( james @ bam ) our top story this morning... a major development in the investigation into russia's meddling in the u-s election. the justice department has appointed a "special counsel" to oversee the fbi investigation. that man is robert mueller... he is a former fbi director -- who was tapped by president george w. bush. earlier in his career, mueller was the u-s attorney in san francisco. grant lodes has the response from the white house. the investigation into possible collusion between the trump campaign and russia has

taken an unexpectedtwist -- the appointment of a special prosecutor. in a statement, deputy attorney general rod rosenstein wrote "...special counsel is necessary in order for the american people to have full confidence in the outcome." reaction from capitol hill was swift -- espcially from democrats who had insisted on a special prosecutor ever since fbi director james comey was fired last week. rep. jackie speier/-d- intelligence committee: "everyone in this country should breathe a sigh of relief."sen. richard blumenthal/-d- judiciary committee: "a very solid and significant step"rosenstein -- who recommended firing comey -- has appointed robert mueller to lead the russian investigation. mueller is a former marine and doj official who served as fbi director until 2013 after serving 12 years. jeffrey toobin/cnn senior legal analyst: "this is the single most respected figure in american law enforcement./this is someone who really embodies the best of the american criminal justice system and the chips

are going to fall where they may."the news comes the same day president trump interviews candidates to replace comey. the white house has said the need for a special counsel in the russian probe is unecessary. in a statement president trump wrote: "a thorough investigation will confirm what we already know - there was no collusion between my campaign and any foreign entity." ( james ) president trump also said he looks forward to this matter concluding quickly. however, most legal and political experts say that's highly unlikely. and that we should expect a long and thorough investigation. ( james ) stocks had their worst day since september. investors worried the washington turmoil will stymie the president's pro- business agenda. the dow fell 372 points. the nasdaq was down 158 points. the s-and-p 500 was off by 43. ( james ) another big story we are following this morning... the suspect in a series of east bay car fires has been identified.

investigators are worried he may be responsible for dozens of other arson fires. kron four's alecia reid has more on what we are learning about the suspect. james bishop iii describes himself as a struggling artist, who needed help getting his books published. but investigators call him a serial arsonist.sot - we are very confident that we have the person responsible for the series of firesthe 36 year old is being charged with over two dozen counts of arson. that includes vehicles and buildings with people inside. sot - where the fire in a vehicle spread to a structure is a different crimethe uptick in vehicle fires across contra costa county started back in april. and after careful investigation, authorities noticed a similarity between all of them....sot - we were able to tie them together due to commonalities like using an accelerant on the outside of the vehicles.law enforcement also realized those types of vehicle fires extended to the beginning of the year.sot - right now we're investigating

fires in 2017 but part of the investigation is outside of that time frame.nearby surveillance cameras at a number of the fire locations... captured images of bishop's toyota rav -4... which investigators say tied bishop to the fires. the vehicles were torched in a number of cities in the east bay.including lafayette (jp), brentwood(hm), walnut creek(hm), and pleasant hill(ha).sot - as the occurences increased in frequency, and became more dangerous, we assembled a task force with partners in law enforcement and the district attorney's officebishop's go fund me page says he's been down on his luck for last 10 years. there hasn't been a single donation since he created the page in december. and investigators say he has a prior record.sot - the priors that are listed include some sexual assault chargesstandup if you live in the area where any suspicious fires occurred, and have information or surveillance that can help, youre urged to call the fire district.reporting from concord. alecia reid kron4 news. drawback for the prosecution as the penalty phase of the sierra lamar murder trial continues in san jose. new information surfaced during the trial and it could have reperussions for the prosecutions case... the defense is now suggesting there is 'lingering doubt' about the guilt of convicted murderer antolin garcia - torres. the defense informed the court about a new development regarding lead detective herman leon. detective leon oversaw much of the sierra lamar investigation. last week, a judge found that leon gave false testimony in another case... ( james ) bart is taking action to make sure riders do not get stuck in the dark during a power outage. bart installed new batteries to power the backup emergency lights. this after a p-g-and e outage left riders in the dark at the montgomery bart station last month. then, days later, emergency lights failed at bart's richmond station. bart says, an investigation revealed 14- stations did not have emergency lights. that's despite the fact, inspection reports indicated, the systems had been tested and were working. now bart is suggesting some of its employees were not doing

