... telling people not to sit by themself, not to get distracted, and to trust their instincts. so yesterday afternoon bart came out with this. it's called "don't be creepy 101." telling people to keep their hands to themselves and don't leer. ( mark ) the state is blocking the public release of records related to the spillway failure at the oroville dam. the information could guide repairs to the damage caused by the incident back in february. it prompted the evacuation of nearly 200- thousand people. governor jerry brown's office say they are keeping the records sealed because of federal security regulations designed to combat terrorism. the administration also blocked the release of records showing how brown's office handled the

( mark ) the wife of orlando night-club shooter omar mateen pleaded not guilty in court. bay area native noor salman appeared in a courthouse in orlando, florida yesterday. she faces charges relating to helping her husband carry out the shooting. prosecutors say salman knew about the nightclub attack that killed 49 people and injured more than 50 others last june. she was arrested in january here in rodeo, but was transferred last week to florida. a trial date has been set for june. ( james ) the first african american woman appointed to new york's appeals court has been found dead. 65-year-old sheila abdus salaam's body was found yesterday afternoon floating near the shore of the hudson river. the judge was reported missing just the day before. police say her body did not have any obvious signs of trauma. the medical examiner is still trying to determine how the judge died. students on a fieldtrip to the state capitol were embarassed by an email sent out to government workers. as the students arrived monday... a capitol staffer sent out an email announcing, quote "there are cross-dressers in the building." the email went on to say staffers were being allowed access to private bathrooms -- so they wouldn't have to share public bathrooms with the visiting gay, lesbian and transgender students. the oklahoma house speaker says she is looking into why the email was sent. parents of the children say they want an apology. ( james @ land ) a frightening scene inside a barber shop in arizona... a four-year-old girl had to run for cover after a gunman opened fire inside the shop. this happened earlier this week. two men were asked to leave a tattoo parlor after a fight broke out. the two men got into their car and shot at the shop while driving away. instead of shooting the tattoo parlor, they hit the barber shop next door. the bullets just missed the young girl who was watching t-v. the two men were arrested the next day. ( mark ) comedian charlie murphy has died. murphy died wednesday morning in new york after losing his battle with leukemia. charlie was the older brother of eddie murphy. the comedian was best known for his appearances on "chapelle's show" on comedy central. he appeared in several featured films and voiced roles for animated tv series' on adult swim. his

kron4's alecia reid has the details. the district attorney says in order for them to have charged the 2 officers involved in this deadly shooting, they would've had to prove beyond a reasonable doubt that the officers did not act in self defense or in the defense or others.pkgafter interviewing at least 3 dozen witnesses, reviewing the medical examiners report, a toxicology report, and reports from an independent examiner, district attorney george gascon has decided the two officers that shot amilcar perez lopez to death are not at fault."let's say you do not believe the officers as to the fact that they were in fear for their lives, or you do not believe the expert in the timed reaction, the reality is the officers are justified under the law to protect others." perez lopez was shot half a dozen times, mostly in the back. the d-a says it was lawfully done. plain clothes officers craig tiffe and eric reboli intervened during an

( rebecca @ land ) school officials say he's nolan brandy. and his parents say the nine-year-old is recovering well. the family is thanking the community for an outpouring of support after the shooting. nolan was injured when 53-year-old cedric anderson walked into his estranged wife's classroom and opened fire. his wife, karen elaine smith, and an eight-year-old student, jonathan martinez, were killed. hundreds of people gathered at a vigil earlier this week to remember the victims in the shooting.

from 37 to the toll plaza. ( mark ) cameras will soon be installed at a crime-riddled intersection of antioch. the city council approved the installation of new surveillance cameras as a part of an effort to crack down on crime. a total of three cameras and six license plate readers will be installed at the intersection of east 18th street and cavallo road. the city will pay for the cameras with more than 170-thousand dollars collected from measure-c. that measure was a special tax approved by voters in 2014. city council members say the police department will manage and monitor the cameras.

( james ) a woman who was randomly attacked at a c-v-s store in vacaville two years ago is now asking for someone to help her husband. he needs a heart and kidney transplant and is on a wait-list. 55-year-old rene reynolds had surgery for a heart pump. the pump is supposed to buy him more time until he gets a transplant. his wife sherrie was stabbed six times in the back while she was standing in line at a c-v-s. she had two collapsed lungs...but managed to survive. they say relying on their faith helped them through that ordeal and is helping them now.
