building under construction in oakland... leaves up to 20 workers trapped in wet cement. (vicki) the accident was just after nine-30 this morning... on hawthorne avenue near broadway.(grant) that's where we find kron four's philippe djegal... who arrived on scene shortly after the initial emergency call... philippe... that's right... and, a witness tells us this could have been a whole lot worse if the wet cement was any deeper. no one died... but a dozen people were taken to hospitals. (philippe) calm one moment -- seconds later -- a loud thud.saul duran/witness- "i was afraid that someone was buried inside, you know." a witness who shot this video of the aftermath shows construction workers huddled near the front entrance of what oakland fire battalion chief ian (yan) mcwhorter says is an apartment parking garage under contruction. this is where the accident happened -- fire fighters snapped photos of what they saw.ian

mcwhorter/battalion chief- "they were only trapped up to their knees." he says by the time the oakland fire department reached the building on the 300 block of hawthorne avenue... construction workers were using shovels and planks to prop themselves on top of the wet cement 15 t0 20 workers were trapped in to help pull them out.ian mcwhorter/bat talion chief- "well, i'm sure we've all been stuck in the mud at the beach and that's approximately how it is -- kind of like quick sand." mcwhorter says the workers who fell were on the second floor of the building under contruction, pouring cement... when there was a partial collapse, and the workers fell. some were able to hang on to the scaffolding to avoid hitting the cement. mcwhorter says 12-people were taken to local hospitals with minor bruises and scraps. everyone survived.saul duran/witness- "(philippe) was it calm or was there panic? (saul) oh, it's a panic. you know, everybody was, you know, worried about the co-workers." the occupational safety and health administration is leading the investigation into the cause of the partial collapse. we're also learning more about the safety records of the construction

(grant) and we first alerted you about the building collaspe through a push alert which we sent out around 10 this morning. to get the latest breaking news - download the free kron four mobile app. (grant) jurors deliberated this morning in napa county superior court at the trial of a couple charged with the murder and torture of a 3-year-napa girl in 20-14. two separate juries are hearing evidence against sara krueger and ryan warner who are charged with the death of krueger's daughter... kayleigh slusher. prosecutors say the crime occurred at an apartment complex in napa in early 20-14. the couple faces 25 years to life in prison if convicted. a verdict has been reached in the trial for krueger, but it has not yet been released to the public. warner's case is still being deliberated. jurors will continue

deliberations tomorrow. (vicki) a man found stabbed to death yesterday morning in a san francisco park has been identified as a 33-year-old resident of the city. the medical examiner's office say giovanny alvarez was found in bernal heights park around 5-30 in the morning yesterday suffering from stab wounds. paramedics rushed to the scene but pronounced alvarez dead when they arrived. police roped off the area shortly after looking for leads. investigators are asking anyone with information on the incident to come forward. (grant) a santa cruz brain surgeon has just pleaded not guilty to ten felony charges accusing him of sexually assaulting two boys and girl under the age of 14. the doctor, james kohut, was arrested as part of an investigation into a sex abuse ring that ended up leading to charges against two nurses at his office...emily stephens and rashel brandon. court documents today say kohut had sex with two boys while the nurses were right there.

it is not clear yet if stephens and brandon have attorneys to represent them. in san jose today...the brother of nurse rashel brandon told reporters... his family is supporting her through this ordeal. (vicki) happening now... gunfire erupts - and a man was shot early today in gilroy... where police are still searching for suspects. these suspects are also believed to be connected to a string of vehicle break-ins. kron four's rob fladeboe has more on the story now live from gilroy. rob? and told him not to move...." gilroy police said the victim, not identified, was shot twice in the lower body by someone among a group of people who were breaking into a car. police sealed off the area and a chase ensued through backyards to nearby ervin court. eventually, four suspects were detained, some of whom are juveniles. rick menjivar says his neighbor was shot after he'd confrontedthe group.rick menjivar" he says, what are you doing here? you're not supposed to be here and one kid says, i'll tell you what we're doing here and pop, pop, pop, he shoots him...."police were still searching for the gun as residents told about a recent rash of vehicle break-ins in the neighborhood. there are bullet holes in this car parked in front of rick menjivar's home.yeah and my wife was standing right there behind the window so thank god she wasn't hit because there were bullets flying all over the place...."

