(james) plus. a major bay area crash kills six and injures others. what police believe may have led up to the deadly accident. ( james ) our top story. a man is in the hospital this morning after being shot by an officer in fremont . kron four's spencer blake has details on what police and witnesses say led up to the shooting. this video was taken by an eyewitness moments áafter a fremont police officer shot a suspect in the parking lot between lucky and orchard supply hardware."one of our officers, a uniformed patrol officer was flagged down indicating, basically a citizen contacted him advising him that a subject was waving

a pipe threatening people."a witness says she saw the pipe, and it was about three feet long.the officer that had been flagged down found the man in the parking lot.there was a short foot chase, and a confrontation after a witness says the suspect ran into a car. "he had, the pipe was in his hand. the officer for a brief moment was in shock himself because the car was there, he bounced off the car. and then next thing you know, the cop shot him. he shot him three times."the witness says the man had his hands up and did not charge at the cop. public information officer ricardo cortes says two officers immediately rendered first aid, and an ambulance took the man to a nearby trauma center.we have no update so far on his condition. another man was i nhis truck making a delivery to lucky when it happened."i heard some gunshots, didn't think anything of it. i didn't know it was actually gunshots. and about a few seconds later, all of fremont pd showed up from all over.""i ducked down because i said, 'oh my god he

shot him!' and he didn't have to shoot him."police have been gathering witness statements placing evidence markers, and processing the crime scene. they haven't identified the suspect yet, and aren't releasing the name of the officer who fired his gun. ( james ) a memorial day tragedy... a horrific crash kills two people in alameda. six other people are fighting for their lives this morning. kron four's alecia reid explains what happened and updates us on the investigation. police were out here investigating for more than 10 hours, trying to piece this all together.one thing they know for sure, is that speed was a factor in this crash.pkg sot - it rolled 8 or 9 times. the mangled truck came to rest at webb ave and park street.after taking out a street light. it was so loud, people living as far as a quarter mile away heard the truck barreling down the

roadway.dave osborne sot - sqealing tires, and you could hear the metal hit the pavement. you could hear the rollingwitnesses say the g-m-c sierra was driving extremely fast southbound on park street, before the fatal collision.sot - it was a big messa woman in a minivan traveling along lincoln way was hit by the truck at park street.sot - by the looks of the minivan, she got clipped. she was really luckythe jaws of life was used to pry open the truck. 7 people were inside. one of them, a woman - died here at the scene. 6 of the other occupants were rushed to the hospital with critical injuries. one of them died soon after.sot - it's sad. it's sadsot - pray for their family that they'll have peacethe driver of the minivan will survive. as neighbors looked on in fear, they tell me accidents and speeding in this area are a common occurrence.carol ziogas - lives nearby sot - there's an increase in population on the island, and we're getting a lot of traffic coming on the island especially on holidays and weekends. it gets really recklesssot - we've all had near misses. my family, my friends, my neighborsmirna grimes sot - everyone speeds through here and there are a lot of children around here standupthis is still an active investigation.it isn't clear if drugs or alcohol played a

part in the crash.reporting from alameda ( james ) happening today... attorney's will give closing arguments in the penalty phase of the trial of anotlin garcia-torres. he was convicted of murdering morgan hill teenager sierra lamar. the prosecution is asking for the death penalty. lawyers for garcia-torres are arguing that he may have been exposed to pesticides that might have caused a mental illness. the closing arguments are set to begin later this morning. ( james ) a brand-new water park in dublin remains open with the exception of two slides after a child was hurt on one of them. during the park's big grand opening on saturday, a ten-year-old fell out of the emerald plunge water slide. officials inspected the water slide yesterday morning. they were trying to make sure it's safe and determine if the rules need to be changed before the slide re-opens. the boy who fell off the slide suffered only minor injuries. ( james ) let's head to at&t park where there was an all out brawl between the

