pleasanton police say they found malihan in a ditch. her blood-alcohol level was nearly 3 times the legal limit. according to the arresting officer, she had planned to pick up and drive her children home from school. upgrade its aging fleet of diesel trains to faster, more efficient electric ones. the project includes buying the new trains and installing overhead electric lines that will stretch from san jose to san francisco.sot says this is going to allow for trains that move faster. that accelerate and decelerate faster. that have a higher capacity and are generally just more modern.> the entire project will cost just shy of 2 billion dollars. caltrain had secured most of the needed money through federal, state and local funding, but was still short by about 647 million dollars. after reviewing the project, the us department of transportation and the trump administration have approved a full funding grant agreement which will give caltrain what it needs.sot

( robin ) this morning we continue to follow breaking news out of machester, england. at least 22 people are dead and dozens of others injured including children after a terrorist attack at an ariana grande concert. and we are just learning police have arrested a 23-year-old man in connection to the attack. reid binion has the latest. a deadly explosion -- rocking an area outside of england's manchester arena monday night......as concertgoers left a show by pop singer ariana grande.inside the venue - there was confusion, a crescendo of screaming, then panic.a flood of terrified concert-goers -- fleeing from the arena... as sirens flooded the air outside.the blast rocked the area just after grande had finished up her show...andy james / concert goer: "it was just horrific."

to convince witnesses that the little boy belonged to her. officers say the woman and the victims did not know each other. ( robin ) security was tightened in and around the ferry building following the ( robin ) a man is behind bars this morning after an hours long standoff in the east bay. police say he fired shots at people living inside an antioch home. police went to a home on saint francis drive around noon yesterday. three people living in that home say they were shot at. no one was hit. the suspected gunman was found in a nearby home. a swat team was able to convince the man to surrender just before 10:00 last night. ( robin ) pesticides and a life of domestic violence are to blame for convicted killer

antolin garcia torres's actions according to his defense team. this all as the penalty phase continues. kron four's ella sogomonian reports. now that antolin garcia torres is found guilty of murdering south bay teen sierra lamar - the jury has to decide whether he gets life in prison or the death penalty. in his defense garcia torres's lawyers brought his mother to the stand on monday in the sentencing phase of the trial. she and garcia torres's attorneys claim a life of domestic violence and his mother's exposure to farm chemicals while she was working in the fields while pregnant with him are to blame for his actions.sot: curtis briggs, attorney//"because his life is on the line any mitigating factor is important for his attorneys to bring up. in fact they are required by law to bring up anything that would affect his mental capacity."briggs says pesticides are commonly brought up by defense teams in an effort to spare a defendant's life.sot: curtis briggs, attorney//"case law and appellate law supports that when somebody has been exposed to pesticides the

attorneys need to bring it up." while child victim's advocate marc klaas feels these are excuses the jury should dismiss in order to bring justice to lamar's family.sot: marc klaas, klaas kids foundation//"logically you would have to go out and find every other child exposed and lock them up to prevent them from committing the exact same crime. this is really about his responsibility he failed to act on a moral compass and for that he deserves the ultimate penalty."briggs says the defense is likely to bring medical experts as witnesses in days to their case. ( robin ) in the south bay... police say a san jose state university football player is in the hospital after being stabbed. the incident happened early sunday morning near the corner of post and south first streets that's just three -blocks away from the university's campus. university officials identified the victim as chad miller. police have not made any arrests in this incident. san jose state university has made a statement regarding chad miller. it reads- quote: - " he is hospitalized and is expected to recover. our

purchased at a gas station.. the cheese is now linked to a botulism outbreak in sacramento county. justine waldman is tracking the latest. n a go fund me page, the family of martin galindo.. says they are now planning his funeral.taken off life- support last week he died from a rare case of botulism. the father of two from antioch was 37-years old.the california department of public health has now confirmed one person died from botulism.. linked to nacho- cheese dip sold at valley oak food and fuel in walnut grove.. botulism is a rare nerve paralyzing illness caused by toxins.the chief communicable diesease doctor at the department of public health explained in an audio email how the snack dip could have become contaminated. sot dr. james watt / cdph"the toxin that causes botulism can be found in foods that are not properly process or stored. it is odorless and colorless so it is not possible to tell if

a food has it just by looking at it"the state health department knows 10 people got sick from the nacho cheese. including 33-year old lavinia kelly.the mother of 3, pulled over for a snack at the gas station last month.within hours she had double vision, slurred speech and muscle weakness all symptoms of the fatal form of food poisoning. she is now in the hospital in the icu. ( robin ) a union city man accused of trying to set several dennys customers on fire in hayward made his first court appearance. 43 year old victor rubio is facing seven counts of assault, a count of child endangerment and a count of attempting to set a fire. last wednesday police say rubio was inside dennys when he poured gasoline on himself and six other customers. according to court documents,

