department 40 on tuesday, as closing arguments got underway, prosecutor david boyd pointed to the defendant and declared to the jury that sierra lamar is dead and that garcia torres murdered her. the da's case based largely on dna and otherforensic evidence says legal analyst steven clark. steven clark/legal analystfor it's part the defense will again argue that sierra is a runaway while trying to convince the jury that sloppy evidence gathering and processing by sheriff's deputies and the crime lab will show there is not enough proof beyond a reasonable doubt that garcia torres is the killer.

(catherine) it's been a long, slow search for justice. with no body ever found, investigators had to rely on forensic evidence to link the defendant to sierra lamar's disappearance. natearly morning on a lonely rural road in morgan hillthis is where sierra lamar disappeared on march 16th, 2012 she was headed for the school bus stop just a few minutes walk from her home.that evening her mother got an automated call from the school that her daughter was absent. marlene lamar insists her daughter is not a runaway, whoever is out there, please please let her go. the next day, sheriff''s deputies began searching nearby fields. they discovered sierra''s cell phone in a field a couple of blocks away.and then her purse was found .... a juicy couture

(vicki) state lawmakers are questioning university of california president janet napolitano today. they want more information about an audit that found the university system hid 175 million dollars from the public. auditors say uc administrators collected undisclosed surplus money even as the uc raised tuition and asked the state for more funding. napolitano has disputed the audit's findings. she says there is actually 38 million dollars in reserves. she has described the money as a modest amount set aside for unexpected expenses. some lawmakers called for a reversal of the tuition hike in the wake of the audit. (catherine) no one got dragged....no rabbits were killed...but this was still bad. the video shows two men throwing punches at each other.. the man in the dark shirt yells "someone help - this guy is crazy"... witnesses say the man in the red hawaiian shirt was drunk and had been the one who started the problem.... a flight attendant desperately tries to separate the men.... you could hear a child wailing....and other passengers saying things like "oh my god." the man in the red shirt is finally coaxed into leaving and is led away...his shirt torn to shreds. he clearly doesn't want to go.. but finally things get quiet and the man in the dark shirt sits down again. and look what happens..... guess who comes back.... and there are "more" punches thrown.

(grant) it's proof that little things do add up. the nation's airlines collected four-point-two billion dollars in baggage fees last year... up ten percent from 2015. that's according to new data released tuesday by the department of transportation. the increase alone is a million dollars a day. but not everything was up. fees collected for changing a reservation actually fell four percent to two-point-nine billion dollars. and fares went down by one percent. some airline executives point to baggage fees as a way to keep fares low. (philippe)nats- hovering around 90-degrees in the fremont hills... warm weather and slithering rattlesnakes go hand in hand. chelsey barnes/hiker- "they love the heat -- so, they'll be out there." on monday afternoon, a 47-year-old man from santa clara learned that the hard way. after reaching the summit at the mission peak regional preserve area... the california highway patrol says the man took a seat with his family on their walk down... and, he was bitten on the hand by a rattlesnake he may have mistaken for a rock.mark guinnoo/hiker- "i was a little concerned, i was little concerned, um, cuz we, well i never knew there were rattlesnakes out here." this sign at the front of the trail warns visitors to be aware of rattlesnakes. it says they're not aggressive... but if threatened or

(vicki) a car crashes through a pet store in the north bay. it happened just before 9:30 last night in santa rosa - at a store called "village pets." it is at a strip mall on montgomery drive and summerfield road. police say the driver, 26- year-old jeffery pearson, was speeding when he lost control of his vehicle and crashed into the store. police say he told officers he smoked marijuana before driving. officers also say they found signs of alcohol consumption in his vehicle. pearson was booked into the sonoma