giants and nationals on memorial day. in the 8th inning, giants pitcher hunter strickland throws at nationals star bryce harper. and he wasn't happy. he throws his helmet at strickland and punches are thrown between the two. both teams came out of their dugouts and that's when the brawl started. this lasted about five minutes before both sides were separated. here's what strickland said after the game. reporter: what kicks in when you see him coming after you with a helmet in his hand like that?"it's go time. you gotta protect yourself and stand your own ground obviously, i left the ball over the plate a couple of times with him and he's taken advantage of that, so just want to go a bit inside and obviously it got a little bit too far."( james ) strickland and harper were both ejected. the nationals won, 3 to nothing. the teams play again tonight at 7:00. ( james ) bay area basketball. warriors acting coach mike brown missed the team's practice monday because of the flu. so the

team had a familar face on the sideline. steve kerr coached the team's practice yesterday with brown out. kerr has been out for most of the playoffs with lingering back problems. despite being out there for practice, kerr is unlikely to be on the sidelines for game one of the n-b-a finals. "i'm not ready to coach yet.i'm still feeling a lot of effects of what i've got going on. but with mike being out, i'll take his spot, after he took my spot, media wise. i told the team the good news is the team's really healthy, the bad news is the coaching staff is dropping like flies.>( james ) game one of the finals between the warriors and cavs is set for thursday night at oracle arena. ( james ) breaking news. at least 27 people are dead and hundreds of others are injured after a car bombing in iraq. and isis is claiming responsbility. this happened shortly after midnight their time outside of an ice cream shop in baghdad. families were gathering after they broke their fast as a part of islam's holy month of ramadan. that's when the bomb went off. the attack comes as iraqi troops are pushing the last of isis out of the city of mosul. ( james ) happening now. 12 people are without a home this morning after flames broke out in sonoma. the blaze destroyed a home, several cars and killed a cat. kron four's maureen kelly shows us the aftermath. within five minutes the entire house was totally engulfed .. 80 year old elenor "rusty" cuevas is talking about the house she built 42 years ago which is now destroyed.. it was a handbill house i built

it myself every single shingle put on my hand just devastating.cuevas who didn't want to appear on camera.says three of her tenants lived there.no people were injured. this cat made it out of the fire. but at least one cat was killed.the sonoma valley fire department says those three tenants as well as nine other people who live in other buildings on this parcel have been displacedcueva's is one of thoe people. the building she lives in was untouched by fire.but she has not water or electricity.and they said it could take a long timei don't know what to do i don't know how much is covered as many as 6 cars were also destroyed.including cueva's 58 ford which has been in her family since it was new.here are some photos neighbors took of the fire.which broke out at around 130 am. (maureen) at least 4 neighboring properties were also temporarily evacuated because of the gas leak those presidents of all been allowed to come back home meanwhile the red cross has been giving out debit cards to the people who are either burned out or who's units are uninhabitable

this morning. at some point, the officer ran a routine read of the license plate and learned the car had been stolen out of davis.(take sot) lt. mark donaldsoné vacaville police'when they attempted to stop the vehicle by turning on their lights and sirens, a pursuit began'(track)the chase went from interstate 80 east back into vacaville and eventually made its way to the intersection on nut tree road and nut tree parkway.(take sot) lt. mark donaldsoné vacaville police'the officers broadcast over the raido that they have performed the pit maneuver or pursuit technique' (bridge)'a pit maneuver is often used in police chases, the officer takes the front of his car and taps the back corner of the suspects vehicle. thatúll cause it to spin and eventually bring the car to a stop.'(track)some time shortly after the car came to a halt, shots were fired killing the suspect. police have not identified the man involved.(take sot) lt. mark donaldsoné vacaville police'we have no indication at this point what happened, what lead up to the shooting we do not know if that subject was armed or fired or what happened, still very early in the investigation.'(track)when police towed the car 8 hours after the shooting, you see the bullet holes riddle throughout the windshield and heavy damage to the front and rear of the civic.police say while it unclear if the suspect had a gun, a car could be seen as a weapon and officers have to defend themselves.(take sot) lt. mark donaldsoné vacaville police 'officers obviously are allowed to defend themselves