their jobs. ( james ) new batteries are now in place in six of the stations, while a temporary fix is in place at the others until all 14 stations have new batteries. air quality management district has issued four violations to the chevron refinery in richmond over a flaring incident in december. the flaring led to dozens of complaints about a foul odor. ultimately, the district issued the refinery two citations for excess levels of hydrogen sulfide detected by ground-level monitoring equipment. they also issued two violations for creating a public nuisance. officials at chevron say they were aware of the air district's conclusion but do not agree. ( james ) people visiting the dmv were met with frustration after a system wide computer crash caused longer wait times. the statewide outage only lasted a few hours. it's the second something like this has happened in the last year. kron4's justine waldman is tracking the impact this could have on the dmv today. a long line outside and inside people trying to tolerate the time spent waiting.pretty typical for the san francisco dmv officethough wednesday, frustration also filtered insot they really need to create a better system than the one they have this is

really ridiculousaround noon, statewide computers at offices went black.because of connectivity issues, according to the dmv.this impacted driver license and vehicle registration transactions. and left lots of people unable to get what they needed accomplished.sot i can't say on tv what i am feeling right now..this has happened before.. last october, an outage hit every single d-m-v branch in the state some were closed for days!the problem was blamed on a hardware failure in sacramento. sot there is nothing you can do but waitseveral hours later, the systems was back up and started running again.the dmv doesn't know what caused the latest outage the california department of technology will try and determine the cause.sot something is going on they should find out why this keeps happening ( james ) an alameda county

sheriff's deputy who was killed last friday has been honored. a procession from oakland made its way to downtown stockton yesterday afternoon. sroeuy khin was on his way home from a 12 hour shift last friday morning. chp investigators say a commuter bus crashed into the deputy's volkwagon beetle on eastbound 580 near tracy. they say - khin's car was either stopped or traveling slowly. when investigators found out khin was a deputy - they covered his body with a us flag - and a procession led his body to the coroner's office in alameda county. khin's family has also set up a gofund me to help with funeral expenses. his funeral is set for this weekend. ( james ) in california news.... twenty- one members of a brutal gang in los angeles have been arrested following a 3 -year fbi investigation. during a pre-dawn sweep agents and officers served warrants at

more than 3 - dozen locations looking for members of the notorious m-s-13 gang. among those arrested were the former head of the gang, who faces a number of federal charges. three other gang members are charged with murder. los angeles is the u-s base for m-s-13 which has tens of thousands of members worldwide. authorities count the gang among the largest criminal organizations in the u.s. ( james ) in the north bay - disbelief and shock after the discovery of two people found dead inside their home. it happened around 8:30 yesterday morning at a home off of atherton avenue in novato. family members who were visiting the elderly couple found the two dead inside their home and called

police. sheriff's deputies say the two people died from gunshot wounds and they are investigating this case as a possible murder- suicide. detectives are trying to figure out exactly what happened. the couples names have not yet been released. ( james @ landing ) a family is mourning the loss of a 6-year-old boy who has died after contracting meningitis. the young san jose boy fell ill several weeks ago but wasn't diagnosed with meningitis until last week and by then it was too late. he passed away on tuesday. kron 4's charles clifford spoke with the devastated family. by all accounts, 6-year-old jayden brizuela was a wonderful little boy. his aunt, monica aguilar, says he was an only child and the light of his mother's life.sot but last month, jayden fell ill and his mom took him to the doctor.sot over the next few weeks jayden was in and out of multiple hospitals, urgent cares and

doctor's offices. he would get worse then get better and then worse again. last friday jayden loudly complained of a severe headache and his mother took him to an emergency room. a check of his spinal fluid revealed jayden had bacterial meningitis, a very serious infection that kills about 500 people nationwide every year. standupjayden's devastated family is now left with more questions than answers. they don't know how he contracted the meningitis and they're frustrated that it took so long to get a correct diagnosis. while they are happy with the care jayden

between russia and his campaign. and... a pittsburg man has been arrested in connection to the string of car fires in contra costa county. 36-year-old james bishop was arrested after his car was seen on surveillance. the contra costa county d-a has charged bishop several arson related crimes. fire officials are investigating 30 or more incidents that could possibly be related. a south bay family is mourning the loss of a 6-year-old boy who died after contracting meningitis. jayden brizuela passed away on tuesday after getting sick several weeks ago. he wasn't diagnosed with meningitis until last week, and his family says it was too late. jayden's family say they are frustrated the meningitis wasn't discovered sooner. ( james @ landing ) a stockton mother claims a barber's dirty tools gave her son a scalp infection. now, she's filed a complaint. she claims her 7 year old son got a haircut three months ago at

