(terisa estacio reporting) 41 year old yarenit malihan - the east bay mom and wife of an alameda county sheriff's deputy now in custody made her first appearance in a contra costa county courthouse tuesday after surrending monday charged in this dui crash where 3 year old elijah dunn was killed. alison chandler. "good morning ms. malihan, you need to come to the window so i can see you." that is contra costa deputy district attorney alison chandler instructing malihan to show herself during the arraignment. cameras were allowed in the courtroom for this hearing, but the entire time, malihan hid behind wall and behind her defense attorney joshua olander.

chandler. "do you understand both of these rights?" a snapshot did capture this image of malihan wearing glasses peaking out from a glass partition. she entered a not guilty plea in the case where her suv crashed into elijah's mothers car stalled out on 680 last fall. judge. "bail is set at 3 million dollars." malihan remains in custody on a 3 million dollar bail set by the judge last friday when an arrest warrant was issued in the dui crash. in court documents, obtained by kron four news, prosecutors had harsh words for the mother calling her quote " major risk of public safety." in this last year, yarenit has been arrested 3 times for being intoxicated. last june, her own children called 911 after she picked up one of them intoxicated. then in september, the fatal dui accident of 3 year old elijah on 680. and then most recently on may 12, she was discovered in a ditch in pleasanton at this intersection. her blood level nearly 3 times the legal limit. at the time, she reportedly told the arresting officer she planned to pick up her children from school and drive them home. kron four has learned, malihan's license

was suspended then revoked in december of 2016. terisa estacio, reporting. yarenit malihan is facing 2 counts gross vehicular manslaughter and dui causing injury. if convicted she could be facing 11 years in prison. she will be back in court on june 15 where a preliminary hearing for trial could be set. in contra costa county, te kron four news (vicki) police in san francisco have made an arrest after a bomb threat forced the evacuation of a school. 22 year-old pablo munoz was arrested on two counts of felony threats and two counts of misdemeanor false reporting of a bomb. he was working as an assistant teacher leport montessori school on fell street. police received the bomb threats on two separate occasions. after

a sweep of the school, no bombs were found. classes have since resumed. (grant) the closing arguments began today in the trial of three santa clara county correctional officers charged with beating a mentally ill inmate to death. jereh lubrin, rafael rodriguez and matthew farris allegedly beat michael tyree august of 20-15. tyree was found dead in his cell with a ruptured spleen the morning after. the defense claims his death was a suicide... suggesting tyree jumped into the sink in his cell rupturing his organs. the defendants are also facing charges of beating a second mentally ill inmate the same night. if convicted-- all three defendants could face life in prison. (philippe) an 11-year-old boy and his younger sister frightened late saturday morning...derek cole/neighbor- "you hear a lot of stories like this and its um, its just scary nowadays -- very scary." oakley police sergeant robert roberts says there were plenty of witnesses at oakley elementary school that day. while east county little league games were being played on the baseball diamond... roberts says a man drove through the parking lot and up to the playground -- where the young boy and his sister were on the swings.sgt. robert roberts/oakley police dept.- "an adult male -- hispanic male, uh, ended up asking one of the kids if he wanted to go for a ride." that's when sergeant roberts says the boy grabbed his sister, and ran to their parents who then called police. the man drove off -- never getting out of his car. derek cole lives across the street and has a 12-year-old son.derek cole/neighbor- "you know, i kind of tell my son, if you've got that gut instinct, go with it and main thing, just get away and try to find an adult."

(vicki) an employee was shot during a robbery at a restaurant in san leandro early this morning. it happened at sams best burger just before 3am.... on east 14th street.. police say an armed man wearing a ski

mask robbed the restaurant.... then after he got the cash he shot one of the employees twice in the leg... it just so happens that a police officer was parked about a block away and heard commotion... when he got there the gunman had run off. police say this is an odd case because the gunman had already taken the money and still shot the employee. police never found the gunman but they do believe he left the area.as for the victim, he is expected to recover. (grant) in monterey county... a massive landslide has covered roughly 15-hundred feet of highway 1 in the big sur area. that section of the highway is now

under more than one-million tons of rock and dirt. five smaller landslides combined to make this massive landslide saturday evening. the portion of the slide covering highway 1 is estimated to be 35 to 40 feet deep. caltrans officials say they have to wait for the area to become more stable before they can assess the damage. there is no word on when the highway will re-open. state officals are now estimating the damage from this winter's storms has topped one-billion dollars for the first time in california history. settlement after a massive data breach in 2013. 47 states have reached an nearly 19 million dollar settlement with the company...califonria is among the states to get money...the golden state actually gets the most money...pne-point-four million. but target customers will not see a dime. that money will be used to better enforce cunsumer protection laws. this is the largest multistate data breach settlement in history.the breach affected more than 41 million customers. the settlement requires target to take extra security steps. ( steve ) this morning, the alameda sherriffs deputies wife facing charges of killing a 3 year old boy in a fatal dui crash entered a plea in court today. yarenit malihan sat behind glass partition in court. cameras were allowed in the proceeding, but malihan stayed behind the glass out of view for the entire hearing, barely speaking up when asked by the prosecutor. the 41 year old east bay mom and wife of an alameda county sheriff's deputy is facing charges for the fatal dui car crash where 3 year old elijah dunn was killed. the judge jail kept the bail at 3 million dollars and she remains in custody. contra costa deputy district attorney alison chandler talked about the charges and what happens next after the hearing.