rubio told police that voices told him to do it and that people were out to kill him. after not being able start a fire with a cigarette -- customers forced him out of the restaurant and police arrested him. he has not yet entered a plea. driver's the silver mercedes s-u-v was found on davidson avenue and rankin in the san francisco's bayvew district, completely stripped. even the tires were gone. chai's wife says there was no reason for him to be in that area.my husbands car to be found in that kind of place it points directions to foul play for me. find of the car gets me very very high hope that my husband is still alive being kept somewhere we just need to go find himpolice detectives came to the house to collect chhay computer and ipad, as well as his toothbrush and razor so they can make up a d-n-a profile. according to uber the missing driver was not working for them at the time he went missing.. husband to be missing we've been married for 20 years and altogether for 24 years. and not one day that he left without calling without letting us know where he's at. nine days now it's absolutely hell.maureen kelly kron4 news ( robin ) police in southern california say they were forced to shoot a 16- year-old boy. police in la ha-bra... say they received a call that the boy was threatening his mom with a gun. when police got to the scene, the teen had already left. but his mom said he still had the gun with him. he was later found at a playground. police say he pointed his gun at them and one officer fired his gun. the boy was taken to the hospital. his condition has not been released. ( robin ) a group of lingerie thieves that's connected to the on-going victoria's secret theft investigation led police to a high speed chase to santa cruz. the four women from oakland were arrested at gunpoint on highway 17 near scotts valley yeserday.

( darya ) the wife of an alameda county sheriff's deputy accused in a deadly d-u-i crash is expected to enter a plea in court today. it happened eight months ago on interstate 680 in san ramon and left a three -year old boy dead. yarenit malihan turned herself into police in dublin yesterday. malihan's charged with vehicular manslaughter while intoxicated and driving under the influence. two weeks ago, pleasanton police say they found malihan in a ditch. her blood-alcohol level was nearly 3 times the legal limit. according to the arresting officer, she had planned to pick up and drive her children home from school. ( mark ) san francisco police arrest a woman after she tried to snatch a child out of his mother's arms. it happened yesterday morning inside the ferry building on the embarcadero. bystanders helped the mother and her little boy and were able to stop the kidnapping. police say the woman tried to convince witnesses that the

( darya ) a man is behind bars this morning after an hours long standoff in the east bay. police say he fired shots at people living inside an antioch home. police went to a home on saint francis drive around noon yesterday. three people living in that home say they were shot at. no one was hit. the suspected gunman was found in a nearby home. a swat team was able to convince the man to surrender just before 10:00 last night.

( mark ) the penalty phase continues for the man convicted of killing sierra lamar. and this morning antolin garcia torres's defense team says exposure to pesticides and domestic violence contributed to his actions. garcia torres's mother took the stand yesterday. she says her exposure to farm chemicals from working in fields while pregnant with him could have affected his mental capacity. she also says garcia torres was exposed to domestic violence while growing up. child victim's advocate marc klaas says these are excuses the jury should dismiss in order to bring justice to lamar's family. ( darya ) a woman from albany is filing a lawsuit against bart. she claims that the mobile app used for reporting crimes to bart police has secretly been collecting people's private cell phone information. the lawsuit claims that the bart watch app collects a user's cellphone identification number and other identifying data. according to the lawsuit... the app violates several state laws. a bart spokesperson says the app is not used to track users and that privacy of the riders is one of bart's priorities. a lawsuit has also been filed against the

( darya ) another person has been arrested in connection to the death of an elderly san jose woman who was murdered in her home. perla arre-loa was taken into custody after police say she tried to hide evidence. the 20-year-old has been charged with accessory to murder and for conspiracy to obstruct justice. flo douglas also known as "miss flo" died in september after being brutally assaulted. zachary cuen has been charged with her murder. his girlfriend...jennifer jiminez was arrested in march. she's accused of hiding evidence related to the murder. ( mark ) the father of a michigan tourist who was killed by an out-of-control driver in times square is thanking new yorkers for all their support. the father went to visit his daughter alyssa elsman's memorial in

new york city. the 18-year-old was killed and 20 others were injured when 26-year-old richard rojas barreled his car through times square. in a note, alyssa's father thanks police and medical staff who helped his daughter, as well as the countless others who have left condolences to his family. alyssa was visiting new york city with her family at the time of the crash. rojas has been arraigned on murder charges. ( mark ) police in southern california say they were forced to shoot a 16- year-old boy. police in la habra... say they received a call that the boy was threatening his mom with a gun. when police got to the scene, the teen had already left. but his mom said he still had the gun with him. he was later found at a playground. police say he pointed his gun at them and one officer fired his gun. the boy was taken to the hospital. his condition has not been released. alert this morning... a 12-year-old girl is sexually assaulted at a 7-eleven store in fairfield. 30-year-old luis mendoza- navarro is behind bars right now. the incident happened last week when a mother was inside the store with her daughter the woman says navarro groped her 12-year-old daughter right in front of her. she says when she yelled at the man, he denied what he had just done. yesterday. people along streams in the sierra are asked to use extra caution around the water. the flood watch is in effect through tomorrow ( mark ) san francisco police arrest a woman after she tried to snatch a child out of his mother's arms. it happened yesterday morning inside the ferry building on the embarcadero. bystanders helped the mother and her little boy and were able to stop the kidnapping. police say the woman tried to convince witnesses that the little boy belonged to her. officers say the woman and the victims did not know each other. ( mark ) security was tightened in and around the ferry building following the incident. ( darya ) oj simpson could be released this year on parole after spending nearly a decade behind bars. simpson is scheduled for a parole hearing in july. the former n-f-l star turned