(rob live) gilroy police said the victim was shot twice in the leg. he is out of surgery and in stabile condition. several suspects were taken in for questioning but as of this evening there is no word of any arrests. live in gilroy rob fladeboe kron 4 news (vicki) the assistant teacher accused of making a bomb threat that forced an evacuation of a school has pleaded not guilty to the crimes. 22 year-old pablo munoz was arrested on two counts of felony threats and two counts of misdemeanor false reporting of a bomb. he was working as an assistant teacher at leport montessori school on fell street. he has since been

ordered to stay away from the school and is wearing an ankle bracelet to track his movements. police received the bomb threats on two separate occasions. after a sweep of the school, no bombs were found. munoz was ordered to return to court on july 27th for a prehearing conference. (grant) a former junior college professor has been arrested after police say he beat three people with a metal bike lock during a protest in berkeley earlier this year. 28-year-old eric clanton was arrested in oakland for assault with a deadly weapon. clanton remains in custody tonight on 200 thousand dollars bail. officers say a video posted to social media helped identify clanton as a suspect. 19 people were arrested during protests on april 15th. 11 people were injured during the clashes and seven of those people were taken to hospitals. it was just this week we learned the trump administration was not going to go through with threats to cut federal transportation funding to electrify caltrain. (vicki) but now the white house is focusing its budget ax... on earthquakes.. specifically the shake alert early warning system. kron 4's dan kerman is live in san francisco with that (dan kerman)the shake alert early warning system is designed to give people several seconds notice that an earthquake is coming. for individuals it can give them enough time to drop and take cover under something, but those working on the system at uc berkeley's seismological lab say the implications are actually far greater.sot jennifer strauss/uc berkeley seismological lab 25-33a couple of seconds is all you need for a train at a station not to start moving again. but you can think of things like putting all the metering lights to red to prevent more people from getting on the bridge , you can think about stopping elevators to prevent

meterologist lawrence karnow. little warmer, cooling back down heading into next week. lawrence karnow: it's the unofficial start of summer this weekend with the memorial day holiday. many people are going to be traveling around the state this weekend. today was another unusually cool day with temperatures running well below the average for this time of year. clouds continue to linger even now. we ded see a few 70s inland but the fog was slow to clear and in some cased didn't clear at all along the coast to keep highs there in the 50s to low 60s. if you're going out tonight the low clouds and fog will begin to fill into the bay and valleys. and it will be a little breezy toward the coast. it looks like high pressure will begin to build starting on saturday. this should bring some warming to the valleys tomorrow with fog lingering at the coast. we'll let you know if the nice weather is going to stick around through the holiday coming up in a few minutes.

of a disturbing sight in san francisco's castro and mission districts. pigeons have been spotted who appear to have been shot with blow darts. here's one that has been pieced thru the head and survived. there are several photos showing this bird and others on the website reddit. one person on the site claims to have seen at least three wounded birds in recent weeks. we talked to the person who shot this photo eariler in the month. animal control says they've been called to the area several times on reports of people seeing an injured pigeon but so far have been unable to catch any of the birds. a person found responsible for shooting the birds could be charged with animal cruelty. (grant) devastation in a stockton neighborhood...one home is gone...four others are damaged after a massive fire in a pallet yard at a warehouse strong winds quickly escalated things...pushing the flames towards a nearby neighborhood...scorching five homes and sending one woman to the hospital. the victim..now in a burn center after she was unable to escape her home quickly enough. now the neighborhood is left picking up the pieces. hurt in fire):"we couldn't save nothing, but ourselves." every available firefighter in stockton responded to the four-alarm fire, in addition to three outside strike teams. family's in the neighborhood say they have called regulators repeattedly to report code violations at the warehouse for having pallets stacked too high. red cross is now helping those displaced. fire crews are expected to be out for several days to make sure it doesn't flare up again. at this point the cause of the fire is unknown. (estacio reporting) "they slashed all of our couches and had they upside down. this east bay mom who does not want to have her face on camera for fear of retaliation - talked with about how they came home the other day and found their house ransacked. "i was out for mother's day and came out to this." besides slashing the couches - the kitchen was a mess. "all of the cabinets were open, everyting was out on the counters and on the floor." and here on the wall, in their living room, a racial slur. "it was very hurtful." "my children are half black." "my son cried all night long" her daughters extremely upset as well. (grant) redwood city police are asking for the public's help identifying an arson suspect. in the video you can see him starting the fire...then running from the scene.. this happened just before ten o'clock back on may 13th on flynn avenue in redwood city. the fire damaged the home owners cinder block wall... police say the suspect has distinct long dark hair that was pulled back in a pony tail they also said he may have been jumping on people's rooftops in that same neighborhood later that night.. lawrence karnow: it's the unofficial start of summer this weekend with the memorial day holiday. many people are going to be traveling around the state this weekend. today was another unusually cool day with temperatures running well below the average for this time of year. clouds continue to linger even now. we ded see a few 70s inland but the fog was slow to clear and in some cased didn't clear at all along the coast to keep highs there in the 50s to low 60s. if you're going out tonight the low clouds and fog will begin to fill into the bay and valleys. and it will be a little breezy toward the coast. it looks like high pressure will begin to build starting on saturday. this should bring some warming to the valleys tomorrow with fog lingering at the coast. if you're traveling aroung the state you'll find an almost summer-like pattern. there will be plenty of sunshine and 80s in the central valley with 60s along the coast and southern california. highs around the bay area tomorrow will be a little warmer. we will start with morning low clouds but probably a earlier burnoff and that should warm the temperatures to the 70s inland, 60s and 70s around the bay, and 50s to mid 60s at the coast. temperatures should continue to warm over the weekend and into the holiday with some of the warmest