the 'exclusive barber shop' inside the sherwood mall in stockton. at the time, the boy complained the barber hurt his head. days later, a bump formed... now he has six patches on his scalp. doctors say it's folliculitis: a severe infection can cause permanent hair loss and scarring. < " ... "his hair is not getting any better and i just think that i have to do something about it because other parents need to be aware of salons, barbershops, nail shops, anything like that... like they need to clean their tools in front of you." ( james ) the boy's mom filed a complaint against the barbershop through the california board of barbering and cosmetology. because of board regulations, they can't disclose if a complaint was filed -- but they do say all complaints are thoroughly looked into. the city of stockton says "exclusive barber shop's" business license is currently in the review process. ( james @ landing ) a thousand dollar reward is now being offered to help catch a dog killer. as many as a dozen dogs were found mutilated and dumped in vallejo recently. kron4's

philippe djegal shows us how animal rescue groups are teaming up to solve this case. (philippe) three months after the initial discovery... julia orr/jarr- "i mean, the sadness is overwhelming." some remains of dead dogs still rest in the bark off columbus parkway near lake herman road in vallejo.julia orr/jarr- "yeah, the smell -- it hits you immediately." julia orr speaks for "jameson animal rescue ranch" in the napa valley -- or "jarr." a non-profit organization deeply concerned by this case. julia orr/jarr- "we definitely have a concern that there's a serial animal killer out here." the initial reward offered in this case was two thousand dollars... then, it went up to four and a half thousand dollars... now, it's up to ten thousand dollars... and, julia says it's possible even that amount can increase.carine peters/discovered dogs- "someone knows something, someone saw something -- um, it's time to get some answers." carine peters is the one who first called animal services back in february about as many as a dozen dismembered dogs left on the side of the road. she still walks past the site on a weekly basis.carine

( james ) mueller started his career here in the bay area. his first job was as a litigator for a private law firm in san francisco. that was in 1976. he then worked for 12 years as a united states attorney. his first position was for the northern district of california in san francisco...thats where he received praise for his dedication to prosecuting fraud and corruption cases...he then rose to be chief of the criminal division. after that, he went to boston and served in the same position there. then mueller became director of the f-b-i in the summer just before the september 11th terror attacks. he ran a tight ship... and was known for taking a stand against the

( darya ) one person is recovering after being stabbed last night at dolores park in san francisco. police say the attackers were a group of five to six juveniles. they stabbed the victim multiple times before running off. the victim was taken to the hospital but there is no word on their condition this morning. ( darya ) happening today... the man accused of setting a series of car fires in the east bay will make his first court appearance. 36-year-old james bishop the third is being charged with over two dozen counts of arson. police say he set several cars on fire in lafayette, brentwood, walnut creek, and pleasant hill. authorities say the fires became more frequent starting in april... but date back to the beginning of the year. bishop was linked to the fires when investigators looked at surveillance video and noticed his toyota rav-4 at a number of the fire locations. james bishop created back in december. in it, he describes himself as a struggling artist who has been down on his luck for 10 years. he was trying to raise money to get books published. nobody donated to his cause. ( mark ) a south bay family is mourning the loss of a 6-year-old boy who died after contracting meningitis. jayden brizuela passed away on tuesday after getting sick several weeks ago. he wasn't diagnosed with meningitis until last week, and his family says it was too late. doctors first gave jayden medication when his mother thought he had a cold. over the next few weeks he was in and out of urgent care as his symptoms got worse. on friday, he was taken to santa clara valley medical center where they checked jayden's spinal fluid and discovered he had bacterial meningitis. just a few days later he fell into a coma and then passed away. jayden's family say they are frustrated the meningitis wasn't discovered sooner.

( darya ) a north bay neighborhood is in disbelief after two people found dead inside their home. we first broke this story yesterday on the kron 4 morning news. the bodies were discovered at a home off of atherton avenue in novato. family members who were visiting the elderly couple found the two dead inside their home and called police. sheriff's deputies say the two people died from gunshot wounds and they are investigating it as a possible murder- suicide. the

