(vicki) breaking news - just into the kron four newsroom. napa county health officials confirm - there's been a second death related to botulism. however, this recent death is not connected to the botulism outbreak in sacramento county. health officials say the victim is a man - but has yet to release more information on him or when he died. the death remain under investigation. health officials say there is no ongoing threat to the public. (vicki) this is the second botulism related death - reported here in the bay area. a man in antioch died after eating nacho cheese dip purchased at a gas station... in sacramento county. california health officials confirmed - the presence of the botulism toxin - in one of the bags of cheese sold at that gas station. nine others also got sick. botulism is a rare foodborne bacteria - and can paralyzes the nerves so the muscles can not contract.

(grant) an update now to a story we first brought to you last night at five... a woman...with a fake beard... arrested in connection to a bank robbery in danville - has been identified as a former southern california police officer. the robbery happened yesterday morning at the bank of the west branch on diablo road. police say jennifer rae mc-clary, entered the bank wearing a baseball cap and had a beard painted on her face. the 36-year-old allegedly handed a note demanding money - and then took off... however, she was arrested yesterday afternoon. placentia police confirmed mc-clary was a former officer in the department, although they're not saying when she worked there...and why she left. (grant) an update now on the sexual assault charges against a de la salle high school football player in concord... the assault was november 18th...after a game on de la salle's campus......and this week a juvenile court reached the

decision...that the crime was in fact committed. the un- named, 15-year-old freshman football player sexually assaulted a girl from a neighboring high school. the suspect is facing up to 10 years of confinement. it's too early to say whether he'll be required to register as a sex offender. (vicki) a fedex driver is now behind bars. he's being accused of breaking into several east bay homes. as kron four's terisa estacio reports - this is not the first time, this east bay man has been in trouble with the law. (estacio reporting) the first burglarly in this case involving a fedex driver happened in atherton- on orchard hills drive on may 3. steve wagstaff, san mateo district attorney. "he was really a predator. steve wagstaffee is san mateo's district attorney. he explained how they finally caught up and arrested fedex driver 57 year old kevin baker out of hayward.wagstaffe. "it was good old work and tracking surveillance cameras and electronics." baker has a criminal background.

"you would think they would do a better job vetting their people, you would think, yeah." out on the route near the homes hit, we talked with some fedex and ups drivers. they wouldn't go on camera, but both said they knew baker and were very surprised to find out about his arrest. neighbor. "they all have signs on them." sink was surprised baker risked breaking because so many homes have alarms and surveillance cameras in the neighborhoods neighbor, "you wouldn't catch me doing that." terisa estacio, reporting. as far as baker, he remains in jail. he entred a not guilty plea wedesdnay afternoon. if convicted, the da says he could face life in prison due to his prior convictions. (vicki) we now know the name of the man shot and killed in san jose . police have identified the victim has george garza. they say the 38-year-old was gunned down thursday night in the area of south first street and edwards avenue...in front of the weinerschnitzel restaurant. officers arrived and found garza suffering from at least one gunshot. he was taken to a hospital where he died from his injures. no arrest have have been made. the homicide marks the 12th in san jose so far this year. (glo) the city of monterey is receiving relief money... for last year's destructive soberanes fire. the california office of emergency services has given the city more than 300-thousand dollars. the blaze started last july... resulting from an illegal campfire in garrapata state park. it was the most expensive wildfire in u-s history. it burned more than 130-thousand acres.... and took around 5-thousand fire firefighters to put out. (grant) construction crews in butte county have begun demolishing the destroyed portion of the main spillway at lake oroville. you may remember kron4 reported back in febuary...that huge chunks of the main spillway began washing away. and when a second emergeny spillway also began giving wayauthorities ordered the temporary evacuation of 188 thousanf people downstream. crews aim to replace the lower

(vicki) alamo square park in san francisco is officially back open. the park overlooking the "painted ladies" has been closed for more than a year for renovation. it's reopening was delayed because of the rain this winter. the san francisco landmark has undergone a more than five million dollar renovation that... was necessary because of an aging irrigation system. park officials say the park will be one of the most-water efficient open spaces in the city. phil ginsburg, san francisco recreation and parks department: "it most fundamentally it started as a water conservation project, the most water wasting park in our system and with support of our public utilties commission we have a completely modernized irrigation and drainage system to make sure we save water and make sure this park thrives. there is nothing more iconic then the view over my shoulder, the painted ladies followed by the skyline in the background and i think that is so poetic for san francisco."(vicki) the parks department

say the district is demonstrating a lack of respect to deserving teachers. the district says it is operating with a budget deficit. (vicki) an elementary school in the east bay is set to close at the end of the school year. last night the alameda unified school district voted to close and demolish lum elementary school. this comes after engineers found soil under the school that may not be strong enough to with-stand an earthquake. the district has assured teachers and staff that they will have jobs at other schools. as of now, there are no plans for the property that the school sits on. (vicki) staying in the east bay... the proposal to build a high school near a county jail has been rejected. the school board in dublin and hundreds of parents held a meeting last night to go over the proposal. with the

growing student population in dublin, the school district has been searching for a new location. they say the best option would have been near the intersection of gleason drive and hacienda drive. that's about half a mile away from the alameda county jail, which worried parents. after several votes against the idea, the district will now look for a new site. now... where a cal-bears rugby player partially paralyzed during a match earlier this month is reocvering in san jose. shortly after suffering the injury... 20-year-old robert paylor underwent surgery at santa clara valley medical center to repair a damaged disc in his spine. doctor's say he has complete sensation throughout his spine and has some movement in his biceps, fingers and toes... but that he faces an extended rehab, set to begin this week, to possibly regain more function. dr. stephen mckeena/scvmc- "robert's very fortunate in the sense that he has an, what we call an incomplete spinal cord injury that has a great deal of potential for natural recovery."//jeff paylor/father- "he's a fighter. he's goal oriented, will never give up attitude. alls he talks about is getting into rehabilitation to get started on his recovery. he doesn't ask why this happened, or dwell on what life could be if it wasn't in this situation. at the point of injury, he just knew his life had taken a different path and he's accepted that future." robert's father