(pam) a 20- year-old woman from discovery bay was shot to death.... following an argument in richmond... and police say they need help trying to find her killer investigators say, alexandrea sweitzer was shot multiple times last thursday around 8:45-pm ... in the parking lot of the booker t. anderson community center. richmond police say, an unknown person drove her to a local hospital where she later died

kron4's maureen kelly explains. delays and cancellations are in the forecast for this weekend....the reason....sfo will be closing one of it's two main runways for repaving. during previous weekend closures we've seen up to 100 cancellations in a dayand delays on average of 30-90 minutes....the repaving work has been underway since the spring....originally memorial day was not going to be one of the 9 weekends scheduled for the runway to shut down but rain and wind forced cancellations of two of those weekends....and sfo and the airlines want to get the work down before the really busy summer travel time kicks in...so now those flying in on the weekend many consider to the kickoff to summer....will be dealing with winter like flight traffic at sfo. we do this closure we go down from two runways for landing to essentially one so in terms of operational it back it's very similar to the conditions during winter storm in terms of the potential for delays and cancellationsi've got some great things to do i'm in san francisco and losing any time off of this great weekend will

be a real bummer i talked to nancy mcgraw via facetime who is flying into sfo saturday for a mini vacation. seems like they could pick a different time then a busy holiday weekend to get this work done. there's got to be time late at night or during the week when there's less people traveling.the sfo spokesperson says some of the job is done overnight but they really need long stretches of dry weather to do the major work.it's the equivalent of us paving four lanes of highway 101 for 10 miles that's how much it is involved in(maureen) sfo says they are trying to minimize the impact to fliers by keeping the work to the quietest travel time during the holday weekend. the shutdown begins at 10pm friday night and is scheduled to reopen monday morning at 8am....maureen kelly kron4 news. bart's "seat hog" ordinance may be going away before it even takes effect. passed last year, it was

suppose to fine people who take up more than one seat on the trains. kron 4 today asked bart about the status of the ordinance, and a board member responded it has not been implemented yet. in fact, the board is going to reconsider the measure next month and could disappear all together. the ordinance would fine "seat hogs" 100 dollars. concord is going to become the latest bay area city.... to take up the legalization of marijuana for recreational use. the city is going to hold a meeting tomorrow night, to go over its current rules and consider new ones. concord currently has a ban on dispensiaries ... as well as outdoor grows. but with the passage of proposition- 64 last november, it is legal for people to grow six plants at home. cities are allowed to place regulations... when it comes to growing marijuana the meeting is set for 6 p-m tomorrow ... at the city council chambers. police are looking into whether or not four women from

the east bay are behind a string of theft at victoria's secret stores. they were arrested yesterday after running into a store in capitola and then leading police on a chase. officers say the group grabbed about 12-hundred dollars in merchandise in the latest caper. investigators say the women have targeted the capitola store several times over the last several weeks. the suspects' names have not been released. the crime is similar to ones we told you about earlier this year at new park mall in newark. the victoria's secret store there has been hit at least six times since last year. each time, the suspects have all run in and grabbed merchandise before dashing out the mall doors. in some instances the thefts have totaled thousands of dollars. no arrests have been made in those cases. investigators say they may be different groups targeting the newark store because of the descriptions of the getaway car. (pam) chaos erupts in merced county ... when a tanker- truck overturns. . . causing a massive fire and explosions.

it happened just off highway- 99... at around 10- this morning.cal fire officials say, the truck was carrying thousands of gallons of gasoline. they say, the truck ran off the highway... before overturning near applegate road.that then set off a massive fire and a series of fiery blasts. people scrambled out of local businesses... several were evacuated.the truck driver died at the scene.no word yet on what caused the crash. let's take a look outside right now for the current conditions in the bay area... in monterey county... a massive landslide has covered roughly 15-hundred feet of highway- 1 ... in the big sur area. cal-trans officials say, that section of the highway is now under more than one-million tons of rock and dirt. according to officials -- five smaller landslides combined to make this massive landslide saturday evening. the portion of the slide covering highway -1 is estimated to be 35- to 40- feet deep. cal-trans officials say, they have to wait for the area to become stable to assess the damage. there is no word on when the highway will

(steve) san rafael police are searching for a man they believe attempted to sexually assault a woman while was sleeping earlier this month. it happened around 2-45 in an apartment complex on cresta way. authorities say the woman woke up to a man shining a flashlight in her eyes. the woman's boyfriend-- who was in the bed with her-- chased after the suspect but lost sight of him once outside. the suspect is described as a white man in his 30s-- about five feet 11 inches tall with short, dark hair.