face charges for a 'promposal'. (grant) park rangers are trying to find the person who spray painted "prom?" on a rock in a southern california national park. this happened in the santa monica mountains recreational area at sandstone peak. park rangers say while the gesture may have been grand, it's considered vandalism. they say it's the second year in a row the graffiti has appeared there. who told us something just did not look right. kron 4's ella sogomonian just got to the scene a short time ago. what have you learned? what's left of the single engine glastar plane is still lying in the roadway hazmat crews plugged a fuel leak earlier the plane went down at around 2:45 this afternoon after it turned around to come back to the buchanan field airport because of a mechanical problem.the intersection was closed off as first responders helped the pilot out of the wreckage . the man was still breathing at the time according to robert marshall with the contra costa county fire department but we don't know the extent of his injuries at this point. he was taken to john muir hospital . the roads have since been opened back up. federal aviation administration records this plane is registered to snag would corporation out of brentwood whose owner is said to be jeff klos we don't know if he was a pilot in this incident and the business has not returned our phone calls at this time the faa is now investigating what led up to this crash but we do know that the plane was headed back to

workers and firefighters rush to rescue the nearly two dozen people who fell.( catherine ) this the result of a partial collapse of a building under construction in oakland... the accident happened just after nine-30 this morning... on hawthorne avenue near broadway. that is in the "pill hill" neighborhood. kron four's philippe djegal explains how the workers were pulled out. (philippe)saul duran/witness- "just a boom sound like something collapsing." that's how saul duran describes what he heard just after nine-30 in the morning. he was around the corner, when he heard the second floor of this building on hawthorne avenue partially collapse, and nearly two dozen workers coming down with it. he tried to help pull some people out, stuck in the wet cement... so did others, as you can see from the dried cement on some of the workers' boots. saul duran/witness- "the fire department showed up right away. so, we just tried to help people rescue them, and then they took over." oakland fire department battalion chief ian (yan)

mcwhorter says his crews used tools already on site to help pull the workers out of about two to three feet of wet cement.ian mcwhorter/battalion chief- "shovels, uh, we also used planks and plywood to keep us from stepping through the concrete to get to the trapped victims." for reasons now under investigation by the occupational safety and health administration, or osha... while pouring cement on the second floor of what will be an apartment parking garage... the floor partially collapsed... and, mcwhorter says everyone on it either fell into the wet cement below, or hung on to the scafollding.ian mcwhorter/battalion chief- "approximately 12 members were transferred to various hospitals for minor to, you know, bruises and things like that. no serious injuries." the general contracting company overseeing the project is johnstone moyer incorporated. a company based in san carlos. records from the past five years show they've been inspected 11 times... and, have been cited four times. none injury-related largo concrete incorportated, hired to pour the concrete... has also been inspected 11 times in the past five years. and, cited on four occasions -- and, those were

( steve ) new at six: at least six napa high school students are going to face criminal charges in a hazing case involving the football team. this is a story we first told you about in march of this year. that is when investigators started looking into reports of hazing during the previous school year. the napa county district atttorney's office says no charges will be filed against football coach gerald harris. however is still going over the case and it is possible eleven more students could be charged at some point. coast shake alert. kron 4's dan kerman has been talking to researchers working on the project, he joins us live from san francico.dan? there's nothing that can prevent a major earthquake, like 2014's napa quake or one that's even bigger but for the last decade researchers have been working on an early warning system, to give people advanced warning, even if it's just seconds.sotit only takes a couple of seconds to drop to the ground and find safety jennifer strauss with uc berkeley's seismological lab says the shake alert could also potentially slow down trains, turn on metering light to prevent additional cars from going over a bridge.sot this is something that's actually impacting people parents will know their children will be safe at schools and their businesses