( darya ) more money is being offered to help catch a dog killer. jameson animal rescue ranch in the napa valley says it has teamed up with two other north bay non- profit groups. they are offering a combined 10- thousand dollars for information to solve what appears to be an animal cruelty case. three months ago -- a woman discovered the mutilated remains of as many as a dozen dogs left in bags off columbus parkway in vallejo. ( mark ) supervisors in san francisco are also considering new ways for people to pay for city fees and fines. the city's task force wants to base a ticket amount on a person's ability to pay... instead of setting the same cash amount for everyone regardless of income. they found traffic tickets in california are some of the highest in the country. four million people in the state have had their driver's licenses suspended because they could not afford to pay the fines. the task force recommends that the city offer community service options and flexible payment plans. there is a separate plan moving through the state legislature to base traffic fines on a person's income. ( mark ) bart is taking action to make sure riders do not get stuck in the dark during a power outage. bart installed new batteries to power the backup emergency

lights. this comes after a p-g-and e outage left riders in the dark at the montgomery bart station last month. bart says an investigation revealed 14-stations did not have emergency lights. that information came out despite the fact that inspection reports indicated that the systems had been tested and were working correctly. bart says some of its employees were not doing their jobs properly. ( mark ) new batteries are now in place in six of the stations. a temporary fix is in place at the others until new batteries can be installed at all of the stations. ( mark ) a jury has acquitted a white oklahoma police officer in the shooting death of an unarmed black man. and protests broke out overnight in response to the verdict. tulsa officer betty jo shelby was found not guilty yesterday of first-degree manslaughter. terence crutcher was shot and killed in september and it was all captured on camera. shelby testified that she fired out of fear because she said crutcher did not obey her commands and thought he was reaching for something in his s-u-v. prosecutors argued that shelby overreacted and pointed out that crutcher had his hands in the air. crutcher's family is outraged over the verdict.

florida worked together to save an elderly horse that got stuck in a deep mud pit. crews were unable to break the 25-year-old horse free of the mud's suction. heavy equipment was brought in to remove her using paddle straps. the horse had to be sedated during the rescue. vets revived her after about 30 minutes. she had no broken bones and was able to walk on her own after a few minutes. president trump and attorney general jeff sessions yesterday. the three other people who also went to the white house for interviews were: former oklahoma governor frank keating. former top f-b-i official richard mcfeely. and the bureau's acting director andrew mccabe ( darya ) one person is recovering after being stabbed at dolores park in san francisco. police say the attackers were a group of five to six juveniles. they stabbed the victim multiple times before running off last night. the victim was taken to the hospital but there is no word on their condition this morning. ( mark ) a man who police say is responsible for a series of car fires in the east bay is set to appear in court today. 36-year-old james bishop the third is being charged with over two dozen counts of arson. police say he set several cars on fire in lafayette, brentwood, walnut creek, and pleasant hill. authorities say the fires became more frequent starting in april... but date back to the beginning of the year. bishop was linked to the fires when investigators looked at surveillance video and noticed his toyota rav-4

( mark ) and kron four came across a go-fund-me page james bishop created back in december. in it, he describes himself as a struggling artist who has been down on his luck for 10 years. he was trying to raise money to get books published. nobody donated to his ( darya ) sad news this morning for rock fans... chris cornell...the lead singer of the bands soundgarden and audioslave has died at the age of 52. a representative for cornell says that the grammy-winning singer passed away last night in detroit, where sound-garden was performing. the band had just begun a u-s tour in april. cornell's representative said the singer's passing was sudden and unexpected. there's no word yet on the cause of death. ( darya ) two people found dead at a home in the north bay and now it is being investigated as a murder suicide. we first broke this story yesterday on the kron 4 morning news. the bodies were discovered at a

home off of atherton avenue in novato. family members who were visiting the elderly couple found the two dead inside their home and called police. sheriff's deputies say the two people died from gunshot wounds. the couples names have not yet been released. criminalize a disturbing practice during sex called "stealthing." that is where somoene removes a condom without permission during intercourse. lawmakers say exposing partners to the risk of a sexually transmitted disease or unwanted pregnancy without their knowledge amounts to sexual assault. the proposal would require partners to consent to removing contraceptive devices. a state representative introduced the bill this week. bart station last month. bart says an investigation revealed 14-stations did not have emergency lights. which was odd because recent inspection reports indicated the systems had been tested and were working correctly. how could that be? bart says, obviously, some of its employees weren't doing their jobs. ( james @ land ) new batteries are now in place in six of the stations. a temporary fix is in place at the others until new batteries can be installed at all of the stations. ( darya ) happening today... university of california officials are considering a proposal to cap undergraduate out-of state enrollment to 18-percent. the move is an effort to prioritize in-state applicants.

