thousand square feet of retail space went up in flames 5 months before its scheduled opening in october. at a news conference thursday investigators with the bureau of alcohol tobacco firearms and explosives announced the emeryville fire was no accident sot jill snyder/atf special agentit was intentionally set and considered an act of arson surveillance footage has captured these imagesand investigators say this person on the bicycle, wearing a jacket with a hood, and carrying a backpack is their prime suspect.sotthe video showed a suspect canvassing the building and then entering before the fire.authorities say security officers were on scene at the time of the fire, but not at the location where the suspect entered this is the second time this construction site has gone up in flames. it first happened in july of 2016, and authorities have announced that too was arson though it's unknown if the same person is responsible.sotin both fire there were unauthorized persons identified to be around the building prior to the fire, also the stage of completion of the building was about the same.the building had been framed but dry wall had not been hung.that made the building more vulnerable to fire. atf is offering is now offering a 50 thousand dollar reward for information bleading to the arrest and

(vicki) in east bay news. a tragic accident in antioch. where police say a teen has died after accidentally being shot by a b-b gun. it happened just before ten this morning on palomar drive. once at the scene officers located a 15-year-old boy who was unresponsive and suffering from a chest wound. the victim was taken to the hospital where he died of his injuries. officers discovered the teen had been shot with a pellet rifle in the chest by a juvenile friend. police believe the incident was an accident...and all parties involved are cooperating with the investigation. a former employee has slapped the owners of a pleasanton construction company with an explosive lawsuit. that woman who used to work there... says she was the victim of racist harassment and discrimination.(vicki) kron4's maureen kelly was there as the plaintiff unveiled the pictures she says backs up her claim. the woman filing the lawsuit against southland construction management says the man in this picture posing as donald trump in a cubicle decorated with a confederate flag is her former boss kenneth hayden. we are told this shot features hayden's wife anita who is also the company's cfo. it's believed she's dressed as a trump supporter. she's sitting in another office space with a banner featuring what is by many considered a symbol of slavery, and the words the southland will rise again. here's another of mrs hayden, posing with a confederate flag handbag that these photos where eventually delivered in.this package was given as a gift....to this woman....tishay wright, who says she was the company's

sole african american employee....and the only one to get a present like this in the office. her reaction to the photos.....it made me sick to my stomach. and i felt like dirt like he considered me less than human.she believes the gift she was given to her in retaliation for her previoulsy complaining about kenneth hayden refering to her and another female employee by a sexist swear word. she says there were other acts committed by her employers that made her feel unwelcome...as well as subliminal racism in the office.saying we'll get the mexican's to do it and things like thatwright says when she colained about the gift of the photos and the purse she was fired.wright's attorney says in all his years of handling employment discrimination he's never seen such offensive behavior. he believes the election of donald trump is bringing out the worst in some.. this demonstrates was going wrong with this country and that people feel that his presence that his statements makes it ok for others to add with hatred and to feel that they

"no danger to the public, this seems to be an altercation between two parties that seemed to result in the shooting. but what that was and the details is what we're looking into." anyone with information on suspects or what led to the shooting is being asked to call police.. california.. a grandmother from southern california has pleaded not guilty to the murder of her young grand daughter...and attempted murdf her adult daughter and anher and daughter. 43-year old nicole darrington- clark is accused of attacking her three family members at their home in san bernardino county on monday. her one- year-old grand daughter was killed. back in 2005 darington-clark was found ánotá guilty for resason of insanity in attempted murder of her own children. she spent ten years in a mental hospital but was released in 20-15. she is now being held on three-point-two million dollars bail. (vicki) in other national news tonight... the senate may vote on health care legislation by the fourth of july....(dbx vo) senate majority leader mitch mcconnell says the congressional budget office will issue a new report soon on the senate's version of the bill-- it continues to be negotiated behind closed doors among republicans. mcconnell did not set a firm deadline for the vote. but republicans are impatient

(vcki) a new study tonight suggests children who drink dairy alternatives... may end up shorter than those who drink cow's milk. according to the report from the american journal of clinical nutrition... each cup of non-cow's milk consumed daily led to a loss of about a quarter inch in height... this is compared to the average for a child's age. for example-- a three-year-old who drinks

three cups of rice, soy, or almond milk each day... would be more than half an inch shorter than a three-year-old who drinks three cups of dairy each day. the study suggests one reason for the difference in height might be that plant-based milks do not stimulate insulin-like growth factor production as well as cow's milk does. shot with a pellet rifle in the chest by a friend....a juvenile. it's believed the incident was an accident - and all parties involved are cooperating with the investigation. ( steve ) police are looking for leads tonight in a double shooting that left one man dead. it happened at about 2 a-m in the parking lot of the faioaks pla strip mall in sunnyvale. police say a fight might have led to the shooting but the vestigation is in its early stages. officers did find the body of a 21-year-old man at the scene. the second victim is 24 years old and remains hospitalized in critical condition. their names are not being released. police are checking to see if there is any surveillance video of what happened. "it is a nice gesture. glad to help out." simon's family is a regular here at this straw hat. amanda, "we just wanted to do something for them, it is hard time. terisa estacio. in addition to the fundraiser, there is also a go fund set up for simon. on saturday, the funeral for briana ortega will take place brianna was also a victim in the crash. she attended decoto independent studies school which is in union city. teachers and friends say she was a very generous person. also, kron four has learned, sergio garcia - has died of

his injuries associaated the crash. a relative reached out to kron four saying her nephew was a hard worker and loved his daughter. the cause of the crash remains under investigation. there is no word on whether the driver behind the wheel at the time could be facing charges. in hayward, terisa estacio (steve) the white owners of a pleasanton construction company are being accused of racially harrassing an african american employee and then wrongfully firing the woman when she complained about it. (steve) the employee says she was given a rhinestone

( grant ) there are two men facing charges in the fire that killed 36 people. derick almena and max harris. almena was briefly in alameda county court today... to be arraigned on involuntary manslaughter charges... but he did not even get a chance to enter a plea. his lawyers asked to lower his bail...which is just over a million dollars... and the want to delay the hearing a month... so that almena and harris can appear in court at the same time. this afternoon harris was transferred from los angeles to the main jail in... dublin. he could be in court as early as tomorrow. as for

almena... he is due back in court next thursday. however, almena's lawyers have planned a news conference tomorrow to discuss the case and the charges he is facing. we will keep you posted on air and on kron4.com...as this legal process plays out. catherine. (catherine) family members of a woman who disappeared in the sierra during a fishing trip are speaking out. (catherine) terry blake was last seen by her husband and two children in plumas county when she went fishing by herself sunday afternoon. search and rescue teams found blake's car a mile away from the cabin where her family was staying. her family says they're holding out hope that she'll return... (catherine) sheriff deputies say

they're focusing their search on the feather river, where blake was fishing. (steve) contra costa county is finally fixing alhambra road, after months of being washed out during severe storms this year. (catherine) a request for a new trial for a wisconsin man who was the subject of the netflix hit series "making a murderer" has been denied. (catherine) the wisconsin department of justice denied steven avery's request... he has claimed that his conviction was based on planted evidence and false testimony. he was sentenced to life in prison after being convicted of first-degree murder back in 20-05. (dan kerman)here at police hq in emeryville, atf investigators say those two fires at a san pablo avenue construction site, one this year and one last year were both arson.. now they have surveillance footage of the