if they feel like their lives are in danger, at risk of great bdily ijury or death. they can discharge their service weapons to protect their lives or the life of someone else' ( james @ landing ) all across the bay area, ceremonies were held to honor those who died while serving our country. this was the annual memorial's day event aboard the u-s-s hornet museum in alameda. the ceremony concluded with the casting of a wreath into the bay. in san francisco... hundreds of people came out ot the presidio for the annual memorial day commemoration. it began with a march to the national cemetery and a program that included a 21- gun salute, speeches, and flags being placed on the graves of u.s. soldiers. in lafayette, a service paid respect to fallen soldiers in iraq and afghanistan while standing up against the very violence that claimed their

lives. kron 4's ella sogomonian was at the crosses of lafayette - a symbolic site made in the name of peace. sot:ella sogomonian/lafayette //"the memorial day service here in lafayette may be considered unusual to other commemorations happening monday for memorial day across the nation because they're not only one honoring the service men and women who lost their lives in battle in the middle east but also they're protesting was in general." the tradition began in 2011 with one man who planted the first few crosses on this lafayette hillside dedicated to each soldier killed in afghanistan and iraq.sot: jeff heaton, crosses of lafayette founder //"to recognize the tremendous sacrifice that these soldiers have made and this hillside sort of expresses that in a really stark way."the land was donated to the cause by the clark family when they were approached with the idea six years ago.sot: charles clark, family donated land //"jeff heaton came to my mother and said let's make this peace memorial and she's always been a strong, outspoken 'peace- nick' and so she was all in." the crosses of lafayette along with the mount diablo and

welcome back to the kron four morning news. i'm tracking your entertainment headlines today... a sports writer... fired after posting a controversial tweet about the first japanese indy 500 winner takuma sato. denver post writer terry frei said on twitter that he was "very uncomfortable with a japanese driver winning the indianapolis 500 during memorial day weekend." executives from 'the post' called frei's statement "disrespectful and unacceptable." the tweet has since been deleted and frei issued his own apology. frei had been at the post for more than 20 years. (robin) a major milestone at cannes. sofia coppola has been awarded the best director prize at the french film festival. she is only the second woman to win the honor... a soviet director won it back in 1961. the award is for coppola's new film "the beguiled".. starring nicole kidman... it's about a woman who runs a southern girls' boarding school during the civil war. it debuts on june 23rd. after being shot by an officer in fremont. it happened on mowry avenue yesterday afternoon. police say a man was waving a three-foot long pipe and threatening people. when officers arrived, there was a short foot chase and confrontation with the man before an officer shot him. this is the fourth time this year a fremont police officer has shot someone. two people are dead and six are recovering this morning after a crash in alameda. it happened in the area of park street and lincoln avenue yesterday morning. the crash involved a minivan and a full-size truck. police say speed appears to be a factor in the crash. attorney's will give closing arguments in the penalty phase of the trial of anotlin garcia- torres today. he was convicted of murdering morgan hill teenager sierra lamar. the prosecution is asking for the death penalty. lawyers for garcia-torres are arguing that he may have been exposed to pesticides that may have caused a mental illness. the closing arguments are set to begin later this morning. ( james ) happening now in the east bay. police are searching for a man who assaulted another man in a popular berkeley park. it happened sunday morning at the "people's park." that's located off telegraph avenue. police say the attacker threatened the victim and then hit him in the back of the head with a skateboard. the victim was treated for a head injury and is expected to be okay. ( james ) the mayor of benicia is proposing new regulations to be placed on the valero oil refinery. this comes after a flaring

event earlier this monththat sent thick, black smoke into the sky. kron four's charles clifford spoke to the mayor about what changes she wants. back on may 5th, a major power outage at the valero refinery in benicia resulted in a flaring event that sent black smoke pouring into the sky. a nearby industrial area was evacuated, 2 elementary schools were ordered to shelter in place and a dozen people were taken to the hospital.sotmayor elizabeth patterson says it was very alarming and very scary. benicia's mayor, elizabeth patterson, believes the flaring event shows that the refinery needs additional oversight. she is now proposing that the city adopt an industrial safety ordinance, similar to one that's already in place in contra costa county. the goal of the ordinance would be to prevent future chemical releases, create a safety plan for the community and improve air monitoring around the refinery.sot