the board of regents is also discussing a controversial audit on the u-c system. it found that u-c administrators hid 175-million- dollars in a secret reserve fund and that the presidnet's office interfered with the audit process. u-c president janet napolitano denied her office improperly stashed money. ( darya ) the bay area air quality management district has issued four violations to the chevron refinery in richmond over a flaring incident in december. the flaring led to dozens of complaints about a bad odor. the district issued the refinery two citations for excess levels of hydrogen sulfide detected by ground-level monitoring equipment. they also issued two violations for creating a public nuisance. ( mark ) the number of people arrested by immigration agents has increased dramatically during the trump administration. u-s immigration and customs enforcement says arrests are up nearly 40-percent compared

to last year. arrests of immigrants with no criminal convictions more than doubled. however, the number of people deported from the u-s has declined under president trump. the president signed executive orders to boost deportations back in january. ( mark ) a san jose family is mourning the loss of a 6- year-old boy who died after contracting meningitis. jayden brizuela passed away on tuesday after getting sick several weeks ago. kron 4's charles clifford spoke with the devastated family. by all accounts, 6-year-old jayden brizuela was a wonderful little boy. his aunt, monica aguilar, says he was an only child and the light of his mother's life.sot but last month, jayden fell ill and his mom took him to the doctor.sot over the next few weeks jayden was in and out of multiple hospitals, urgent cares and doctor's offices. he would get worse then get better and then worse again. last friday jayden loudly complained of a severe headache and his mother

took him to an emergency room. a check of his spinal fluid revealed jayden had bacterial meningitis, a very serious infection that kills about 500 people nationwide every year. standupjayden's devastated family is now left with more questions than answers. they don't know how he contracted the meningitis and they're frustrated that it took so long to get a correct diagnosis. while they are happy with the care jayden eventually received at valley medical center, they are troubled that so many doctors and nurses couldn't find the problem sooner.sot

to gisele bundchen's claims that her husband, tom brady, suffered a concusion last year. the n-f-l released a statement saying there is no evidence that the new england patriots quarterback experienced any kind of head injury last year.( darya ) yesterday she said her hasbund has had multiple concussions over the course of his career. brady has never been listed on any injury report with a concussion in his 17-year career.( mark ) just hours after her comments, two retired n-f-l stars, leonard marshall and matt hasselback announced they would be donating their brains to scientists for c-t-e research. ( darya ) we are learning about new health risks of e- cigarettes. e-cigarettes are tied to an increased risk for bladder cancer. that is according to a new study from vanderbuilt university.( mark ) researchers looked for five chemicals known to cause bladder cancer that may be found in e-cigarette liquid. it found 92-percent of e- cigarette users' urine tested positive for two of those chemicals. ( darya ) the finding contradicts a recent study that claimed e- cigarettes do not cause cancer at any nicotine dose.

( mark ) san francisco is planning to go high-tech at its 22 parking facilities. the city is going to upgrade the parking structures over the next three years and add features such as license plate readers. it will show who comes and goes... and could help drivers who lose their parking tickets. there also will be a pre-pay feature so drivers can avoid long lines. the payment system will also be upgraded. the city says it will also install credit card chip readers to help prevent ( darya ) supervisors ( darya ) supervisors in san francisco are also considering new ways for people to pay for city fees and fines. the city's task force wants to base a ticket amount on a person's ability to pay... instead of setting the same cash amount for everyone regardless of income. they found traffic tickets in california are some of the highest in the country. four million people in the state have had their driver's licenses suspended because they could not afford to pay

firefighters put out a fire at a former auto parts store in san jose.( darya ) kron four's averi harper is live outside the building. averi? ( averi ) firefighters put out a two-alarm blaze at an abandoned building in san jose, fire officials said. according to san jose fire capt. mike van elgort, at 3:02 a.m. fire crews were dispatched to an abandoned building at 1064 s. white road. the building is the former location of an o'reilly auto parts store. there are no reports of injuries and the cause is under investigation, van elgort said. further details were not immediately available. ( james ) the lead detective who oversaw key parts of the investigation into the missing teen... was recently found by a judge to have given false testimony in an unrelated murder trial. in that case, the testimony of sargent herman leon, lead to the conviction of two men for a 2009 murder. a judge has now ordered a new trial in that case. and in light of this revelation... defense attorneys for antolin garcia- torres are now looking to discredit his testimony in the sierra lamar case, too. sargent leon is the one who

tulsa officer betty jo shelby was found not guilty yesterday of first-degree manslaughter. terence crutcher was shot and killed in september and it was all captured on camera. shelby testified that she fired out of fear because she said crutcher did not obey her commands and thought he was reaching for something in his s-u-v. prosecutors argued that shelby overreacted and pointed out that crutcher had his hands in the air. crutcher's family is outraged over the verdict. ( mark ) last night there were some protests in downtown tulsa over the verdict.