(vicki) a few dallas officers are being hailed as heroes tonight... for rushing to the aid of a paramedic who had been critically injuried - during an active shooter situation. police say the gunman, derick brown, opened fire on paramedics who were responding to a shooting call at his home. officers say brown was acting erractically and killed his roomate before shooting and critically injuring a neighbor outside. officers dodge gunfire to help the injured paramedic and the injured roomate- who both remain at the hospital in critical condition. brown was later found dead from a self-inflicted gunwound. deadly stabbing that happened yesterday on the campus of university of texas. the victim who died during the attack has been identified as harrison brown... a freshman at the school who was involved in band and the choir. two other students who were stabbed during the attack - have been released from the hospital. one person remains in the hospital. the attacker has been identified as - 21-year-old kendrex white. police say white suffers from mental health issues - but would not release a motive in the attack. old boy shot and killed in san francisco's sunset district has been identified as rae-john jackson of daly city. (catherine) grief counselors were available at jefferson high school where jackson had been a sophomore before leaving this fall. his older brother is a junior at the same school. jackson was shot as he was driving a white pontiac near sunset blvd and kirham around noon monday. he later died at the hospital. witnesses say they heard 6 or 7 gunshots. and there were bullet holes in the driver's side car door. the school district superintendent says these are difficult circumstances for jackson's fellow classmates to comprehend. the fires are happening close to major roads.. this is the scene of one of at least three - which have happened in recent weeks in oakland. have been 3 fires at homeless encampments. last month 5 tents burned and a dog died when fire raced through a homeless encampment at 22nd avenue and 880 then on monday of this week, there was a fire at 5th and market, and then later that evening a fire at an encampment at 35 and magnolia destroyed 20 of 40 tents. sotcity fire officials say they may have to start including homeless encampments on their normal inspection routes.sot mark hoffmann/actin g oakland fire chief 55-105 the city of oakland wants to go a step further this encampment at 35th and magnolia was sanctioned by the city and came with services and bathrooms. it will close friday, and city officials say the next city sanctioned encampment will come with greater protections.sot joe devries/asst. to the oakland city administrator 127-133 there are also plans to regulate the non city sanctioned encampments which also could reduce fire danger. sot153/in the encampment

it's still not clear whether the fire was deliberately set -- but it did start at a homeless camp. the suspect - who is homeless - faces a first degree arson charge. one witness claims the man had been smoking drugs and started the fire. ( steve ) a 47-year-old man from santa clara is in serious but non-life threatening condition at a hospital after being bitten by a rattlesnake yesterday afternoon. it happened in fremont at it happened it happened in fremont at the mission peak regional preserve area. the california highway patrol airlifted the man to a hospital.. after he may have mistakenly put his hand on a rattlesnake he thought was a rock. the east bay regional park district says the warm weather is bringing the snakes out. hikers are now being warned to keep an eye out. chelsey barnes/hiker- "i usually walk looking down anyways and i was keeping a heads up for them. we saw a little, a little snake but not -- no rattlesnakes."//mark guinoo/hiker- "i just hike in the middle of the trail and stay away from the sides and the bushes."//bill moore/hiker- "you just have to watch out for them and, especially up in the rocks."(

steve ) in just the past week, the park district says there have been six reported rattlesnake sightings at east bay parks. the bite victim was given anti-venom and is expected to survive. (catherine) hayward residents are voting in a special vote-by-mail election today.. the question - whether to keep an existing parcel tax and increase it. the extra tax money would help fund hayward schools. the parcel tax would increase from 58 dollars to 88 dollars per parcel and would stay in place for 12 years. the present tax expires june 30th. hayward residents who haven't yet mailed in their ballots must do so by today. (steve)crews are searching for a 14-year-old boy who went missing while playing with friends on the american river. the teen had been one of five children jumping off rocks into the river in folsom last night.the folsom fire department says crews looked for the boy for more than two hours before calling off the search. fire officials say the search continued today- but has gone from a rescue to a recovery operation.

there's an interesting proposal that could dramatically change the rules of the road for bicyclists in california. lawmakers are suggesting it would be safer if they allowed bikers to yield at stop signs instead of coming to a complete stop... or what some are calling an "idaho stop." that's because the proposal is based on an idaho law from 1982. it is the only state that allows bicyclists to yield at stop signs. statistics show a drop in bicycle injuries since the law went into effect.