interest is being questioned after a grass fire in the oakland hills. it broke out yesterday morning near ascot and mastlands drives. that neighborhood is considered a high risk fire zone. firefighters were able to quickly get a handle on it. but while firefighters were on scene, they found a man claiming to have been stabbed. investigators say that man was ánotá stabbed -- and that person is now undergoing a psychological evaluation. ( james ) in gilroy... police arrest two men accused of a home invasion robbery. officers got a call about suspicious activity taking place outside a home. police say they found these two men, jon kovacs and james hall, loading stolen items from a home into a parked car. officers say hall had a gun. police say kovacs is related to one of the victims inside the home.. a small child was inside when the robbery took place. no one was injured. ( james ) bart police arrested a man after they say he attacked a train operator. the incident happened saturday night when the man

allegedly punched a train operator at the pittsburg/ bay point station. a bart officer was able to arrest the man who has now been booked into the contra costa county jail on suspicion of battery. ( james ) a man was attacked and robbed at a bart station in the east bay and the attackers are still on the loose. the crime happened sunday at the richmond bart station. the victim was punched in the face and then robbed. the attacker ran off. police have not yet released a description of the thief. ( james ) former panamanian dictator manuel noriega has died. noriega had undergone surgery in a panama city hospital in march to remove a benign brain tumor. he was placed in a medically induced coma after suffering severe brain hemorrhaging during the surgery noriega ruled the central american nation from 19-83 until he was removed from power by the u-s military in 19-89. noriega spent nearly two decades in a u-s prison for drug trafficking and money laundering. after more jail time in france, noriega returned to panama in 20-11. he was 83

(james) welcome back to the kron 4 morning news. here is a look at the major headlines before you head out the door this morning.... warriors head coach steve kerr will likely miss the n-b-a finals. kerr has been out for most of the playoffs with lingering back problems. he filled in for acting head coach mike brown during yesterday's practice because brown had the flu. game 1 is set for thursday night. the giants and nationals get into a brawl on memorial day. giants pitcher hunter strickland hit nationals star bryce harper with a 98 mile per hour fast ball in the 8th. that's when harper charged the mound. punches were thrown. both players were ejected. washington won 3 nothing. they play again tonight. the a's lost to the indians in cleveland.

( darya ) in the east bay.. police say two people are dead and six are recovering this morning after a crash in alameda. it happened in the area of park street and lincoln avenue yesterday morning. the crash involved a minivan and a full-size truck. seven people were in the truckone of whom died at the scene. another victim in the truck was taken to the hospitalwher e he died of his injuries. the other five people in the truck are in critical condition this morning. the woman driving the minivan has injuries that are non-life threatning. police say speed appears to be a factor in the crash. ( darya ) a brand-new water park in dublin remains open with the exeception of two slides after a child was

hurt on one of them. during the park's big grand opening on saturday, a ten-year-old fell out of the emerald plunge water slide. officials inspected the water slide yesterday morning. they were trying to make sure it's safe and determine if the rules need to be changed before the slide re-opens. the boy who fell off the slide suffered only minor ( mark ) happening today... attorney's will give closing arguments in the penalty phase of the trial of anotlin garcia-torres. he was convicted of murdering morgan hill teenager sierra lamar. the prosecution is asking for the death penalty. lawyers for garcia-torres are arguing that he may have been exposed to pesticides that may have caused a mental illness. the closing arguments are set to begin later this morning. ( darya ) the mayor of benicia is proposing new regulations for the valero oil

refinery.( mark ) this comes after a flaring event earlier this month that sent thick, black smoke into the sky. anny hong his here with the details. anny? ( anny ) the flaring happened back on may 5th when there was a major power outage at the valero refinery. nearby offices were evacuated, two elementary schools were ordered to shelter in place, and a dozen people were taken to the hospital. now mayor elizabeth patterson says the refinery needs additional oversight. she is proposing that the city adopt a new safety ordinance that would prevent future chemical releases, and create a safety plan for the community.