( mark ) a man is behind bars this morning after an hours long standoff in the east bay. police say he fired shots at people inside an antioch home. police went to a home on saint francis drive around noon yesterday. three people living in that home say they were shot at. no one was hit. the suspected gunman was found in a nearby home. a swat team was able to convince the man to surrender just before 10:00 last night. ( mark ) the penalty phase continues for the man convicted of killing sierra lamar. and this morning antolin garcia torres's defense team says exposure to pesticides and domestic violence contributed to his actions. garcia torres's mother took the stand yesterday. she says her exposure to farm chemicals from working in fields while pregnant with him could have affected his mental capacity. she also says garcia torres was exposed to domestic violence while growing up. child victim's advocate marc klaas says these are excuses the jury should dismiss in order to bring justice to lamar's family.

( darya ) a woman from albany is filing a lawsuit against bart. she claims that the mobile app used for reporting crimes to bart police has secretly been collecting people's private cell phone information. the lawsuit claims that the bart watch app collects a user's cellphone identification number and other identifying data. according to the lawsuit... the app violates several state laws. a bart spokesperson says the app is not used to track users and that privacy of the riders is one of bart's priorities. a lawsuit has also been filed against the software company that makes the app.

( mark ) the white house is expected to release its budget for 20-18. a senior administration official says the budget will include eight hundred billion in cuts to medicaid. that is because the budget assumes the g-o-p health care bill will eventually become law. the president's budget is also expected to include a plan to give six weeks of paid leave to families after the birth or adoption of a child. also expected in the budget... changes to anti-poverty programs giving states new powers to limit certain benefits. ( mark ) the trump administration is proposing to eliminate subsidized student loans and end student debt forgiveness for those who enter public service. the proposals are likely to face criticism amid calls to make college more affordable as millions of people are struggling to pay off student loans. in a budget document released yesterday, the administration seeks to save over one-billion dollars by doing away with the subsidized student loan program. that is for undergraduate students who qualify-- the government pays the interest while they remain in college. who's been missing more than a week has been found. the wife of piseth chhay says police found his mercedes s-u-v in san francisco's bayview district completely stripped. even the tires were gone. chhay has not been seen since mother's day when he left his home in san francisco to help a friend.

accused of trying to set several dennys customers on fire in hayward made his first court appearance. 43 year old victor rubio is facing seven counts of assault, a count of child endangerment and a count of attempting to set a fire. last wednesday police say rubio was inside dennys when he poured gasoline on himself and six other customers. according to court documents, rubio told police that voices told him to do it and that people were out to kill him. after not being able start a fire with a cigarette -- customers forced him out of the restaurant and police arrested him. he has not yet entered a plea. ( darya ) a long planned upgrade to cal-train has received a major financial boost. the federal government has approved money that will allow caltrain to upgrade its system. the project includes buying the new trains and installing overhead electric lines that will stretch from san jose to san francisco. this will allow for new trains that move faster and can hold more people. after reviewing the project, the u-s department of transportation has approved about 650 million dollars to complete the

( mark ) a man is arrested after leaving a dog and her nine puppies in a hot car in concord. three of those puppies died. the dogs were found in a car on clayton road on wednesday. police arrested the dogs' caretaker, 55-year-old clifford gough. the mother, princess, and her puppies were taken to the contra costa animal services. police want to remind you that under a new california law, if you see a dog in distress in a hot car you can break in to save it without fear of being held liable for damage.

( darya ) the father of a michigan tourist who was killed by an out-of-control driver in times square is thanking new yorkers for all their support. the father went to visit his daughter alyssa elsman's memorial in new york city. the 18-year-old was killed and 20 others were injured when 26-year-old richard rojas barreled his car through times square. in a note, alyssa's father thanks police and medical staff who helped his daughter, as well as the countless others who have left condolences to his family. alyssa was visiting new york city with her family at the time of the crash. rojas has been arraigned on murder charges. ( darya ) state lawmakers passed a bill to strenghten gun laws in schools. the california assembly passed the bill yesterday, sending the measure to the state senate. it revokes superintendents'