( darya ) happening now in the east bay. police are searching for a man who assaulted another man in a popular berkeley park. it happened sunday morning at the "people's park." that's located off telegraph avenue. police say the attacker threatened the victim and then hit him in the back of the head with a skateboard. the victim was treated for a head injury and is expected to be okay. ( darya ) a person of interest is being questioned after a grass fire in the oakland hills. it broke out yesterday morning near ascot and mastlands drives. that neighborhood is considered a high risk fire zone. firefighters were able to quickly get a handle on it. but while firefighters were on scene, they found a man claiming to have been stabbed. investigators say that man was ánotá stabbed -- and that person is now undergoing a psychological evaluation. without a home this morning after a fire broke out in sonoma. no one was injured in the fire but several cars were destroyed. the fire ruptured a gas line, causing at least four homes nearby to temporarily evacuate. the homeowner says she built the home 42 years ago. ( mark ) three people lived in the home, and nine other people who lived in buildings nearby are being assisted by the red cross. fire crews do not believe the fire was suspicious. ( darya ) in bay area basketball. warriors acting coach mike brown missed the team's practice monday because of the flu. so the team had a familar face on the sideline.( mark ) steve kerr coached the team's practice yesterday with brown out. kerr has been out for most of the playoffs with lingering back problems. despite being out there for practice, kerr is unlikely to be on the sidelines for game one of the n-b-a finals.

a hat that had fallen in the water. the man's name has not been released -- but we do know he is in his mid-fifties. the man jumped off a 20- foot recreational boat. coast guard crews searched by air and water into the night... before suspending the operation. ( mark ) a family is safe after having to be rescued by a helicopter from a rural area of contra costa county. a dad and his two daughters, along with their dog went for a hike sunday morning. they got lost in the las trampas regional wilderness. the dad called for help when they couldn't find their way back. rescue crews were able to find them a few hours later and airlifted the group to safety. ( darya ) the university of california is facing new allegations that the u-c board of regents spent money on parties -- even while voting to raise tuition.. the san francisco chronicle found that since 2012.....u.c. president janet napolitano reimbursed the regents for more than 225- thousand dollars in dinner

( lydia )(lydia)this is the fourth time this year a police officer in fremont has shot someone.(take vo)yesterday's shooting happened after a uniformed patrol officer was flagged down by someone who said a man was waving a pipe and threatening people. the officer chased the suspect and when the two reached the south parking lot of a lucky supermarket they had a confrontation. police said during the confrontation is when the officer shot the person. (sot)"he had, the pipe was in his hand. the officer for a brief moment was in shock himself because the car was there, he bounced off the

police arrested 50-year-old reh-nu singh in connection with the violent attack. ( darya ) happening today... a jury could deliver a verdict in the murder trial of three santa clara county jail guards accused of beating a mentally ill inmate to death. the jury began deliberations last week. michael tyree was found dead in his cell with a ruptured spleen at san jose's main jail in 2015. jereh lubrin, rafael rodriguez and matthew farris are the deputies who could face life in prison if convicted. they are also facing charges connected to the beating of a second mentally ill inmate on the same night. defense attorneys say tyree died when he slipped and landed on the corner of a sink. ( darya ) vacaville police shot and killed a man after a police chase that ended right in front of the vacaville outlets. it happened yesterday morning when police discovered a white 98 honda civic was stolen out of davis. the chase started on

interstate 80 east and ended at the retail outlets. officers were able to stop the suspect's car by tapping the back corner of the car. shots were fired and the suspect was killed. ( darya ) an officer was also injured during the incident. the injuries are not life- threatening. ( mark ) bart police arrested a man after they say he attacked a train operator. police say the man punched a train operator at the pittsburg- bay point station. a bart officer was able to arrest the man who has now been booked into the contra costa county jail. ( mark ) in gilroy... police arrest two men accused of a home invasion robbery. officers got a call about suspicious activity taking place outside a home. police say they found these two men, jon kovacs and james hall, loading stolen items from a home into a parked car.

( darya ) we now know the name of a navy seal killed during a fleet week demonstration in new jersey. we told you about this story yesterday on the kron 4 morning news. special warfare operator first class remington peters died when his parachute failed to open properly during a demonstration on sunday. peters landed in the hudson river. peters was a part of a team that was conducting a coordinated jump into liberty state park in jersey city. the 27-year-old was a veteran of two combat tours and had performed more than 900 jumps. investigators are trying to figure out why his parachute failed. ( mark ) former panama dictator manuel noriega has died at the age of 83. noriega ruled the central american nation from 19-83 until he was removed from

( darya ) a troubling trend called "lunch shaming" is on the rise. when a student doesn't have enough lunch money, schools are taking away a child's hot food, and replacing it with a cold sandwich, or sometimes, no food at all. ( mark ) according to the school nutrition association, 76 percent of school districts across america have students with school lunch debt. even though the average school lunch costs about 2 and a half dollars... administrators say schools don't have the funds to absorb the debt.( darya )

( darya ) a brand-new water park in dublin remains open with the exeception of two slides after a child was hurt on one of them. during the park's big grand opening on saturday, a ten-year-old fell out of the emerald plunge water slide. officials inspected the water slide yesterday morning. they were trying to make sure it's safe and determine if the rules need to be changed

( mark ) happening today... attorney's will give closing arguments in the penalty phase of the trial of anotlin garcia-torres. he was convicted of murdering morgan hill teenager sierra lamar. the prosecution is asking for the death penalty. lawyers for garcia-torres are arguing that he may have been exposed to pesticides that may have caused a mental illness. the closing arguments are set to begin later this morning. ( mark ) the mayor of benicia is proposing new regulations for the valero oil refinery. this comes after a flaring event earlier this month that sent thick, black smoke into the sky. the flaring happened back on may 5th when there was a major power outage at the valero refinery. nearby offices were evacuated, two elementary schools were ordered to shelter in place, and a dozen people were taken to the hospital. now mayor elizabeth patterson says the refinery needs additional oversight. she is proposing that the city adopt a new safety ordinance that would prevent future chemical releases, and create a safety

(ááátriggerááá) the first shooting was around 10-15 on weld street. the victim was shot in the torso. thirty minutes later...another shooting happened a few blocks away on international boulevard. the victim in that shooting was shot in the leg and is expected to be okay. police say they have no idea who the shooters are in both shootings. ( mark ) 12 people are without a home this morning after a fire broke out in sonoma. no one was injured in the fire but several cars were destroyed. the fire ruptured a gas line, causing at least four homes nearby to temporarily evacuate. the homeowner says she built the home 42 years ago.

a kite surfer near a rocky shore. it happened yesterday afternoon near santa cruz. the coast guard sent a rescue boat and a helicopter to help the surfer. boat crews were not able to reach the kite surfer because of the rocks and the weather. the guard got a rescue swimmer to help the kite surfer get to emergency crews. this is

the third rescue of this kind within the last month. the coast guard recommends going to the beach with a group of friends who are able to call for help if needed. ( mark ) a family is safe after having to be rescued by a helicopter from a rural area of contra costa county. a dad and his two daughters, along with their dog went for a hike sunday morning. they got lost in the las trampas regional wilderness. the dad called for help when they couldn't find their way back. rescue crews were able to find them a few hours later and airlifted the group to safety. ( mark ) vacaville police shot and killed a man after a police chase that ended right in front of the vacaville outlets. it happened yesterday morning when police discovered a honda civic was stolen out of davis. the chase started on interstate 80 east and ended at the retail outlets. officers were able to stop the suspect's car by tapping the back corner of the car. shots were fired and the suspect was killed.

widespread 40s and 50s. the marine layer is pretty deep, meaning heavy mist and drizzle will reach the inland valleys. ultimately, we're expecting a partly cloudy day with highs in the upper 50s at the coast, mid 60s to low 70s along the bay shoreline, and mid to upper 70s inland. it will continue to be windy all around. gusts will reach 20 - 30 mph with the strongest reserved for the coast. expect temperatures to remain 5 to 10 degrees below normal through wednesday as a weather system passes through the northern half of the state. this system may bring the bay area light showers tomorrow. after wednesday, inland temperatures will climb to the mid 80s by saturday.

( mark ) a florida family woke up find an uninvited guest in their swimming pool. an alligator decided to go for a swim and made itself at home on the bottom. this gator is about eight feet long. wildlife officials called in a trapper to remove it. the gator was eventually pulled out and relocated the animal.
